2024_06-03 SRC Minutes Workshop 1 SUSTAINABILITY AND RESILIENCY COMMITTEE Wednesday, March 6th, 2024 Workshop Conference Room 10050 NE 2nd AVE 6:30 PM MINUTES 1. CALL TO ORDER –Ms. Meyer called the workshop to order at 6:30pm 2. ROLL CALL Present: Ms. Rangel Ms. Kang Ms. Meyer Mr. Pluhar Ms. Respondek Absent: Ms. McSherry Ms. Casey Also, Present: Mr. Chris Miranda –Public Works Director Ms. Alizgreeth Tezen –Planning and Zoning Technician 3. MINUTES (S): 3.a. Postpone for the next Meeting in April 10th, 2024. 4. DISCUSSION ITEM: 5.a. Tree Ordinance Update (Draft 11.20.23) https://cloud.msvfl.gov/s/NPMjcrTbH9yETMz Mr. Miranda asked to have this workshop as an opinion to the draft and to provide input to staff to provide to Village Council since this already went through first reading. Ms. Respondek spoke about the 20 percent rule for the swale and how can this affect those who do not meet the criteria and have unique circumstances. Chair Meyer asked would this be part of an additional division? Mr. Miranda yes. Ms. Rangel asked would this be the best ordinance to create as a staff guideline? 2 Mr. Miranda stated no. Mr. Pluhar asked about the fee for removing trees. Mr. Miranda stated that if the tree were a specimen tree (Any tree over 20 inches in diameter) then that would be by the circumference of the tree and the height. This would impact the cost per circumference, the revenue would go towards a tree account and is used to match 50/50 grant given by the county. Ms. Rangel stated that clarification on lines 57 and 71 should include how it will benefit the community in a tangible way. Chair Ms. Meyer stated that line 66-69 should include “in addition to residents tree lines can increase property values..” Ms. Rangel asked would it be best to include the specimen tree types on this line ideally provide a hyperlink of Florida protected list. Ms. Respondek asked should “vines be part of the list of cutting and injuring trees...” Mr. Miranda stated that in some cases vines are planted on the trees by the residents and once it is placed on public swale it becomes Village property. Chair Ms. Meyer asked about line 13 can it state that “unless the tree is otherwise exempt Public Works shall, be pruned…” Mr. Miranda stated that we do not govern the trees by the county and are maintained through a mutual agreement through them. In the Village website it would be effective to provide a map of what trees belong to the Village and what doesn’t, Ms. Rangel added. Ms. Rangel and Chair Ms. Meyer asked to remove the word “current..” from line item 142. Chair Ms. Meyer asked would it be best for the “recommendation of a homeowner to provide a proposed location of new trees...”. Mr. Miranda stated it would be per the design recommendation of the arborist, landscape architect, etc. Chair Ms. Meyer asked would it be best to hold up a homeowner certificate of occupancy if they didn’t comply with the landscape?. Mr. Miranda stated that it would only be held from being issued not revoked. Ms. Rangel spoke about line 193, and what are considered “criteria’s” referenced to the line 133 from exempt..” These type of items should circle back to public works department. Can a tree be cut to the property line? Ms. Rangel asked. Mr. Miranda stated yes, just as long as it is not to the public swale. Item 11 should be added after 126 “pruning of roots on public trees on public sidewalks are the essential for any repair and improvement will be performed by public works on sidewalks where they are a nuisance on private property to reach out to public works...” Pruning of roots encroaching on public property is the responsibility of public works. Line 237, add the word “After-the-Fact (ATF) Permit and ATF…” and “Application for an ATF are double”.. Reference code sec. 538.2 as it was not shown on Municode, per Chair Ms. Meyer. Line 277 provide hyperlink to the prohibited trees added by Ms. Rangel. Ms. Kang asked is there a process to replace an invasive tree with a tree that will benefit in its place? Mr. Miranda stated that Public Works has a process for that. Ms. Kang asked what the requirements of TreeUSA are and what would be the benefit in placing a new tree. Clarification for item 4. As well as item 5. Line 505 and 515. Add better numbering and order to make it cleaner. Add a paragraph of planting new trees, and providing the beautification of creating new trees. Tree Ordinance workshop notes from 3/6/23 (Provided by Chair Ms. Meyer) 3 Add language that we want to become a Tree City USA and why this is important. Line 64: define Economy Line 69: In addition, tree lined streets might improve property values. Line 64-69: we like the language of Miami Beach, consider rewording more like theirs. Line 127 add: Pruning of roots of public trees that are essential for any repairs and improvements will be performed by the Public Works Department. When roots of public trees encroach on private property, pruning is the responsibility by the property owner. Contacting the Public Works department for consultation is preferred. Line 76: add a link or footnote to what a Florida Protected Tree is (Municode Miami -Dade?) Line 133 Delete sentence from "except" on Line 142: remove "current" Line 197 on (i) (ii) iV v edo the numbering Line 237: An ATF public tree Line 239: ATF are double Line 256, 261: reference the code, where can one find it? Lines 278: explain why there trees don't have to be replaced Line 277: add a link of footnote to what verified prohibited tree species are Line 505-515: is this list amending the prohibited plant species list? What is 538.2.? Why were these trees added in addtion to the list of prohibited plant species published in the Miami Dade County Landscaping Manual? We propose to delete this paragraph Line 514: does this only pertain to canal banks? Line 544-550: move to 386 5. BOARD MEMBER COMMENTS Green Day- April 27th, 2024. The committee asked about items and possible booth for them to be part of. Asked staff to provide location and items to share at the Green Day event. 6. NEXT COMMITTEE MEETING – April 10th, 2024 7.
