1) CALL TO ORDER
Mayor Harris called the meeting to order at 6:33 PM.

A change to the order of business was requested by allowing Council discussion before opening public
comments.
Vice Mayor Marinberg moved to change the order of business as indicated above and Councilmember
Saint Fleur seconded the motion which carried a 5-0 voice vote.
4) ORDINANCE(S) ON FIRST READING-PUBLIC HEARING
4.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA,
AMENDING THE VILLAGE COMPREHENSIVE PLAN BY AMENDING THE FUTURE LAND USE
ELEMENT AND FUTURE LAND USE MAP (FLUM) FOR PROPERTIES LOCATED IN MIAMI
SHORES VILLAGE; PROVIDING FOR TRANSMITTAL; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE (STAFF:
PLANNING & ZONING DIRECTOR).

Village Clerk Rodriguez read the caption of the ordinance into the record.
Mr. Jim Karas, facilitator, delivered a presentation regarding the findings concerning the Resident
Workshop held on November 28, 2022. Mr. Karas answered questions posed by the Village Council.
Ms. Claudia Hasbun, Planning & Zoning Director, delivered a presentation, providing a chronology of
public engagement efforts concerning the comprehensive plan amendments.
Vice Mayor Marinberg spoke about the allegations regarding a presumed conflict of interest, elaborating
on the financial disclosure forms he has filed and his former and current employment background. He
further clarified there is no conflict of interest.
Responding to Vice Mayor Marinberg, Ms. Hasbun clarified the proposed comprehensive plan does not
eliminate single-family residential zones. She further clarified single family homes can be as high as 30
feet from flood elevation.
Vice Mayor Marinberg indicated that the property located west of 105 Street and Biscayne Boulevard
was zoned and is still zoned as multi-family.
Vice Mayor Marinberg requested specificity concerning the phrase “auto related uses” (lines 301-306).
Ms. Hasbun clarified definitions should be included in the zoning code and not in the comprehensive
plan.
Vice Mayor Marinberg moved to change floor height nomenclature to reflect feet in lieu of stories and
Councilmember Burch seconded the motion, which carried a unanimous vote.
Vice Mayor Marinberg noted the inclusion of language concerning the prohibition of subdivision of lots
and “barriers that are not temporary in nature will not be removed.”
Vice Mayor Marinberg noted the 10500 Biscayne Boulevard property currently reflects mixed-use
designation. Vice Mayor Marinberg proposed reducing the height of said property to 35 feet.
Councilmember Burch moved to reduce the height of the 10500 Biscayne Boulevard property to 35 feet
and Vice Mayor Marinberg seconded the motion, which carried a unanimous vote. Ms. Hasbun clarified
a new land use designation or exception may be required.
Councilmember Burch moved to change the 10500 Biscayne Boulevard land use designation from mixed
use to multi-family land use designation. The motion failed due to a lack of second.
Vice Mayor Marinberg advocated for the 10500 site to keep a designation that allows for multi-family use
and/or the flexibility of commercial uses limited to the 35 feet height restriction. Ms. Silvia Vargas, Calvin
Giordano & Associates representative, explained that a special district or an exception can be created.
(Action was not taken, as the land use designation is currently mixed-use and the height limitation of 35
feet was approved my majority vote.)
Vice Mayor Marinberg (lines 210-212) proposed removing "Development shall be considered Mixed Use
when no one use is less than 20% or no greater than 80% of the net overall square footage of a
development.” On line 311, Vice Mayor Marinberg proposed the addition of "horizontal mixed use projects
may include two or more." Ms. Hasbun clarified there is no prohibition of non-retail and restaurant uses
on first floor in the Downtown District. There was consensus on the above noted recommendations.
Mayor Harris called for an intermission at 7:54 PM. The meeting resumed at 8:08 PM.

Councilmember Burch read a letter into the record, thanking residents for their civic participation and
expressing her position regarding the proposed amendments to the Comprehensive Plan.
Councilmember Wagar clarified there is a State coordinated process in place and whatever the outcome
of the item is today, it is not a definitive conclusion.
Mayor Harris opened the public hearing.

Maureen Duffy spoke in opposition to the comprehensive plan.

Darci Cohen expressed concerns regarding increased density and asked the Village Council to consider
keeping parking lots or creating a separate designation.

Victor DeJesus spoke about the importance of a master plan and other factors that should be considered
such as parking, density, and traffic.

Mike Allen, Barry University President, spoke in support of the proposed plans for the property west of
Barry University and spoke in support of collaborating with the Village.

Mayor Harris moved to approve the ordinance on first reading and Councilmember Saint Fleur seconded
the motion, which carried a 4-1 voice vote. Councilmember Burch voted in opposition.
No further action was taken.
Mayor Harris spoke about the need for a special meeting to discuss the potential appointment to the
vacant office of Councilmember in light of Councilmember Saint Fleur’s resignation. Mr. Scott indicated
there may be availability amongst the Councilmembers to meet on December 28, 2022.
Councilmember Saint Fleur indicated her official resignation date would become effective December 15,
2022. Councilmember Saint Fleur further mentioned the reason for her resignation, indicating she is a
registered lobbyist and due to recent legislation, she cannot be a councilmember and a registered
lobbyist. Councilmember Saint Fleur expressed gratitude for the support she has received from fellow
Councilmembers, administration, staff, and residents. Individual Councilmembers thanked
Councilmember Saint Fleur for her dedicated service and wished her all the best in her future endeavors.

Discussion resumed regarding the special meeting concerning the vacancy. There was consensus to
conduct a special meeting to potentially appoint a replacement on Wednesday, December 28, 2022 at
the 9900 Building, beginning at 6:30 PM. Candidates will have up to five minutes to provide introductory
remarks. There was further discussion regarding the candidate application process.
By way of consensus, Village Clerk Rodriguez was directed to open the application process for the
Councilmember vacancy on December 15, 2022, requesting letters of interest, resumes, and proof of
qualification, until Thursday, December 22, 2022.
No further action was taken.

There being no further business before the Village Council, the meeting adjourned at 10:55 PM.
