Ordinance 2023-081 2 ORDINANCE NO. 2023-08 3 AN ORDINANCE OF THE VILLAGE COUNCIL OF 4 MIAMI SHORES VILLAGE, FLORIDA, 5 COMPREHENSIVELY UPDATING AND AMENDING 6 CHAPTER 20, "STREETS, SIDEWALKS AND 7 OTHER PUBLIC PLACES," ARTICLE V., 8 "STORMWATER UTILITY" BY ADDING DIVISION I, 9 "STORMWATER UTILITY SYSTEM" AND 10 CREATING DIVISION II, "STORMWATER 11 QUALITY," PERTAINING TO ILLICIT DISCHARGES 12 AND CONNECTIONS, EROSION AND SEDIMENT 13 CONTROL, AND OTHER WATER QUALITY 14 REGULATIONS; PROVIDING FOR SEVERABILITY; 15 PROVIDING FOR CONFLICT; PROVIDING FOR 16 CODIFICATION; PROVIDING FOR AN EFFECTIVE 17 DATE. 18 WHEREAS, Miami Shores Village (the "Village") is committed to environmental 19 conscientiousness and is located along an interconnected system of waters that provide 20 habitat for fish and wildlife, opportunities for recreation, and an enhanced quality of life; 21 and 22 WHEREAS, the Village has determined that illicit discharges to the stormwater 23 system result in the damage and loss of natural resources, including the degradation of 24 water quality; and 25 WHEREAS, discharge of pollutants directly or via stormwater runoff into the 26 surrounding waterways degrades water quality and poses a public health risk; and 27 WHEREAS, storm drains that overflow, or are not properly protected or 28 maintained, can permit an accumulation of pollutants to enter the stormwater system and 29 discharge into the Village's interconnected waterways; and 30 WHEREAS, as an operator of Municipal Separate Storm Sewer Systems ("MS4") 31 and a co-permittee under the National Pollutant Discharge Elimination System ("NP DE S") 32 Permit No. FLS000003, the Village is required to prohibit illicit discharges, illicit 33 34 35 36 37 38 39 40 41 connections, illegal dumping, improper disposal and spills into the stormwater system, and is required to have the authority to enforce such prohibitions; and WHEREAS, this Ordinance was duly noticed and presented to the Village Council in two readings, with second reading conducted as the required public hearing on ______ ,2023;and WHEREAS, the Village Council finds that this Ordinance is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AS FOLLOWS: 1 42 Section 1. Recitals Adopted. That Chapter 20 -Streets, Sidewalks and Other Public Places of the Village Code of Ordinances is hereby created as follows: Chapter 20 -STREETS, SIDEWALKS AND OTHER PUBLIC PLACES *** ARTICLE V. -STORMWATER UTILITY Division I. Stormwater Utility System. *** Division II. Water Quality. Sec. 20-111. Scope and purpose.
