2024-14RESOLUTION NO. 2024-14. A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, OVERRULING THE DECISION OF THE PLANNING & ZONING BOARD TO DENY THE VARIANCE APPLICATION SUBMITTED BY THE APPLICANTS, LANCE & JENNIFER TINKLER; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Village Planning and Zoning Board, on November 16, 2023, denied the variance application VAR-23-41 (D.O. No. 23-41 ), submitted by Lance & Jennifer Tinkler (the "Applicants") for a five (5) foot front wall and fence with five (5) foot and six (6)inches columns on the property legally described in Exhibit "A;" and WHEREAS, the Applicants timely appealed the decision of the Planning and Zoning Board to the Village Council in accordance with Section 800 of the Village Zoning Code of Ordinances; and WHEREAS, Staff recommended approval of the requested variance in its report dated November 16, 2023; and WHEREAS, Public notice was provided in accordance with the law; and WHEREAS, the Village Council has reviewed the findings of the Planning and Zoning Board and determined that the decision was unreasonable and not in accordance with the purposes of the Village Zoning Code; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA: Section 1. Recitals Adopted. That each of the above-stated recitals are hereby adopted, confirmed and incorporated herein. Section 2. Decision Overruled. The decision of the Village Planning and Zoning Board to deny the variance application submitted by the Applicants, as described in the Planning and Zoning Board's findings dated November 16, 2023, is hereby OVERRULED.
