2024-09-03 Council Minutes1 MEETING MINUTES SEPTEMBER 3, 2024 6:30 PM COUNCIL CHAMBERS 1) CALL TO ORDER Mayor Burch called the meeting to order at 8:29 PM. 2) MOMENT OF SILENCE / PLEDGE OF ALLEGIANCE 3) ROLL CALL Present: Mayor George Burch Vice Mayor Jesse Valinsky Councilmember Jerome Charles Councilmember Sandra Harris Councilmember Neil Cantor Also Present: Village Manager Esmond Scott Village Attorney Chanae Wood Village Clerk Ysabely Rodriguez 4) ORDER OF BUSINESS Councilmember Harris asked for the deferral of board appointments in the interest of time. Councilmember Charles voiced concern on not having enough time to research board appointment applications. There was consensus amongst the Village Council to keep board appointments on the agenda. Village Manager Scott deferred item 11C to the September 17th Council meeting. Mayor Burch moved to approve the order of business as amended, deferring item 11C to the next meeting and to have item 5C moved to the beginning of the meeting. Councilmember Charles seconded the motion which carried a 5-0 voice vote. 2 5) PRESENTATIONS 5.A PRESENTATION REGARDING MIAMI SHORES PARTICIPATION IN INTERNATIONAL COASTAL CLEANUP DAY (BY: DAVE DOEBLER- VOLUNTEER CLEAN-UP.ORG). Dorothy Campbell, resident of Miami Shores, provided an overview of the event, which will be held on September 21, 2024 (9am to 12pm), and encouraged residents to volunteer at said event. 5.B PRESENTATION REGARDING THE MIAMI SHORES BOAT PARADE COMMUNITY OUTREACH PROJECT (BY: KIM JUANICO MCADAM). Kim McAdam provided an overview of the event and asked residents to support the event in any way possible. 5.C THE PROMOTION OF A POLICE CAPTAIN, POLICE SERGEANT, AND POLICE DETECTIVE ALONG WITH THE OFFICER OF THE YEAR PRESENTATION. Chief of Police David Golt, promoted Officer Justin Zalonis to the rank of Police Captain, Officer Evan Greene to the rank of Police Sergeant, Officer Christopher McDonald to the rank of Police Detective and presented the Officer of the Year award for 2023 to Officer Martha Tejera. 6) BOARDS/COMMITTEES REPORT 6.A HISTORIC PRESERVATION BOARD REPORT CONCERNING HISTORIC MARKERS (PRESENTED BY: CHAIRPERSON PATRIZIA BONADUCE). Ms. Bonaduce provided an overview of the item, requesting Council consideration of the historic markers. Vice Mayor Valinsky and Councilmember Charles thanked the committee and residents time and efforts in putting together their presentation to the Council. Village Clerk Rodriguez spoke about encouraging the boards and committees to utilize the new boards and committees section of the agenda to update the Council on recommendations. Councilmember Harris also reminded the boards and committees to consult with legal regarding procedures. Village Attorney Wood clarified that the process of passing historic marker guidelines was not properly addressed from a procedural standpoint. Such matters should be presented to the staff liaison and the Village Attorney for review. Staff in turn presents the item to the Village Council. 6) MANAGER'S UPDATE Village Manager Scott provided an update regarding various projects that are to be completed. Councilmember Cantor presented the Capital Projects tab which is now on the main website for any updates to ongoing projects in the Village. Village Manager Scott also introduced the new Public Works Director Delroy Peters to the Council. 7) PUBLIC COMMENTS Peter Hosfeld spoke about the possible use of the 9900 building for the display of art exhibits hosted by the Fine Arts Commission. Village Clerk Rodriguez read eComments into the record. 9) CONSENT AGENDA 3 9.A APPROVAL OF THE JULY 2, 2024 VILLAGE COUNCIL MEETING MINUTES (STAFF: VILLAGE CLERK). Vice Mayor Valinsky moved to approve the consent agenda and Mayor Burch seconded the motion which carried a 5-0 voice vote. 9.B APPROVAL OF THE JULY 15, 2024 BUDGET WORKSHOP MINUTES (STAFF: VILLAGE CLERK). PASSED ON CONSENT. 9.C APPROVAL OF THE JULY 16, 2024 VILLAGE COUNCIL MEETING MINUTES (STAFF: VILLAGE CLERK). PASSED ON CONSENT. 10) BOARD APPOINTMENTS 10.A APPOINTMENTS TO THE PLANNING AND ZONING BOARD (STAFF: VILLAGE CLERK). Village Clerk Rodriguez provided opening remarks, detailing the application and selection process. Village Clerk Rodriguez provided opening remarks, detailing the application and selection process and also read eComments into the record. Village Clerk Rodriguez provided opening remarks, detailing the application and selection process. Vice Mayor Valinsky moved to appoint Jesse Cangiano, Kirk Gilliland-Rodriguez and Patrick Huber to the Code Enforcement Board. Councilmember Harris seconded the motion which carried a 5-0 voice vote. 10.D APPOINTMENT TO THE AD HOC TRAFFIC ADVISORY COMMITTEE (STAFF: VILLAGE CLERK). Village Clerk Rodriguez provided opening remarks, detailing the application and selection process. Vice Mayor Valinsky moved to appoint Dennis Leyva to the Ad Hoc Traffic Advisory Committee. Councilmember Harris seconded the motion which carried a 5-0 voice vote. Discussion ensued regarding the adjournment of the meeting pursuant to the rules of procedures which requires the meeting to end by 10:00 PM unless extended by the majority of the Councilmembers. In response to Councilmember Charles' inquiry, Village Attorney Wood explained that while the pending items are not urgent, delaying the legal advertisement ordinance could have a financial impact on the Village. 11) ORDINANCE(S) ON FIRST READING 11.A AN ORDINANCE OF THE MIAMI SHORES VILLAGE, FLORIDA, AMENDING THE VILLAGE S CODE OF ORDINANCES BY AMENDING CHAPTER 6, BUILDINGS AND BUILDING REGULATIONS, ARTICLE I, IN GENERAL, SECTION 6-4, PERMITS APPLICATION GENERALLY TO UPDATE REGULATIONS TO CONFORM WITH THE FLORIDA BUILDING CODE REQUIREMENTS FOR PERMITTING AND REMOVE OBSOLETE PROVISIONS RELATED TO SOLAR PHOTOVOLTAIC SYSTEMS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE ( STAFF: BUILDING OFFIICAL). Councilmember Harris seconded the motion which carried a 3-2 voice vote. Councilmembers Charles and Cantor voted in opposition. The meeting adjourned at 10:02 PM. 6
