2023-03-07 Minutes1 MEETING MINUTES MARCH 7, 2023 6:30 PM 9900 NE 2ND AVENUE 1) CALL TO ORDER Councilmember Burch called the meeting to order at 6:01 PM. 2) MOMENT OF SILENCE / PLEDGE OF ALLEGIANCE 3) ROLL CALL Present: Vice Mayor Daniel Marinberg (Via Zoom) Councilmember Alice Burch (presiding officer) Councilmember Wesley Castellanos Councilmember Timothy Crutchfield Also Present: Village Manager Esmond Scott Village Attorney Sarah Johnston Village Attorney Chanae Wood Village Clerk Ysabely Rodriguez Mayor Sandra Harris (Absent) 4) ORDER OF BUSINESS - ADDITIONS, DELETIONS, & DEFERRALS Councilmember Burch announced the deferral of items 5.A and 5.B. Additionally, Councilmember Burch stated in lieu of item 5.D the Council will hear a presentation from Stefano Viola of Kimley- Horn. 5) PRESENTATIONS 5.A RECOGNITION IN HONOR OF THE DEDICATED SERVICE OF FORMER COUNCILMEMBER KATIA SAINT FLEUR. DEFERRED 2 5.B RECOGNITION IN HONOR OF THE DEDICATED SERVICE OF FORMER COUNCILMEMBER CRYSTAL WAGAR. DEFERRED 5.C PROCLAMATION IN HONOR OF MR. HERBERT LECONTE, UNITED STATES POSTAL SERVICE EMPLOYEE, WHO HAS DELIVERED SUCH SERVICE TO THE MIAMI SHORES NEIGHBORHOOD OF SHORES ESTATES FOR FORTY-FOUR YEARS (SPONSORED BY: COUNCILMEMBER ALICE BURCH). Councilmember Burch opened the floor to public comments. Robert Menge expressed appreciation to Mr. LeConte for his dedicated service as a USPS mail carrier to the Shores Estates subdivision. Janet Goodman expressed appreciation to Mr. LeConte for his dedicated service to the Shores Estates subdivision. Carol Eannace expressed appreciation to Mr. LeConte for his dedicated service to the Shores Estates subdivision. She further presented Mr. LeConte with a token of appreciation on behalf of the Shores Estates community. Mr. LeConte thanked Village Council and staff for the recognition. He expressed gratitude for the outpouring of love and support from fellow co-workers, friends, family and residents. Councilmember Burch read and presented the proclamation dedicated to Mr. LeConte. 5.D PRESENTATION ON THE PROPOSED PLANS FOR EXPENDITURE OF AMERICAN RESCUE PLAN ACT (ARPA) - BY CHRISTOPHER MIRANDA, PUBLIC WORKS DIRECTOR DEFFERED 5.D UPDATE ON THE SHORES ESTATES SUBDIVISION SEPTIC TO SEWER CONVERSION AND DRAINAGE IMPROVEMENT PROJECT BY KIMLEY-HORN. The Shores Estates Subdivision Septic to Sewer Conversion and Drainage Improvements presentation was delivered by Stefano Viola, representing Kimley-Horn. Mr. Viola presented a project overview and further outlined the summary of next steps and status of said projects. Councilmember Castellanos posed a question to Mr. Viola regarding the length of time for the project. In response, Mr. Viola estimated the septic to sewer project could take approximately a year. Councilmember Crutchfield asked about the 105th street right-of-way and the disruption to traffic that construction might cause. Mr. Viola stated people will be able to maneuver around the construction. Councilmember Burch posed a question regarding the required distance between two types of pipes. In response, Mr. Viola stated it varies by sewer and stormwater. In response to further inquiry, Mr. Viola stated there is only one municipality to his knowledge who has been able to place electrical lines underground and repair their water pipes all at once. Mr. Viola reiterated the purpose of the project is to repair the water pipes rather than replace it. Vice Mayor Marinberg asked where is the best location for the lift station. In response, Mr. Viola stated anywhere east of the wall on 105th street. 3 6) PUBLIC COMMENTS Robert Menge spoke about recent grants awarded to other municipalities regarding septic and sewer conversion and asked whether the grant writer in Miami Shores Village could look into such matter. Mr. Menge posed additional questions to Village Council regarding pending construction in the Village, and what accommodations will be made in the event flooding happens during construction. Janet Goodman sought clarification regarding the timeline concerning the septic to sewer conversion project and the stormwater project. In response to Ms. Goodman’s inquiry, Mr. Viola stated construction for the septic to sewer project is slated to begin soon; however, the construction date for the stormwater project will be announced in the near future. 7) APPROVAL OF THE MINUTES 7.A APPROVAL OF THE FEBRUARY 7, 2023 VILLAGE COUNCIL MEETING MINUTES (STAFF: VILLAGE CLERK). Councilmember Crutchfield moved approval of the minutes, and Councilmember Castellanos seconded the motion. The minutes were approved with a 4-0 voice vote. 8) ORDINANCE(S) ON FIRST READING 8.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING THE VILLAGE’S CODE OF ORDINANCES BY AMENDING CHAPTER 11, HISTORIC PRESERVATION, CHAPTER 19, PLANNING, AND APPENDIX A ZONING TO CHANGE REFERENCES TO PLANNING BOARD THROUGHOUT THE CODE TO PLANNING AND ZONING BOARD; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE (SPONSORED BY: COUNCILMEMBER ALICE BURCH). Village Clerk Rodriguez read the caption of the ordinance into the record. Councilmember Burch provided opening remarks, indicating her preference for a name change to better reflect the current functions of the board. There were no comments from the public upon Councilmember Burch opening the floor to public comments. Councilmember Castellanos moved approval of the item, and Councilmember Crutchfield seconded the motion. The item was approved with a 4-0 voice vote. 9) DISCUSSION & POSSIBLE ACTION ITEMS 9.A DISCUSSION AND POSSIBLE ACTION ON THE GREATER MIAMI SHORES CHAMBER OF COMMERCE REQUEST FOR PROVIDING IN-KIND VILLAGE SERVICES TO THE GREEN DAY EVENT. GREEN DAY WILL BE HELD DOWNTOWN ON NE 2ND AVENUE ON SATURDAY, APRIL 29TH AND REQUIRES VILLAGE IN-KIND SERVICES FROM PUBLIC WORKS AND THE MIAMI SHORES POLICE DEPARTMENT, INCLUSIVE OF STREET CLOSURES. THE VILLAGE WILL BE LISTED AS THE MAJOR SPONSOR OF THE SPRING EVENT (SPONSORED BY: COUNCILMEMBER ALICE BURCH). 4 Councilmember Burch provided opening remarks, and then turned the item over to members of the Greater Miami Shores Chamber of Commerce. Carla Peters, Executive Director of the Greater Miami Shores Chamber of Commerce provided opening remarks and introduced Liangy Fernandez Calli who provided further background regarding upcoming Green Day event. Catherine McLaney, President of the Greater Miami Chambers of Commerce thanked the Village Council, and provided further emphasis on the importance of Green Day. Councilmember Crutchfield moved approval of the request for In-Kind services from Village Staff, Councilmember Castellanos seconded the motion. The item was approved with a 4-0 voice vote. There was no further discussion. 9.B DISCUSSION AND POSSIBLE ACTION REGARDING THE HISTORIC PRESERVATION BOARD'S REQUEST TO MODIFY THE VILLAGE CODE TO EXPEDITE AND STREAMLINE THE PROCESS FOR DESIGNATING HISTORICALLY SIGNIFICANT PROPERTIES (SPONSORED BY: COUNCILMEMBER WESLEY CASTELLANOS). Councilmember Castellanos provided opening remarks, and spoke in support of the Historic Preservation Board’s (HPB) request to eliminate the Planning Board review of properties nominated for historic landmark designation. Director of Planning and Zoning, Claudia Hasbun, gave a brief presentation on the Miami Shores Village Historic landmark designation process and answered questions posed by the Village Council. Councilmember Crutchfield inquired as to the premise of the Planning Board’s involvement regarding the historic landmark designation process. In response, Director Hasbun stated there is no rationale present in the code. Director Hasbun, in response to Vice Mayor Marinberg’s inquiry, stated there has never been a denial for historic landmark designation to her knowledge. Councilmember Burch opened the floor to public comments. Nancy Dowson spoke in opposition to designating properties without expressed consent of the property owners. Patrizia Bonaduce, HPB Chair, spoke in support of the item, and in response to Nancy Dowson clarified that properties are designated with owner’s written consent. Ms. Bonaduce asked for the Village Council to support the HBP’s request. Peter Walsh introduced himself as one of the Candidates running in the 2023 Village Council elections. Jeffery Saadeh expressed support for the item. Vice Mayor Marinberg clarified that homeowners must volunteer their property for historic designation. There was consensus amongst the Village Council to direct the Village Attorneys to draft an ordinance for Village Council considerations, removing Planning Board review of historic landmark designation 5 applications. There was no further discussion. 9.C DISCUSSION REGARDING THE MORATORIUM ORDINANCE NO. 2022-09 (STAFF: VILLAGE ATTORNEY). Village Attorney Johnston provided opening remarks regarding the impending expiration of the above referenced moratorium affecting commercial properties. Additionally, Village Attorney Johnston sought direction from the Village Council on whether or not the Moratorium should be extended. Councilmember Crutchfield and Castellanos spoke in support of extending the Moratorium. Vice Mayor Marinberg spoke in opposition to extending the moratorium. Village Attorney Johnston stated she is clear on the direction from the majority of the Village Council to draft an ordinance further extending the moratorium for Village Council consideration. There was no further discussion. 10) MANAGER'S REPORT Village Manager Scott asked Planning and Zoning Director Hasbun to announce the upcoming Comprehensive Plan Workshop. Director Hasbun informed Village Council about an upcoming informational workshop regarding Phase 2 of the Comprehensive Plan. Additionally, Director Hasbun stated there will be several subsequent meetings to discuss the remaining nine (9) elements of the Comprehensive Plan. Assistant Village Manager Wilson provided an update regarding beautification in the downtown corridor. Village Manager Scott provided operational updates. 11) ATTORNEY'S REPORT The Village Attorney’s Office did not have any report for this Village Council Meeting. 12) ANNOUNCEMENTS Village Clerk Rodriguez read announcements into the record. 13) VILLAGE COUNCIL COMMENTS Councilmember Crutchfield mentioned the need for an improved Village website. Councilmember Crutchfield spoke in support of improving the acoustics in the 9900 Building. Councilmember Castellanos thanked the Greater Miami Shores Chamber of Commerce, and Community Alliance for their great work in Miami Shores. Councilmember Burch thanked the Miami Shores Community Alliance, Mayor Harris, and the Planning Committee for their efforts in coordinating community events throughout the Village. Additionally, Councilmember Burch praised Chair of the Miami Shores Community Alliance, Robert Bourne for his hard work in planning the Mayor’s Brunch, and Tropical Chevrolet for their generous sponsorship. In closing, Councilmember Burch thanked Kimley-Horn for their presentation, and Herbert LeConte for his service to Shores Estates. 6 14) ADJOURNMENT There being no further business before the Village Council, the meeting adjourned at 8:07 PM.
