2025-04RESOLUTION NO. 2025-04 A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, APPROVING A NON- EXCLUSIVE LICENSE AGREEMENT FOR PARKING BETWEEN MIAMI SHORES VILLAGE AND MIAMI SHORES PRESBYTERIAN CHURCH; PROVIDING AUTHORIZATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Miami Shores Village (the "Village") has a need for parking for the members of the public that use the C. Lawton McCall Community Center (the "Village Community Center") located at 9617 Park Dr, Miami Shores, FL 33138; and WHEREAS, Miami Shores Presbyterian Church (the "Licensor") is the fee simple owner of the real property located at 602 NE 96'h Street, Miami Shores (the "Licensed Property"); and WHEREAS, the Village and Licensor previously agreed upon the Village's use of the Licensed Property and now wishes to memorialize such terms and conditions; and WHEREAS, the Village Council desires to enter into a license agreement with the Licensor for use of the Licensed Property in substantially the form attached hereto as Exhibit "A" (the "Agreement") and authorize the Village Manager to execute the Agreement with the Licensor; and WHEREAS, the Village Council finds that this Resolution is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted., The foregoing recitals are true and correct. Section 2. Approval., That the Village Council approves the Agreement with the Licensor. Miami Shores Village Resolution 2025-04 1 Section 3. Authorization and Implementation. The Village Manager is authorized to execute the Agreement, attached as Exhibit "A," on behalf of the Village, subject to approval as to form and legal sufficiency by the Village Attorney, and take any action necessary to implement the purposes of this Resolution. Section 4. f-ffective Date, This Resolution shall take effect immediately upon the adoption hereof. PASSED AND ADOPTED this 21 st day of January, 2025.
