There was a request for clarification about this property and Ms. Hasbun stated that the current zoning map shows it as multifamily and that was the correction. Approved of minutes Mr. O'Hara seconded by Mr. Finklestein. 4-0. Ms. Hasbun read out loud the ordinance of the extensions and explained the permit process must be started by the deadline of the 6 months. 2023-3-23 PB Minutes.pdf 2 4) ACTION ITEM(S): 4.A STPL-5-2021 Owner: Domenico Alessandro Applicant: Domenico Alessandro Agent: N/A Address: 1255 NE 93rd ST Request: Development Order Extension The architect (spoke at the podium) Mr. Bolton asked Ms. Hasbun why the applicant took a delay from the time of the new ordinance in December until April to ask for administrative extension, to which the architect stated that it was due to the external agencies and abiding by the 50 percent rule for flooding purposes. Motion to approve by Mr. Bolton seconded by Mr. O'Hara 4-0. Mr. Busta asked if there was a reason why they are asking for an extension to which she stated it was due to various reasons. Mr. Bolton asked if they have until May to turn in the plans, to which Ms. Hasbun stated that if they don't turn it in by May deadline then they have to return to the Planning and Zoning Board. Ms. Hasbun stated that they needed to go through the 3 external agencies in order to move forward with the building department. Ms. Hasbun stated that work was not commenced until now and therefore it was a different development order. Mr. Busta asked why they took so long to obtain the permit. Ms. McConney stated that it's due to the fact that since this is a commercial project it's different than a residential project and its more extensive with DERM and HRS. Mr. Bolton asked why is there a box in the middle of the house and Ms. Ramos stated that it's a lower level and it's to help to level it to the roof. Ms. Ramos stated that the area is for the kitchen to be expanded to provide height and they asked if there is going to be a parapet wall to which Ms. Ramos stated that it will be run off. Mr. O'Hara asked about the comments made by the board members, to which Ms. Hasbun stated that the board approved with conditions to repurposing windows/awnings over windows, same stucco and color, the garage conversion into cabana maintain the wood floor. 4 Mr. O'Hara asked about Sheet A-3.0 east elevation and removing the set of windows and Mr. Ocariz stated that a new kitchen will be replaced there with a solid wall. Mr. O'Hara asked about the addition on Sheet A-4.0 south elevation and stated that it looks modern than Mediteranea revival. The addition must be distinguished than the current historic home. Awnings will be included and sliding doors will also be placed. Mr. Busta asked about the colors of the house and commented on the stucco being able to match it to the existing. Public commentator: Carlos Guadamuz A letter was submitted to the board members opposing the project because it is imposing on the neighbors due to the views, economic concerns, and day to day life and value of the adjacent properties. The second floor is an issue for privacy and visibility for the neighbors. The house also changes the character of the neighborhood of Miami Shores. Mr. Bruce stated that the windows are not imposing on the privacy of the neighbor also the max building allowed is not exceeding the 30 feet allowed. Mr. O'Hara asked if the owner reached out to any of the neighbors to advise on the development. Mr. O'Hara stated that the owner should come back with comments and time to address the concerns of the neighbors. Motion to table by Mr. O’Hara 1-4. Motion did not pass. Ms. Woods elaborated with what "IF" the planning and zoning board does not approve the development order to which Ms. Hasbun stated that the applicant has 30 days to appeal. Mr. Busta wanted to add a comment that the letter intent was well written and asked if the applicant wanted to make a presentation. Mr. O'Hara wanted to clarify that the applicant was not aware of him having to be present. Mr. Bolton asked about an application in January on a Variance on the drainage field being raised and a small wall was put to accommodate the driveway and asked about following up on this request. Board members were concerned about the variance and being able to assist this case. Mr. Bolton stated that he appreciated the electronic process and stated that the electronic review process in an easier way to save paper and reduce delivering the packages. Ms. Hasbun stated that this would be added part of the budget process. Mr. Finkelstein asked if parking a trailer is part of a zoning question.
