Ms. Wood reviewed for the Board the Sunshine Law, Public Records, The Highlights of the Miami -Dade County
Ethics Code, The Miami Dade County Conflict of Interest and Code of Ethics, The Florida Commission
on Ethics - 2022 Guide and a short power point presentation training which was given to be introduced
into the record.

street tree. The structure is located in FEMA flood zone AE 9. According to Miami- Dade County

The applicant is requesting site plan approval for an addition of 1,598 square feet of area. The proposed
addition is a two-story structure in the front area of the lot. The proposal also include a metal roof for the
entire structure.
The Board asked questions.
Staff informed the Board that the driveway is not for review at this time.
The Agent did not wish to present. He said that the metal roof in dark grey.

Staff recommends approval with the conditions attached.
The Board asked questions about the width of the driveway. The Agent said that it is 20 feet wide.
The Agent presented that the project was initially a two story home that was downgraded to a one story.
There was no public comment.
Mr. Brady commented that the current Air Conditioning location is in violation of our Code.
Motion to approve subject to Staffs recommendations with the Air Conditioning unit on the roof,
amended with condition to provide sidewalks by Ms. Hegedus, seconded by Mr. Brady and the
Motion was unanimously approved.
There was discussion by the Board with respect to sidewalks on private property, no public right of
way. The Board is following the recommendation from Staff.

Staff is recommending approval with the conditions attached.
Ms. Hegedus asked about the existing dock. Point of clarification the dock is not part of the application.
Mr. Snow asked about the setbacks .
Staff read into the record the section of the Code that says that there is no rear setback on the shore view.
Mr. Martin gave an extensive presentation of the project and stood for questions. The Board asked
questions.

6) CONTINUED ITEMS
6.A - Code amendments updates
Ms. Hasbun spoke about Staff moving forward with several amendments to the Code. The Board asked
questions.
- Synthetic Turf and Noise ordinance
Pending Turf from previous Council meeting and the legal team. This item will be brought back to the
Planning Board in July as stated by Staff.
Will also bring back synthetic turf and recommendations to the Board. There will be research done by
Staff and bring to the Board.
About Noise Code this is not an easy search regarding regulation. The Board and Staff discussed about
the latest Miami -Dade Code. Staff will research the City Code and Zoning Code for more
clarification. The legal department will compile information about the current Code. Staff is also
working on this information to bring to the Board.
The Board discussed the leaf blowers and Council looking into this ordinance. Mr. Bolton read into the
record the Code for Noise.
Staff spoke about noise and nuisance. The legal department opined as to noise and how it is
established. Is it audible from a certain distance, not necessarily using the decimal system to decide. Mr.
Busta concluded that noise is about interpretation and is not clear in the current Code.
Mr. Brady asked who is responsible for driveway approval. Staff said that it is part of the Building
permitting process. There is a Building Department application and the Planning Director reviews
administratively.
Mr. Bolton asked about the current planning applications and all the paperwork submitted. Is it part of
the application to submit all these papers?
Staff said that the goal is for electronic submittals in the future. Mr. Snow said that it is necessary
paperwork until we get fully digitized. Staff said that we could look into having the Staff Report, the
Plans, and Survey in the submittals.
