This is a quotation on the goods and services named subject to the conditions noted below:
Generat AN material supplied with the system is first class UL approved and guaranteed to be as specified. AN work is to be completed in a professional and
workmanlike manner to meet local construction, electric and gas codes and according to standard practice. Any alteration or deviation from the
attached specifications involving extra costs will be executed only upon written order and will become extra charge over and above the estimate. All
agreements contingent upon strikes, accidents or delay beyond our control. Owner to carry fire, hurricane and other necessary insurance. Our workers
& subcontractors are fully insured by worker's compensation.
Tares and Fees. Prices do not include Federal, State, local, or excise taxes.
Freight. Prices include freight and delivery charges.
PaymentTemis: 50% upon signing this agreement, 30% upon delivery of the generator to site, balance upon final inspection.
Late Paymeais: 159E per month interest will be charged on overdue paymerrts.
Validity: This quotation is valid for 30 days. By signing a sales agreement, customer accepts the terms and conditions of this quotation unless waived in writing by
Empower Generators.

Sub -base Tank Pad if the municipality requires an under -tank pad to be installed add $995 for SDO Gallon tank and $1775 for 1000 Gallon tank
Any work required to correct existing code violations found by municipal av pectors which are not associated with the generator system is the resposhsilAity of the
Code Violations: owner.
Underground Utilities: Empower engages Sunshine Utilities for identification of major utility pipes and services prior to breaking ground. If utility pipes are encountered when excavating
for the installation of tfie Propane tank, re-routing of the pipes is the responsibility of the customer.
Sometimes electrical surges can damage appliances and equipment. Our electricians take precaution to avoid such damage, however, damages caused to electrical
Ele trknlAppliances: equipment or appliances during disconnection/reconnection of utility services are the responsibility of the owner. Damage caused due to contractor negligence is
the contractors responsibility.
Can¢9adons. If customer cancels the order within the first 30 days after it was signed, there willy6e a 25% cancellation fee assessed. In the event the order is
cancelled after 30 days, there will be a 501A cancellation charge assessed.
Arbitration: If any dispute arises after signing a sales agreement by Customer, such disputejs) shall be referred in writing to arbitration, and that decision shall be
final and bfndxtg in all respects. The venue for any arbitration hereunder shall be in the state of Florida, whether or not such venue is or subsequently
becomes ire rmmnient Arbitration proceedings initiated pursuant to this Agreement shall be conducted in accordance with the Rules of the American
Arbitration Association, and shall provide for more than minimal discovery by each party. The arbitrator shall consider the matter in controversy and
may hold hearings regarding the same. The arbitrator may grant any remedy or relief deemed just and equitable, including, but not limited to, any
remedy or relief that would have been available to the parties had the matter been heard in court. The arbitrator shall enter an award in writing
detailing his or her consideration of the relevant facts, the basis and reason for the decision, and adherence to the

Applicable Law: The Sales Agreement and the rights of the parties shall be governed by and construed and enforced in accordance with the laws of the state of Florida.

Limited Warranty: Empower Generators warrants to the original buyer that its products are free from defects in material and workmanship and will perform to their
published specifications for a period as specified on the first page of this estimate / proposal. Empower Generators will at its option replace or repair
itself or through contract partners any product which fails to perform to its specifications provided that the product was used and maintained in
accordance with the applicable operator miainto ace irsinrctior s. This warranty does not cover failures due to misuse, abuse, negligence, accidents,
repairs or alterations by owner or by third parties other than Empower Generators contract partners.
Empower General = MAKES NO OTHER EXPRESS OR IMPLIED WARRANTY OF FrTNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY OR ANY
OTHER EXPRESS OR IMPLIED WARRANTY. UNDER NO CIRCUMSTANCES WHETHER BASED IN CONTRACT OR TORT SHALL Empower Generators BE
UABLE FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND OR FOR LOSS OF REVENUE, LOSS OF BUSINESS OR
