4) PRESENTATIONS
4.A PRESENTATION ON COMPREHENSIVE PLAN FUTURE LAND USE MAP (BY: CALVIN
GIORDANO & ASSOCIATES, INC).
Mr. Scott provided opening remarks, indicating inconsistencies between the most recently adopted
Future Land Use Map (FLUM) and the Comprehensive Plan text as raised by Vice Mayor Marinberg who
requested the evaluation of said material. Responding to Vice Mayor Marinberg’s request, Mr. Scott
engaged Calvin Giordano & Associates (CGA) to assist with the evaluation of such records and to provide
a presentation regarding their preliminary findings. Mr. Scott introduced Ms. Silvia Vargas and Mr. Alex
David, accredited Urban Planners with CGA, who delivered the presentation and answered questions
posed by the Village Council.
Ms. Vargas highlighted the primary issues, noting inconsistencies between the Comprehensive Plan Text
(Land Use Designations) and FLUM, the lack of designations (definitions) for Parking, Mixed-Use,

Commercial, Special Area, no consistency between the map and legend, no indication of how the
annexation Area (west of Barry University) was designated, and no record of Comprehensive Plan and
map changes.
Ms. Vargas further noted why these issues matter, specifying that the Comprehensive Plan must comply
with Florida Statutory Requirements (Chapter 163 F.S.), the Regional Plan, and the Miami-Dade County
Comprehensive Development Master Plan among other reasons.
Ms. Vargas spoke about ways to address the above-referenced challenges: (1) amending the
Comprehensive Plan text and FLUM so they are internally consistent and (2) providing technical and
legal rationale to support the amendments. Ms. Vargas noted CGA’s recommendation, which is to enact
a provisional moratorium (for a specified time) on Future Land Use and Rezoning Applications, exempting
single-family properties. According to CGA, such recommendation is best practice and provides the
Village time to study, document, and resolve the issues.
Mr. Sarafan noted if it is the will of the Village Council, the legal department would draft a proposed
ordinance imposing the recommended temporary moratorium.
Responding to Mayor Harris’ inquiry regarding inconsistencies with the 2010 and 2018 Comprehensive
Plans, Ms. Vargas explained the issue herein lies with the lack of historical records that justify how the
2010 adopted version transformed into the 2018-2019 adopted version.
Explaining the implications of the inconsistencies concerning Items 7A and 7B, Mr. Travis Kendall,
Planning & Zoning Director, clarified there are more defined commercial land use categories in the 2018-
2019 Comprehensive Plan text: restricted and general commercial. Mr. Kendall further noted the
application for review indicated a request for a general commercial land use category. Mr. Kendall noted
the inconsistency herein lies with the Comprehensive Plan text, which outlines “restricted commercial”
and “general commercial” categories and the FLUM, which only indicates a “commercial” category.
Vice Mayor Marinberg noted the appearance of a change to the existing land use map wherein the title
of the map reflects “future” yet the legend of the map language reflects “existing.”
Vice Mayor Marinberg read a letter regarding the inconsistencies he raised regarding the Comprehensive
Plan text and the FLUM.
Some of the Councilmembers voiced concerns and displeasure regarding the inconsistencies and the
lack of due diligence when questions were raised regarding such issues.
Councilmember Burch moved to defer items 7A and 7B to the February 15, 2022 Village Council Meeting
and to direct the Village Attorney to draft an ordinance imposing a temporary moratorium on Future Land
Use and Rezoning Applications (exempting single-family properties) and for such item to be brought
forth Village Council adoption at the February 15, 2022 Village Council Meeting. Vice Mayor Marinberg
seconded the motion, which carried a 5-0 voice vote.
The applicant’s attorney, Mr. Ryan Bailine, stated the above-referenced request for deferral to the
February 15, 2022 Village Council Meeting is reasonable.
By way of consensus, the Village Council authorized the Village Manager to negotiate the cost associated
with CGA assisting the Village remedy the inconsistencies.
There being no further discussion, Mayor Harris called for a brief intermission.
Mayor Harris resumed the meeting at 8:11 PM.

4) PUBLIC COMMENTS
Village Clerk Rodriguez read eComments (which have been attached hereto as Exhibit A) into the record.
Robert Menge spoke about flood zone impacts and asked the Village Council to consider the
recommendations outlined in the document that was circulated to them.
Noel Franz spoke about the importance of including residents in discussions concerning amendments to
the Comprehensive Plan.
Tim Duerkop spoke about Items 7A and 7B. Mr. Duerkop further spoke about the installation of speed
humps and inquired into the costs associated with it.
6) APPROVAL OF THE MINUTES
6.A APPROVAL OF THE JANUARY 4, 2022 VILLAGE COUNCIL MEETING MINUTES (STAFF:
VILLAGE CLERK).
Vice Mayor Marinberg asked for an amendment to the minutes, reflecting Mr. Tom Septembre’s request
for Vice Mayor Marinberg’s resignation and not the Village Council.
Vice Mayor Marinberg moved to approve the minutes as amended and Councilmember Burch seconded
the motion, which carried a 5-0 voice vote.
7) ORDINANCE(S) ON SECOND READING- PUBLIC HEARING
7.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA,
APPROVING A SMALL SCALE AMENDMENT TO THE FUTURE LAND USE MAP WITHIN THE
VILLAGE COMPREHENSIVE PLAN, CONSISTENT WITH 163.3161, 163.3184 AND 163.3187,
FLORIDA STATUTES; REDESIGNATING THE FUTURE LAND USE DESIGNATION FOR
CERTAIN PROPERTY FROM MULTI-FAMILY RESIDENTIAL TO COMMERCIAL; PROVIDING
FOR CONFLICT, CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE (STAFF:

She further spoke in support of capital improvements to the tot lot and community center sooner than
2025.

Vice Mayor Marinberg moved to approve the ordinance on second and final reading. Councilmember
Burch seconded the motion, which carried a 5-0 voice vote.
8) ORDINANCE(S) ON FIRST READING

SEVERABILITY AND AN EFFECTIVE DATE (SPONSORED BY: VICE MAYOR DANIEL

Councilmember Wagar asked the Planning Director to provide detailed departmental staff reports for the
future.
Vice Mayor Marinberg recommended a friendly amendment to Page 2, Line 1 to reflect 521(b)(1)(a)
instead of 536(2). Vice Mayor Marinberg further recommended striking through Section 1(2) regarding
safe distance visibility requirements.
Discussion ensued regarding the intent of the safe visibility requirement provision in relation to non-
conforming driveways.
Mayor Harris moved to approve the ordinance on first reading as amended to include the above-
referenced amendment concerning Section 521(b)(1)(a) and Councilmember Burch seconded the
motion, which carried a 5-0 voice vote.
9) VILLAGE BOARD APPOINTMENT(S)
9.A APPOINTMENT TO THE PERSONNEL APPEALS BOARD (3 VACANCIES).
Village Clerk Rodriguez introduced the item. Given there are three vacancies and one applicant, the
Village Clerk stated the Village Council may cast a vote by acclamation in support of the applicant.

Responding to Councilmember Burch’s inquiry regarding incumbents, Village Clerk Rodriguez noted all
of the incumbents whose term expired in October 2021 have been notified of the vacancies.
Councilmember Burch moved to appoint Mr. Larry Aguilar to the Personnel Appeals Board and Vice
Mayor Marinberg seconded the motion, which carried a 5-0 voice vote.
10) RESOLUTION(S)
10.A A RESOLUTION OF THE VILLAGE COUNCIL AUTHORIZING MIAMI SHORES VILLAGE TO
JOIN THE STATE OF FLORIDA AND OTHER LOCAL GOVERNMENTAL UNITS AS A
PARTICIPANT IN THE FLORIDA MEMORANDUM OF UNDERSTANDING AND FORMAL
AGREEMENTS IMPLEMENTING A UNIFIED PLAN FOR THE SETTLEMENT OF THE OPIOID
LITIGATION (STAFF: VILLAGE MANAGER).
Village Clerk Rodriguez read the caption of the resolution into the record.
Mr. Scott introduced the item and recommended approval as a sign of solidarity.
Mayor Harris moved approval of the resolution and Councilmember Saint Fleur seconded the motion,
which carried a 5-0 voice vote.
11) DISCUSSION & POSSIBLE ACTION ITEMS
11.A DISCUSSION AND POSSIBLE ACTION REGARDING ANNUAL PERFORMANCE REVIEWS
FOR CHARTER EMPLOYEES (SPONSORED BY: VICE MAYOR DANIEL MARINBERG).
Vice Mayor Marinberg introduced the item, indicating the importance of providing annual feedback
concerning the Charter Officers. Vice Mayor Marinberg asked the Village Council if there are comfortable
directing the Village Clerk to schedule individual meetings with each respective Councilmember and
Charter Officer to conduct performance reviews.
Discussion ensued regarding performance measures for each Charter position and the acquisition of
annual performance review templates from Miami-Dade County municipalities.
Responding to Councilmember Wagar, Mr. Scott indicated there is no overlap with respect to this item
and the human resources diagnostic initiative. Mr. Scott further stated there is not a common practice for
this type of performance review as it may vary depending on the municipality and its current elected body.
The Village Council directed the Village Clerk, the Village Manager, and the Village Attorney to reach out
to their fellow municipal colleagues to acquire Charter Officer performance review templates for Council
consideration at the February 15, 2022 Village Council Meeting.
No further action was taken.
12) MANAGER'S REPORT
Mr. Scott provided an update regarding operational matters, including the announcement of Chief David
Golt’s appointment.

14) VILLAGE COUNCIL COMMENTS
Vice Mayor Daniel Marinberg- Vice Mayor Marinberg congratulated Chief Golt and spoke about
addressing the concerns regarding the Comprehensive Plan inconsistencies.
Councilmember Crystal Wagar- Councilmember Wagar congratulated Chief Golt and further spoke
about the 90th anniversary of the Village. Councilmember Wagar spoke about the value in seeking and
receiving information.
Councilmember Katia Saint Fleur- Councilmember Saint Fleur thanked CGA for their help with the
Comprehensive Plan inconsistencies and further thanked Assistant Village Manager Tanya Wilson for
her diligence and expertise regarding the Comprehensive Plan inconsistencies. Councilmember Saint
Fleur spoke about the responsiveness of the Village Council and the importance of doing what is best for
the Village. Lastly, she thanked the Village Manager for cutting his vacation short during the holidays.
Councilmember Alice Burch- Councilmember Burch thanked all of the residents who sent letters and
emails to the Village Council. Councilmember Burch spoke about bringing forth the eComments
ordinance. Lastly, Councilmember Burch thanked the Village Attorney for working during his vacation
and thanked Village Manager for working while he was under the weather.
Mayor Sandra Harris- Mayor Harris echoed the congratulations offered to Chief Golt and thanked all of
the Councilmembers for their responsiveness during the holiday season given the unprecedented volume
of resident outreach.

I would like to see a new developer recruited to purchase the property at the same/better price than the current
bidder.
My opinion is we need a 'Plan B', another option before approving the one presented. This is standard
government procedure, issuing an RFP for a public opportunity w/in the village.
If it becomes necessary, I'll be willing to work on a subcommittee of residents to make this happen.
I am not a contiguous resident to this property but have a village-wide responsibility for a well-planned future of its
integrity.

The comprehensive plan and zoning issues have to be straightened out before anything can transpire with council
regarding changes to zoning. Effectively there is no zoning currently. Voting on a second reading of zoning
change is null.

I strongly oppose any rezoning that will permit a gas station right alongside a canal--the potential harm to the
environment and residents and the increased traffic, noise, and pollution make this a proposal that is not in the
Village's interest. Please do right by your consitutents and put this to rest.

I would like to re-state my opposition to the proposed development at 10500 Biscayne Blvd. Via the excellent
research that has been done by so many of my neighbors, it has become increasingly obvious that a gas station
on that parcel is a very bad idea. We have heard the developer promise to retain all the water during a rain event
on the property, which is required under law, but that is not possible on that property. The increased amount of
asphalt needed for this development added to the already low lying nature of the land will not allow for this, and
then all the run-off of spilled gasoline and other pollutants will end up in Biscayne Bay and in the Canal. For the
health of the residents of Miami Shores and the health of the Bay, please DENY this request for a change in land
use and zoning.

As I have stated earlier and along with the majority of the resident comments on this proposed change to the
FLUM-Comprehensive Plan I am opposed to the application and urge all of the council to vote NO. In addition to
the proposed changes to the FLUM and Comp Plan any changes to the property to a Business Use that would
allow for a gas station should also be denied and I urge all of the council to vote NO.
Perhaps instead of having to settle for the only thing the current owners and new developer have presented,
consideration should be given to a use that doesn't require an 8 foot wall with "extra" landscaping to make it
appealing. Remember the wall is only there because the previous occupants were a hazard and a detriment to
the Village and it's neighbor's. Let's make this about improving the quality of life for those living in Miami Shores
Village.
Miami Shores Village can do better and it's residents deserve better than this ill conceived and short sighted
proposal for a gas station.
Let's not leave a legacy that in 20, 30 or 50 years the future residents of Miami Shores Village ask why a Gas
Station was allowed on this property. Instead let's make the decision we can all be proud of and decide what is
the best use for the property that benefits the entire Miami Shores Village Community and the environment.
Vote NO on the proposed FLUM and Zoning requests.

Catherine Salow; 10634 NE 10 Court. As an architect for the past 30+ years specializing in Retail development, I
am not opposed to development in Miami Shores. What is confusing to me is that a gas station is even being
considered for 10500 Biscayne Blvd., with the detriment to the community (additional crime) as well as the
negative impact on the environment. The comprehensive plan (Zoning and FLUM) is a concise well thought out
plan that can take months or years to develop with city, county, village, and community input. By changing these
plans we are signally to developers that with only 2 readings at a council meeting, regardless of community
outrage, this work can be undone. Please consider the impact of your vote tonight and the quality of life here in
Miami Shores--vote "NO" to the requests for a change in the FLUM and the zoning map.

Michelle Headley, I've lived in Miami Shores for 16 years at 437 NE 102 Street. I strongly agree with Planning &
Zoning board and staff to not change the Future Land Use map. The Village's priority must be to represent their
constituents and listen to the overwhelming opposition against this ordinance. Please do not ignore the
environmental concerns so close to our neighbors and beautiful canal!

As a resident of Miami Shores Estates, I oppose the proposed zoning change for a bevy of reasons, including
environmental concerns and safety concerns as they relate to introducing a motor fuel station at the subject
property in question. As a Licensed Real Estate Broker for over 10 years, I oppose this zoning change for how it
can and will adversely affect the property values for my fellow Miami Shores Residents and my own property. In
my experience, homes that are located within close proximity to a commercial buffer zone suffer from the
perception of lacking a "residential" look and feel. A zoning change and the introduction of the commercial
development being proposed will directly and permanently bond Miami Shores Estates to a commercial pocket
that our residents simply don't want to see or hear so close to home. The homes located on the East side of
Miami Shores Estates will especially be adversely affected by commercial development on the subject property.
These homeowners will be forced to look at commercial buildings from their front and backyards, which
essentially robs these properties of the domestic tranquility they deserve. Our residents are angry about this
proposal because it negatively affects our quality of life and does very little to enhance it. Miami Shores Estates
don't want a gas station or a fast food restaurant adjacent to their homes. They want peace and quietude where
they live. We entrust our Village Commissioners to protect and safeguard our domestic tranquility. As such, the
right thing to do is to deny this proposal in the name of domestic tranquility and common-sense city planning. We
need to be cautious and selective as to how our Village is being transformed and developed. There are certain
developments that add more than they subtract. This proposed development has too many negative and
unintended consequences, which is why our Village commissioners must vote to deny the zoning amendment.
This is not the type of development that we ought to hang our hats on. We can better for our community. We need
our village officials to understand how development like this can slowly tarnish our neighborhood. We cannot
send the message that Miami Shores is for sale to the highest bidder. Miami Shores Village is better than that.

I oppose the amendment to the Future Land Use Map to commercial. I agree with the staff recommendation of
Denial, due to the multiple adverse implications to the quality of life and wellbeing of the Village residents that a
B2 designation would bring.
I addition, I'd like to acknowledge Councilperson Burch's representation and leadership throughout the debate
over this issue. She has consistently made sure that the voices of residents are heard, in a process where they
don't have the resources of a large corporation and are not considered a party to the procedures. Councilperson
Burch has my thanks and those of concerned neighbors.

Miami Shores is a signatory to the SE Florida Regional Climate Change Compact. As such, any expenditure
involving taxpayer funds should be put through the lens of climate change and sea level rise, or else it is a misuse
of funds. Please do not make this change -- or another other decision -- without serious reflection on the effects it
will have on climate change and sea level rise which are the most serious issues facing our village. I don't think
the residents of the village want our image to be the promotion of a new gas station, when we should, as
residents and as a village, be reducing our use of fossil fuels in order to give our children and grandchildren a
change at a decent future.

Concilmembers must hear the community. The opposition has been clear, and the reasons to preserve the
environment are self-evident. Councilmembers must vote no. This change will not benefit the Village.

Good evening mayor and council members. This item related to driveways has been talked about for many
months and glad that you will be taking a vote on it tonight. The village proudly calls itself the village beautiful and
here is opportunity to fulfill that vision. This item would properly correct the code and allow residents with legally
non confirming driveways the simple and straight forward ability to replace their materials. This is not a negative
impact to neighbors as this ordinance would only apply to already existing driveways; the neighbors that surround
my house are all aware and support this code change. Prior to final adoption, I would ask you to revisit some of
the words in the ordinance as site triangle should not apply as these driveways are already legally existing and
the reference to size should be limited to not increasing the non conformity.

Thank you for bringing this back before the Council. I support this ordinance. I have spoken in detail with the
directors of Planning and Zoning and Public Works and in order to do what I need to do to comply with the current
code, my driveway will be incredibly awkward and will not look right with my property. Thank you for your
consideration on this issue.

I am in support of Item 8A related to Driveway improvements for certain driveways that are legally non
conforming. If residents want to improve the look of their driveway by installing other materials such as pavers,

I am writing to ask for your support on Item 8A which would enable legal non conforming driveways to change
their material. The current code should be changed and as the neighbor who lives across the street from one of
these driveways, we welcome changes that improve the aesthetics of our street.
