the Miami Shores Village Council adopted Ordinance No . 702-13 (attached) on second and final reading
during their meeting of February 18, 2014. A copy of the amendment package, which was adopted
without further changes, is also attached for your records.

AN ORDINANCE OF THE MIAMI SHORES VILLAGE COUNCIL, MIAMI SHORES,
FLORIDA, AMENDING THE MIAMI SHORES VILLAGE 2025 COMPREHENSIVE
PLAN BY ADOPTING THE 2014 CAPITAL IMPROVEMENTS PROJECT SCHEDULE
ANNUAL UPDATE; AND INCLUDING AN AMENDMENT ADOPTING A PROVISION TO
INCORPORATE THE ANNUALLY UPDATED PUBLIC SCHOOLS FIVE YEAR WORK PLAN BY
REFERENCE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, In July, 2008, the Miami Shores Village Council adopted the 2025
Comprehensive Plan which was found to be in compliance by the Department of Community
Affairs (DCA); and,
WHEREAS, Section 163.3177 (3)(a), Florida Statutes, requires that local government
comprehensive plans contain a Capital Improvements Element designed to consider the
need for and the location of public facilities; and
WHEREAS, Section 163.3177 (3)(b), Florida Statutes, requires that local governments
review the Capital Improvements Element on an annual basis, and provides that
modifications to update the five-year capital improvements schedule may be accomplished
by ordinance; and
WHEREAS, "capital improvement" generally means physical assets constructed or
purchased to provide, improve, or replace a public asset, typically large scale, high in cost,
generally non-recurring, and may require multi-year financing; and
WHEREAS, Section 163.3177 (3)(a) 4, Florida Statutes, requires that projects
necessary to achieve and maintain the adopted levels of service for the five-year planning
period be included in the capital improvements schedule; and
WHEREAS, the Local Planning Agency (Planning Board) held a properly noticed Public
Hearing on November 14, 2013 for the purpose of reviewing the Capital Improvements
Schedule Annual Update; and
WHEREAS, the Department of Economic Opportunity requires the Village to retain
the Public Schools Five Year Work Plan within the Comprehensive Plan; and,
WHEREAS, the Miami Shores Village Council held a Public Hearing on November 19,
2013 , with all required public notices, for the purpose of hearing and considering comments
of the general public and other jurisdictions prior to final action on the Comprehensive Plan
amendment relating to the Public Schools Five Year Work Plan and the Capital Improvements
Schedule Annual Update set forth herein .
NOW, THEREFORE, BE IT ORDAINED BY THE MIAMI SHORES VILLAGE COUNCIL, that:
Section 1. The Miami Shores Village Comprehensive Plan is hereby amended to include
the Capital Improvements Schedule Annual Update referenced herein as Exhibit A.
Section 2. The Capital Improvements Schedule Annual Update is hereby adopted as set
forth in Exhibit A, attached hereto and incorporated herein.
Section 3. The Miami Shores Village 2025 Comprehensive Plan is hereby amended to
include a provision which provides for the annually updated Miami-Dade County Public
Schools 5-Year District Facilities Work Program to be incorporated by reference into the
Village's Comprehensive Plan.
