3 AN ORDINANCE OF THE VILLAGE COUNCIL OF
4 MIAMI SHORES VILLAGE, FLORIDA, AMENDING
5 THE VILLAGE'S CODE OF ORDINANCES BY
6 AMENDING CHAPTER 11, "HISTORIC
7 PRESERVATION," SECTION 11-2, "DEFINITIONS"
8 TO AMEND CERTAIN DEFINITIONS; SECTION 11-
9 4, "HISTORIC PRESERVATION BOARD," TO
10 CLARIFY THE POWERS AND DUTIES OF THE
11 HISTORIC PRESERVATION BOARD REGARDING
12 HISTORIC MARKERS AND CERTIFICATES OF
13 RECOGNITION; AND SECTION 11-5,
14 "CLASSIFICATION PROCEDURE" TO REMOVE
15 THE REQUIREMENT OF PLANNING AND ZONING
16 BOARD REVIEW OF HISTORICALLY
17 DESIGNATED PROPERTIES; PROVIDING FOR
18 CONFLICT; PROVIDING FOR SEVERABILITY;
19 PROVIDING FOR CODIFICATION; PROVIDING
20 FOR AN EFFECTIVE DATE.

21 WHEREAS, the Village Council of Miami Shores Village, Florida (the "Village")
22 finds it periodically necessary to amend its Code of Ordinances (the "Village Code") in
23 order to update regulations and procedures to implement municipal goals and
24 objectives; and
25 WHEREAS, the Village Council wishes to amend Chapter 11, "Historic
26 Preservation," Section 11-2, "Definitions" to amend certain definitions; and
27 WHEREAS, the Village Council also wishes to amend Section 11-4, "Historic
28 Preservation Board," to clarify powers, duties, and jurisdiction of Historic Preservation
29 Board, as it relates to historic markers and certificates of recognition; and
30 WHEREAS, the Village further wishes to amend Section 11-5, "Classification
31 Procedure" to remove the requirement of planning and zoning board review of
32 historically designated properties; and
33 WHEREAS, the Village Council finds that this Ordinance is in the best interest
34 and welfare of the residents of the Village.

(c)Designation of historic landmarks. The historic preservation board shall recommend
to the planning and zoning board village council, buildings, and structures, to be
designated as historic landmarks. Once revie1Ned by the planning and zoning board
a recommendation shall be moved to the village council f.or final approval or denial.
Upon consideration of the planning and zoning board historic preservation board
consideration recommendation, the village council may designate the property or
site as a historic landmark, in accordance with section 11-3 of this chapter.

115 Section 3. Conflicting Provision. Any provisions of the Code of Ordinances of
116 Miami Shores Village, Florida, in conflict with the provisions of this Ordinance are
117 hereby repealed, but only to the extent of such conflict.
118 Section 4. Severability. That the provisions of this Ordinance are declared to
119 be severable and if any section, sentence, clause, or phrase of this Ordinance shall, for
120 any reason, be held to be invalid or unconstitutional, such decision shall not affect the
121 validity of the remaining sections, sentences, clauses, and phrases of this Ordinance,
122 but they shall remain in effect, it being the legislative intent that this Ordinance shall
I 23 stand notwithstanding the invalidity of any part.
124 Section 5. Codification. That it is the intention of the Village Council and it is
125 hereby ordained that the provisions of this Ordinance shall become and be made a part
126 of the Code of Ordinances of the Miami Shores Village, Florida, that the sections of this
127 Ordinance may be renumbered or re-lettered to accomplish such intentions, and that
128 the word "Ordinance" shall be changed to "Section," or other appropriate word.
129 Section 6. Effective Date. That this Ordinance shall become effective
130 immediately upon adoption on second reading.
