Ordinance 2023-071 2 ORDINANCE NO. 2023-07 3 AN ORDINANCE OF THE VILLAGE COUNCIL OF 4 MIAMI SHORES VILLAGE, FLORIDA, AMENDING 5 APPENDIX, A, "ZONING," SECTION 906, 6 "ISSUANCE OF DEVELOPMENT ORDERS" TO 7 INCLUDE PREREQUISITES FOR DEVELOPMENT 8 ACTIVITY AND ISSUANCE OF DEVELOPMENT 9 PERMITS IN ACCORDANCE WITH THE NATIONAL 10 POLLUTANT DISCHARGE ELIMINATION SYSTEM 11 ("NPDES") PERMIT NO. FLS000003; PROVIDING 12 FOR SEVERABILITY; PROVIDING FOR CONFLICT; 13 PROVIDING FOR CODIFICATION; PROVIDING FOR 14 AN EFFECTIVE DATE. 15 WHEREAS, Miami Shores Village (the "Village") is committed to environmental 16 conscientiousness and is located along an interconnected system of waters that provide 17 habitat for fish and wildlife, opportunities for recreation, and an enhanced quality of life; 18 and 19 WHEREAS, as an operator of Municipal Separate Storm Sewer Systems ("MS4") 20 and a co-permittee under the National Pollutant Discharge Elimination System ("NPDES") 21 Permit No. FLS000003, the Village is required to maintain comprehensive planning 22 processes that limit increases in the discharge of pollutants in stormwater as a result of 23 new development, and reduce the discharge of pollutants in stormwater from redeveloped 24 areas; and 25 WHEREAS, to comply with such mandate, the Village Council wishes to amend 26 Section 906, "Issuance Of Development Orders" to include prerequisites for development 27 activity and issuance of development permits in accordance with the Miami-Dade County 28 Public Works Manual, Standard Details, Miami-Dade County Water and Sewer Authority 29 Department Manual of Standards and Specifications, and other county, state and federal 30 regulations; and 31 WHEREAS, the Planning and Zoning Board, sitting in the capacity as the local 32 planning agency, reviewed the proposed amendments at its May 25, 2023 meeting and 33 voted to recommend approval of the Ordinance; and 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 WHEREAS, this Ordinance was duly noticed and presented to the Village Council in two readings, with second reading conducted as the required public hearing on ______ ,2023;and WHEREAS, the Village Council finds that this Ordinance is in the best interest and welfare of the residents of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AS FOLLOWS: 1 Section 1. Recitals Ad opted. That each of the above stated recitals is hereby confirmed, adopted, and incorporated herein and made a part hereof by reference. Section 2. Amendment to the Village Code. That Appendix A, "Zoning," Section 906, "Authorization By Development Permit Required Prior To Undertaking Development Activity" of the Village Code of Ordinances is hereby amended as follows: Appendix A - ZONING *** Sec 906. Authorization by development permit required prior to undertaking development activity. (a)Generally. No development activity may be undertaken unless the activity is authorized by a development permit. (a.!2.) Development orders consistent with Miami Shores Comprehensive Plan. No development order shall be issued unless it is found that the development is consistent with the 1989 comprehensive plan and any amendments thereto. (ac) Determining consistency with the comprehensive plan. Prior to the issuance of any development order by the Village of Miami Shores, the director of planning and zoning shall check the proposed development for consistency with the future land use map and related policies of the comprehensive plan.
