R-2023-04RESOLUTION NO. 2023-__ A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA; APPROVING THE EXPENDITURE IN AN AMOUNT NOT TO EXCEED $2,200 FROM THE LAW ENFORCEMENT TRUST FUNDS (LETF) TO ATTEND AGRACIE SURVIVAL TACTICS INSTRUCTOR DEFENSE TACTIC TRAINING BY THE CHESAPEAKE VIRGINIA POLICE DEPARTMENT; PROVIDING FOR AUTHORIZATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Shores Village Police Department ("MSPD") is a law enforcement agency that serves and protects the community and Miami Shores Village; and WHEREAS, law enforcement training standards and "best practices" relating to improved professionalism and skill sets · are necessary for law enforcement officers when performing duties in their official capacity; and WHEREAS, Gracie Survival Tactics System ("GST") is a revolutionary defensive tactics system is designed to help law enforcement officers humanely prevail against larger and stronger opponents; and WHEREAS, the Chesapeake Police Department is offering GST instructor training at their location; and WHEREAS, the Police Department requests authorization to expend State Law Enforcement Forfeiture Funds in the amount of $2,200 for costs associated with law enforcement training; and WHEREAS, the Chief of Police certifies that the use of Law Enforcement Forfeiture Funds complies with Section 932.7055, Florida Statutes, in that the funds will be used for an appropriate law enforcement purpose; and WHEREAS, Section 932. 7055, Fla. Stat. (2018), the Florida Contraband and Forfeiture Act, authorizes the expenditure of Law Enforcement Trust Funds RESOLUTION NO. 2023-04 04 for this purpose and the funds are available in the Law Enforcement Trust Fund account for the Police Department; and provided that the proposed expenditures are approved by the municipal governing body and are not used to meet the normal operating expenses of the Department; and WHEREAS, the Chief of Police certifies that the use of Law Enforcement Forfeiture Funds complies with Section 932. 7055, Florida Statutes, in that the funds were not considered in the adoption and approval of the Police Department's budget; and WHEREAS, the Mayor and Village Council find it to be in the best interests of the Village and welfare of the residents of the Village. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Village Council of Miami Shores Village, Miami Shores, Florida that: Section 1. Recitals Adopted. The foregoing recitals are true and correct. Section 2. Approval and Award. The Mayor and Village Council hereby approve authorizes the Village Manager to approve the required documentation for the purpose described in this Resolution, and to expend budgeted Village LETF funds in an amount not to exceed $2,200. Section 3. Effective Date. This Resolution shall take effect immediately upon the adoption hereof.
