4 AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI
5 SHORES VILLAGE, FLORIDA, AMENDING CHAPTER 18,
6 "PERSONNEL," ARTICLE IV, "POLICE OFFICERS'
7 RETIREMENT SYSTEM," SECTION 18-107, "DEFERRED
s RETIREMENT OPTION PLAN" TO IMPLEMENT
9 NEGOTIATED EXTENSION OF THE POLICE PENSION
10 DEFERRED RETIREMENT OPTION PLAN; PROVIDING
11 FOR CONFLICT; PROVIDING FOR SEVERABILITY;
12 PROVIDING FOR CODIFICATION; AND PROVIDING FOR
13 AN EFFECTIVE DATE

15 WHEREAS, the Village Council of Miami Shores Village, Florida (the "Village")
16 finds it periodically necessary to amend its Code of Ordinances (the "Village Code") to
17 update regulations and procedures to implement municipal goals and objectives; and
18 WHEREAS, the Village has a retirement system that provide for the payment of
19 benefits to its police retirees; and
20 WHEREAS, the following pension amendment is necessary to implement
21 negotiated extension of the Police Pension Deferred Retirement Option Plan; and
22 WHEREAS, the Police Pension Board reviewed the proposed amendment at its
23 January 7, 2025, meeting and voted to recommend approval by a 5-0 vote; and
24 WHEREAS, the Village Council has reviewed the proposed amendments and
25 found them to be in the best interest and welfare of the Village.
26 NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
27 MIAMI SHORES VILLAGE, FLORIDA, AS FOLLOWS':

Section 2. Amendment to the Village Code., Chapter 18, "Personnel," Article
IV, "Police Officers' Retirement Pension System" of the Village Code of Ordinances is
hereby amended as follows -
Chapter 18 - PERSONNEL
ARTICLE IV. - POLICE OFFICERS' RETIREMENT SYSTEM
Sec. 18-107. — Deferred retirement option plan (DROP) for sworn police personnel.
(b) Effective May 5, 1998, subsequent to the approval from the state division of
retirement, current employees with at least 25 but not more than 30 33 years of
continuous service as a member of the plan may elect to participate in the deferred
retirement option plan (DROP) for sworn police personnel in accordance with this section.
(d) An employee electing to participate in the deferred retirement option plan for sworn
police personnel including existing DROP participants, may participate in such plan for a
maximum of e�qht years 60-menthe before the employee attains 30 33 years of continuous
service.

Section 3. Conflicting Provision., Any provisions of the Code of Ordinances
of Miami Shores Village, Florida, in conflict with the provisions of this Ordinance are
hereby repealed, but only to the extent of such conflict.
Section 4. Severability. The provisions of this Ordinance are declared to be
severable and if any section, sentence, clause, or phrase of this Ordinance shall, for any
reason, be held to be invalid or unconstitutional, such decision shall not affect the validity
of the remaining sections, sentences, clauses, and phrases of this Ordinance, but they
shall remain in effect, it being the legislative intent that this Ordinance shall stand
notwithstanding the invalidity of any part.

Section 5. Codification. It is the intention of the Village Council and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the Miami Shores Village, Florida, that the sections of this
Ordinance may be renumbered or re -lettered to accomplish such intentions, and that the
word "Ordinance" shall be changed to "Section," or other appropriate word.
Section 6. Effective Date. That this Resolution shall take effect immediately
upon the adoption hereof.
