4 MIAMI SHORES VILLAGE, FLORIDA, AMENDING
5 THE VILLAGE'S CODE OF ORDINANCES BY
6 AMENDING CHAPTER 11, "HISTORIC 7 PRESERVATION," CHAPTER 19, "PLANNING,"
8 AND APPENDIX "A" "ZONING" TO CHANGE
9 REFERENCES TO "PLANNING BOARD"
1 O THROUGHOUT THE CODE TO "PLANNING AND
11 ZONING BOARD;" PROVIDING FOR CONFLICTS;
12 PROVIDING FOR SEVERABILITY; PROVIDING
13 FOR CODIFICATION; AND PROVIDING FOR AN
14 EFFECTIVE DATE.

15 WHEREAS, the Village Council of Miami Shores Village, Florida (the "Village")
16 finds it periodically necessary to amend its Code of Ordinances (the "Village Code") in
17 order to update regulations and procedures to implement municipal goals and
18 objectives; and
19 WHEREAS, the Village has determined that amending references to the
20 "planning board" throughout the Village Code to "planning and zoning board" would
21 provide for uniformity and consistency; and
22 WHEREAS, the Village Council wishes to amend Appendix A of the Village Code
23 of Ordinances; and
24 WHEREAS, the Planning Board, sitting as the Local Planning Agency, reviewed
25 the Ordinance, and voted to recommend approval of the Ordinance by a
26 unanimous vote; and
27 WHEREAS, the Village Council finds that this Ordinance is in the best interest
28 and welfare of the residents of the Village. 29 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND VILLAGE
30 COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AS FOLLOWS:1

offered in support thereof, any evidence in opposition thereto, and the findings and
recommendations of the board.

Section 3. Conflicting Provision. Any provisions of the Code of Ordinances of
767 Miami Shores Village, Florida, in conflict with the provisions of this Ordinance are
768 hereby repealed, but only to the extent of such conflict.
769 Section 4. Severability. That the provisions of this Ordinance are declared to
770 be severable and if any section, sentence, clause, or phrase of this Ordinance shall, for
771 any reason, be held to be invalid or unconstitutional, such decision shall not affect the
772 validity of the remaining sections, sentences, clauses, and phrases of this Ordinance,
773 but they shall remain in effect, it being the legislative intent that this Ordinance shall
774 stand notwithstanding the invalidity of any part.
775 Section 5. Codification. That it is the intention of the Village Council and it is
776 hereby ordained that the provisions of this Ordinance shall become and be made a part
777 of the Code of Ordinances of the Miami Shores Village, Florida, that the sections of this
778 Ordinance may be renumbered or re-lettered to accomplish such intentions, and that
779 the word "Ordinance" shall be changed to "Section," or other appropriate word.

781 Section 6. Effective Date. That this Ordinance shall become effective
782 immediately upon adoption on second reading.
