2022-03-01 Minutes1 MEETING MINUTES MARCH 1, 2022 6:30 PM 9900 NE 2ND AVENUE 1) CALL TO ORDER Mayor Harris called the meeting to order at 6:33 PM. 2) MOMENT OF SILENCE / PLEDGE OF ALLEGIANCE 3) ROLL CALL PRESENT: Councilmember Alice Burch Councilmember Katia Saint Fleur Councilmember Crystal Wagar Vice Mayor Daniel Marinberg Mayor Sandra Harris ALSO PRESENT: Interim Village Attorney Omar Bradford Village Clerk Ysabely Rodriguez Village Manager Esmond Scott 4) PRESENTATIONS 4.A SPECIAL RECOGNITION & CONGRATULATIONS TO DOCTORS CHARTER SCHOOL LADY HAWKS WEIGHTLIFTING TEAM: Mayor Harris announced the deferral of this item to the March 15, 2022 Village Council Meeting. 4.B PROCLAMATION PRESENTED TO VILLAGE ATTORNEY RICHARD SARAFAN IN HONOR OF HIS DEDICATED SERVICE TO MIAMI SHORES VILLAGE (SPONSORED BY: MAYOR SANDRA HARRIS). Mayor Harris, on behalf of the Village Council, read a proclamation into the record in honor of Village Attorney Richard Sarafan’s dedication to Miami Shores Village. Mr. Omar Bradford accepted the proclamation and token of appreciation on behalf of Mr. Sarafan. 2 4.C PRESENTATION OF AD HOC CHARTER ADVISORY COMMITTEE BEST PRACTICES AND RECOMMENDATIONS REPORT. Mr. Ed Quinton, Ad Hoc Charter Advisory Committee Chair, delivered the best practices and recommendations report and answered questions posed by the Village Council. As per the Village Council’s directive, Mr. Quinton provided a brief overview of the committee’s purpose, which is to research best practices for municipal charter review and produce recommendations on process, timing, committee member criteria, and topics for potential charter review consideration. The committee provided recommendations concerning the existing ordinance that governs the timeline, frequency, and process to Charter reviews, and further recommended Charter topics for potential consideration and review, and selection of charter review members. The committee recommended for the Village Council to consider timing the next Charter review process to the next municipal election in 2023. Should the Village Council accept the recommendation, Mr. Quinton stressed the importance of adhering to the recommended timeline outlined in the presentation. Village Clerk Rodriguez reminded the Village Council that should they proceed with the recommended timeline, the Village Clerk’s Office must begin recruiting applicants for the Charter Review Committee no later than July 11, 2022 in order to coincide with the 2023 municipal election. Individual Councilmembers thanked the committee members for their hard work and exceptional presentation. Councilmember Burch acknowledged committee secretary Ms. Bonnie O’Meara for drafting the presentation document and thanked Village Clerk Rodriguez for providing support to the Committee. Responding to Councilmember Wagar’s inquiry regarding the next course of action, Village Clerk Rodriguez explained the Village Council may direct the Interim Village Attorney to draft a proposed ordinance amending Section 2-33 to include the proposed recommendations offered by the Committee for further Council consideration. Village Clerk Rodriguez explained staff is requesting a motion to sunset of the Ad Hoc Charter Advisory Committee should there be no further duties for such Committee. Councilmember Burch moved to sunset the Ad Hoc Charter Advisory Committee and Vice Mayor Marinberg seconded the motion, which carried a 5-0 voice vote. Councilmember Burch moved to direct the Interim Village Attorney to draft a proposed ordinance, amending Section 2-33 to include the recommendations provided by the committee for Village Council consideration. The motion was seconded by Councilmember Wagar which passed unanimously. No further action was taken. 4)PUBLIC COMMENTS 3 Kate Mason thanked Village Clerk Rodriguez for providing support to the Ad Hoc Charter Advisory Committee, acknowledged Ms. Bonnie O’Meara’s hard work with respect to researching and drafting the committee report. Lastly, Ms. Mason spoke about her experience as one of the committee members. Janet Goodman spoke in favor of reopening the pedestrian gate on NE 105 Street, west of Biscayne Boulevard, and asked for the Village Council’s support of such initiative. Village Clerk Rodriguez read eComments, which have been attached hereto as Exhibit A, into the record. 6)APPROVAL OF THE MINUTES 6.A APPROVAL OF THE FEBRUARY 1, 2022 VILLAGE COUNCIL MEETING MINUTES (STAFF: VILLAGE CLERK). Vice Mayor Marinberg moved to approve the February 1, 2022 Village Council Meeting Minutes and Councilmember Saint Fleur seconded the motion which carried a unanimous vote. 6.B APPROVAL OF THE FEBRUARY 15, 2022 VILLAGE COUNCIL MEETING MINUTES (STAFF: VILLAGE CLERK). Vice Mayor Marinberg moved to approve the February 15, 2022 Village Council Meeting Minutes and Councilmember Saint Fleur seconded the motion which carried a unanimous vote. 7)RESOLUTION 7.A A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, OPPOSING HOUSE BILL 1557 AND SENATE BILL 1834 IN THE 2022 FLORIDA LEGISLATIVE SESSION AND URGING ALL MEMBERS OF THE FLORIDA LEGISLATURE TO OPPOSE HOUSE BILL 1557 AND SENATE BILL 1834 WHICH, IF ENACTED, WOULD BAN DISCUSSION OF SEXUAL ORIENTATION OR GENDER IDENTITY IN PRIMARY GRADES; PROVIDING FOR TRANSMISSION; AND PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE (SPONSORED BY: VICE MAYOR DANIEL MARINBERG). Village Clerk Rodriguez read the caption of the resolution into the record. Vice Mayor Marinberg provided opening remarks, asking for the Village Council’s support of such item. Vice Mayor Marinberg moved to approve the resolution and Mayor Harris seconded the motion, which carried a 5-0 voice vote. 8)MANAGER'S REPORT Village Manager Scott provided an update regarding operational matters, including an update on body worn cameras and the document submitted by former Lieutenant James Somohano concerning MSPD. Councilmember Wagar requested a report from the Village Manager on the Department of Public Works’ professional development and promotional practices by the next Village Council Meeting. 9)ANNOUNCEMENTS The Village Clerk read announcements into the record. 4 10) VILLAGE COUNCIL COMMENTS Vice Mayor Marinberg thanked the Fine Arts Commission (FAC) for hosting the Concert in the Park event. He further announced March is Women's History Month. Vice Mayor Marinberg spoke about Ukraine- Russia affairs issue. He further spoke about the upcoming Haitian Heritage and Pride month preparations. Mayor Harris spoke about Black History Month (BHM) events hosted by various local organizations. Mayor Harris further spoke about donations to the Miami Shores Community Alliance. Mayor Harris acknowledged a resident (Ms. Sandra Morisseau) who passed away as a result of COVID-19. Lastly, Mayor Harris mentioned the Miami-Dade League of Cities has asked the Village to appoint an additional member to the board and Mayor Harris nominated Councilmember Saint Fleur. Councilmember Wagar seconded the motion, which passed unanimously. Councilmember Wagar thanked the Ad Hoc Charter Advisory Committee for their hard work, congratulated Chief David Golt on his appointment, and Commander Kerry Turner for his promotion. Councilmember Wagar thanked the South Florida People of Color (SFPC) for hosting BHM events. Councilmember Wagar, in honor of WHM, further spoke about the nomination of Ketanji Brown Jackson for Supreme Court Justice. Councilmember Saint Fleur thanked Brockway Memorial Library, Fine Arts Commission, SFPC, the Ad Hoc Charter Advisory Committee, and the Shores Farmers Market. Councilmember Saint Fleur further asked for a moment of silence in honor Ms. Sandra Morisseau who passed away due to COVID-19. Councilmember Saint Fleur thanked Village Manager Scott for building relationships with community leaders and stakeholders and thanked Village Clerk Rodriguez for her responsiveness. Councilmember Burch spoke about supporting the Farmers Market, Bike to Work Day in Miami Lakes, and the Police Chief installation and command staff appointment ceremony. Councilmember Burch further commended MSPD staff and Barry University for setting up the installation ceremony and spoke about FAC events. My comments are specific to agenda item 4c, Presentation of ad-hoc charter advisory committee report. I participated in the committee but am unable to attend tonight’s meeting. First, I’d like to commend the Shores residents on the committee who dedicated significant time to the meetings and discussions that led to this report. It was great to get to know you a bit, and have rigorous debates along the way. Second, to the council members listening to tonight’s presentation, I encourage you to thoroughly review the appendix, specifically the comparisons of other municipalities’ practices. One item you will not hear much about this evening is election related processes, given discord amongst the committee on whether or not to highlight the actual research findings. I have no position as to what specific changes should be made to Miami Shores Village election practices, however I do believe we owe you a full and complete view of where Miami Shores differs greatly from other municipalities (specifically, how candidates run for council positions, open election vs. running for a specific seat, term durations, and term limits). What recommendations may come from a future charter review committee is up to that group. Third, I do not intend to apply for such a committee should one be called, as I would much prefer to see a committee that is more representative of Miami Shores resident demographics. We need the voices and perspectives of our non-white and mixed ethnicity residents represented on the committee, and unfortunately, we did not have that benefit on the ad hoc committee. I strongly encourage all residents to consider applying to a future charter review committee. Hopefully the next group will better represent the ethnic and racial diversity of our beloved community. This is bad legislation that will hinder teachers' ability provide safe and welcoming spaces for students, and it will harm students, who, while they may face harsh situations in life outside of school, should always have, in contrast, classrooms where they feel secure and valued.
