Mayor Harris called the meeting to order at 6:30 PM.

4)PRESENTATIONS
4.A PROCLAMATION PRESENTED TO MPOWER GYM IN HONOR OF ITS 25TH ANNIVERSARY.
Mayor Harris presented Mr. Chris Russo with a proclamation in honor of MPower Gym’s 25th anniversary
and grand re-opening.
Mr. Russo thanked the residents and the Village Council for their support.
Mayor Harris read a proclamation in honor of Honorable Carrie P. Meek's legacy into the record in light
of her recent passing. Such proclamation was delivered to the Meek family by Councilmember Burch at
one of the homegoing services.
Ms. Lakeisha Morris, Village Grant Writer, delivered a presentation on the Village's 2021 Annual Grant
Report and answered questions posed by the Village Council. Ms. Morris asked the Village Council to

start thinking about transportation projects that may be eligible for grant funding. She further spoke about
State funding for resiliency projects and elaborated on pump station funding.
5)PUBLIC COMMENTS
Due to the volume of eComments that were shared by the commenters in person, such comments were
not read into the record. However, all of the ecomments have been attached hereto as Exhibit A.
Robert Menge spoke in opposition to third party eComments submitted by Next Movement regarding the
10500 Biscayne Boulevard Future Land Use Map (FLUM) and rezoning requests and advocated for the
removal of such comments from the record.
Carole Respondek spoke in opposition to the third party eComments submitted by Next Movement
regarding the 10500 Biscayne Boulevard FLUM and rezoning requests and advocated for the removal of
such comments from the record.
Gaixander Elguezabal spoke in opposition to the third party eComments submitted by Next Movement
regarding the 10500 Biscayne Boulevard property and stated that some of the comments did not reflect
the names of current property owners.
Neil Canton asked the Village Council to reconsider supporting the FLUM and rezoning requests
regarding 10500 Biscayne Boulevard.
Richard Pluhar spoke about vehicular speeding on North Miami Avenue and asked the Village Council
to raise the issue with the County and to consider better signage.
Karla Peters, Greater Miami Shores Chamber of Commerce Executive Director, announced the “Sip,
Shop, and Celebrate” event which is intended to promote economic development in the Downtown
District.
Kate Mason thanked Councilmember Saint Fleur and Mr. Scott for organizing the first Strategic Planning
Session. She thanked Code Compliance Director Lazaro Remond for cancelling his vacation to attend
the Strategic Planning Session. Ms. Mason further asked the Village Council to reconsider the approval
of the FLUM and rezoning items regarding 10500 Biscayne Boulevard.
Jade Moran spoke about the potential impact of the rezoning request based on the proposed site plan.
Ms. Moran further spoke in opposition to the eComments submitted by Next Movement regarding the
10500 Biscayne Boulevard Future Land Use Map (FLUM) and rezoning requests.
Tuyen Tieu spoke about the opposition voiced by numerous property owners who reside in close
proximity to the 10500 Biscayne Boulevard property and asked the Village Council to consider their
concerns.
Stephen Zawadska spoke in opposition to the rezoning item and underscored various violations incurred
by Murphy Oil.
Antonio Chiarella spoke in opposition to the third party eComments submitted by Next Movement
regarding the 10500 Biscayne Boulevard property
Pat Cocci thanked some of the Councilmembers for participating the fashion show. She spoke about the
kayak launch proposal at Bayfront Park and the opposition voiced by neighboring property owners.

Janet Goodman voiced her discontent with the Village Council's support of the rezoning request. She
further asked the Village Council to not support the approval of the minutes due to the eComments
submitted by Next Movement regarding 10500 Biscayne Boulevard.
Noel Franz spoke in opposition to the rezoning item. He further objected to the meeting minutes due to
the eComments that were collected by a third party.
Lois Mamula spoke about the numerous petition signatures she collected from Shores Estates residents
who expressed opposition to the potential development of a gas station at 10500 Biscayne Boulevard.
She further spoke about the environmental impact of the proposed gas station to the canal.
Pedro Chevalier spoke in opposition to the rezoning item and the eComments attachment.
Chrissie Chiarella spoke in opposition to the eComments pie chart.
Randy Gottlieb spoke in opposition to the rezoning item due to potential increase in pollution, crime, and
traffic.
Mayor Omarr Nickerson (Village of El Portal) welcomed the new Village Council and shared the Village
of El Portal's practice of attending all of the Council Meetings throughout Miami-Dade County in the spirit
of unity. He spoke about the importance of future collaboration between El Portal, Biscayne Park, and
Miami Shores.
6)APPROVAL OF THE MINUTES
6.A APPROVAL OF THE NOVEMBER 16, 2021 VILLAGE COUNCIL MEETING MINUTES.
Before approving the minutes, Councilmember Burch asked the Village Council to consider adding a
disclaimer to the eComments portal, notifying participants that the Village does not accept entries
submitted by third parties.
Responding to Councilmember Burch, Mr. Sarafan explained that his office has drafted a proposed
ordinance, at the request of Vice Mayor Marinberg, prohibiting third party comments for future Council
consideration. Mr. Sarafan suggested raising any suggestions concerning eComments when the
proposed ordinance is brought forth for Village consideration.
Responding to the various comments made by the public concerning the November 16 eComments, Mr.
Sarafan clarified all eComments are considered a public record and cannot be modified or destroyed.
Although eComments have been attached to the draft minutes, Mr. Sarafan explained the Village Council
would vote on the approval of the minutes. Mr. Sarafan explained the pie chart included in the
eComments attachment is generated by the legislative management solution, Granicus, in response to
the respective position (support, oppose, or neutral) selected by commenters.
Responding to Mayor Harris’ inquiry concerning guest users of the eComments platform, Village Clerk
Rodriguez explained such feature was enabled, as there is no requirement for the public to provide their
name and address for the record. In accordance with the resolution (R-2021-08) that governs public
participation at Council Meetings, guest user comments will not be read into the record; however, it will
become part of the official record of the Village.
Discussion ensued regarding the feasibility of restricting third party eComments.
Mayor Harris moved to approve the November 16, 2021 Village Council Meeting Minutes and
Councilmember Wagar seconded the motion which carried a 4-0 voice vote.

7)VILLAGE BOARD APPOINTMENTS
7.A APPOINTMENT TO THE LIBRARY BOARD OF TRUSTEES (1 UNEXPIRED VACANCY).
Village Clerk Rodriguez provided an overview of the item.
Some of the applicants were present and briefly spoke about their qualifications.
The Village Council proceeded to cast electronic ballots. Upon the conclusion of the first round of
voting, Village Clerk Rodriguez read the following results into the record:
-Kathleen Redmond and Lissette Reid received a tie vote.

Village Clerk Rodriguez provided an overview of the item.
Councilmember Burch moved to appoint Clarissa Rodriguez to the Fine Arts Commission and Mayor
Harris seconded the motion which carried a 4-0 voice vote.
8)ORDINANCE(S) ON FIRST READING
8.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA,
RELATING TO ZONING, APPENDIX “A”, AMENDING ARTICLE V, DIVISION 17,
“LANDSCAPE”, ADDING SECTION 539, “FERTILIZER STANDARDS”; PROVIDING FOR
CONFLICTS, CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE (STAFF:
PLANNING & ZONING DIRECTOR).
Village Clerk Rodriguez read the ordinance caption into the record.
Mayor Harris opened public comments for this item.
Ms. Kate Mason asked whether the item was presented to the Sustainability and Resiliency Committee
for review.
Responding to Ms. Mason, Mr. Travis Kendall, Planning and Zoning Director, answered in the affirmative.
Mr. Kendall provided an overview of the item and recommended approval.
Councilmember Wagar moved approval of the ordinance on first reading and Councilmember Saint Fleur
seconded the motion which carried a 4-0 voice vote.
9)DISCUSSION & POSSIBLE ACTION ITEMS

9.A DISCUSSION OF COUNCIL PRIORITIES FOR MOBILITY PROJECTS (SPONSORED BY:
COUNCILMEMBER ALICE BURCH).
Councilmember Burch provided an overview of the expectations of the multimodal mobility study.
Mr. Christopher Miranda, Public Works Director, delivered a presentation regarding multimodal mobility
improvements, traffic calming measures, and the FDOT developed Transportation Alternative Program
(TAP) grant.
Responding to Councilmember Saint Fleur’s question regarding the installation of speed tables, Mr.
Miranda explained a priority list of streets has been created in order to help curtail vehicular speeding.
Mayor Harris opened public comments for this item.
Ms. Kate Mason spoke about vehicular speeding on 12th avenue and NE 96 Street and advocated for a
crosswalk as well as a speed table at such location.
No action was taken on this item.
10)MANAGER'S REPORT
Village Manager Scott provided an update on various operational matters, including the introduction of
the new Assistant Village Manager Tanya Wilson.
11)ANNOUNCEMENTS
Village Clerk Rodriguez read the announcements into the record.
12)VILLAGE COUNCIL COMMENTS
Councilmember Crystal Wagar- Councilmember Wagar thanked the Recreation Department and
Department of Public Works for their coordination of the last two events. She further spoke about the
importance of residents voicing their position on various matters and thanked them for attending the
meeting.
Councilmember Katia Saint Fleur- No comments were offered by Councilmember Saint Fleur.
Councilmember Alice Burch- Councilmember Burch thanked residents who have taken the time to
voice their perspectives. She further thanked the Department of Public W orks for their hard work.
Vice Mayor Daniel Marinberg- Vice Mayor Marinberg was absent.
Mayor Sandra Harris- Mayor Harris thanked residents for voicing their views. She further thanked
everyone for attending the meeting and wished all a happy holiday season.

I would like to urge our Village Counsil to join the families residing nearby in rejecting the proposal by out of state
land developers to change the zoning and land use of 10500 Biscayne Blvd. Future development at that site
should not include a gas station, or any other commercial business which would jeopardize the Bay and our
community on countless levels. Inconsiderate rezoning of this land ensures greater traffic and general pollution
within our community, crime rate increase, and the threat of fire, explosion, and toxic fumes from the gas station.
Please keep the land use and zone as is, creating the possibility of the land sale to an endeavor that supports a
family friendly and safe environment for our neighborhood.

want to see a gas station and a kayak ramp in our neighborhood. We expect our elected council members to

As a 7 year resident of Miami Shores Estates subdivision I want to once again voice my opposition to the
proposed zoning change to the 105 ST lot. As was expressed by most if not all of the residents surrounding the
area, we expect our council members to support us and protect our neighborhood and environment, and to listen
and understand the many reasons why we Do Not want a gas station in our area. Thank you Council member A.
Burch for your support as a long time resident and council member you truly understand and know the history of
our village. Shame on all the new council members, and 2nd term member C. Wagar, for supporting the

I object to the addition of illegally obtained, some already proven fraudulent 3rd party collected names &
addresses to the minutes for the last Village Council meeting. These names and addresses are from the
northwest side of the Shores, over 2 miles from the proposed development at NE 105 St. & Biscayne Blvd., while
the canvasser didn't bother to seek out the residents closest to the development site. Although the minutes might
be factually correct as a record, this content should at the least be highlighted for what it is within the minutes, if
not struck from the record. Further, it should raise big questions for all on this council as to the merit of working
with a developer who employs such tactics.
Additionally, I would like to state my objection to the development planned for NE 105 St & Biscayne Blvd. The
overwhelming sentiment of the neighbors close to the proposed development is negative, not because it is
development, but because we don't want another gas station. We have already written, emailed, called and
spoken about the myriad reasons for not wanting this gas station and you, our council members, with the
exception of Council member Burch, have ignored us. It's time for you to listen to the people, not the developers.
This development is not in the best interest of Miami Shores.
To those who continue to state that they're afraid of a lawsuit against the Village and this is their reason for voting
for the development - this is a false narrative. The choice before you is to maintain the current land use and
zoning or to vote to change it to suit the developer. There is no other option today. Please consider your
constituents and when the time comes, vote with the people. We elected you, not the developer from South
Carolina.

First, I want to say how disappointed I am at the November 16th Council vote to allow a zoning change at 10500
Biscayne Blvd.
It is reprehensible that Council would favor an out-of-state developer’s profit over their constituents concerns for
their own health, safety, and Quality of Life.
Make no mistake; don’t fool yourself into rationalizing that this is for the good of the entire Village. It is not. In fact,
1/4 of the Village lives in close proximity to the proposed development and will be adversely affected. Our
waterways in the Village, both the Biscayne Canal and Biscayne Bay, will be at risk.
It’s hypocritical to ask the 99 homes in Miami Shores Estates to fork out $10,000 per household for septic to
sewer conversion while you allow our waterways to be affected by a gas station.
You know the reasons we oppose a zoning change. You’ve heard it over and over and over again for months from
scores of residents. But you pretend to listen to us and to care, then shake hands with the devil.

I’ve never ever heard of such overwhelming support against a zoning change (there is no need). This is
completely detrimental to the Miami Shores community. The traffic on Biscayne Blvd is crazy. Adding another gas
station (arent there enough) makes no sense. The council is therefore voting for more traffic and more accidents.
Why take the risk of putting a gas station right next to our canal with beautiful aquatic life? Why would the Council
think this is a good idea? You know we Americans have been told about safety in the past. Remember how safe
the Exxon Valdez was? The Deepwater Horizon? The developers can march out their paid cronies but everyone
can see through that charade. With the Zoning Board rejecting it 4-0 and professional MS township personnel
recommending against and hundreds of people signing petitions and showing up against it is The Council deaf?
And why would they allow an obvious “biased” crony enter false information into the public record about
canvassing the neighborhood and saying there was overwhelming support. S should the Council be investigating
these lies and find out who’s behind it? Do they not hear the people they were elected to represent or is there
something more sinister here? The arguments they provide are hollow with no basis in fact? Threats to sue is
now another “red herring.” The Council is not acting in the best interests of the residents impacted by this
monstrosity of a gas station nor the interest of other residents. Clearly this is the first of more to come. The
Council is demolishing the serenity, history, and village nature of MS. If the Council votes in favor of this rezoning
those members who voted in favor of it, their reputation and legacy will be tarnished and we will all make sure to
vote them out off office but it is possible their “dirty work” will have been done. Council members, you have heard
your constituents “loud and clear.” DO NOT succumb to threats, paid lobbyists, lawyers, biased environmental
“experts” and all the lies and pressures brought on by monied carpet baggers who care nothing about our village.
Your honesty, reputation, and integrity is on display and your vote will indicate the type of politician you are -
supporting the “will of the people” or succumbing to those who only have financial motives.

It is sad to see that those who knocked on my door to ask for votes now turn a deaf ear and do not want to listen
to the community. A gas station threatens the Ecosystem that we have in this inlet of water where so many
natural wonders live, we are bless to live next to the water and we the commitment to take of the environment .
There is not planet B. I do not agree with the approval vote for zoning change to B2 that does not help the
Ecosystem at all. I hope you, members of the council, really listen to me because I am concerned about where I
live. The developer of the gas station does not own the property and lives in another state they do not care what
happens with this community.

uploaded in rapid, time-stamped succession, and few contain any written comments. Further, I oppose the

The minutes from the November 16, 2021, Village Council Meeting indicate a false reflection of the number of
residents that are in favor of the proposed zoning changes and planned gas station at 105th Street and Biscayne
Boulevard. Clearly most of the residents that attended the meeting and those that submitted their own e-
comments are Opposed to the proposed zoning changes and gas station. As publicly admitted by the individual
who prepared and submitted them, the 144 e-comments were the work of an outside consultant that surveyed
village neighborhoods well outside the area of the proposed gas station and zoning changes. The question
should have been asked if the gas station was to be constructed in their neighborhood would they be in favor.
Where is the survey of the residents in the Miami Shores Estates? Where is the survey of the residents located to
the south of the property or East of the Boulevard? Of course, you have already heard from them directly and the
response is overwhelming that we are opposed to this proposed zoning change and proposed gas station. Those
reasons are many and have already been communicated to you directly from the residents most impacted by this
proposed development. Outside consultants submitting favorable responses to a survey that those in the
immediate area were not included in, is distorting the truth and should be deemed irrelevant. Looks like someone
was stuffing the ballot box and didn't even bother to cover up their tracks. If not illegal certainly ethically
questionable. Was this consultant hired by the gas station developer of the property that we are supposed to trust
to do what is best for all of Miami Shores Village? I don't think you were elected to put the financial interests of a
gas station developer ahead of the quality of life of the village residents. These e-comments submitted by one
individual on behalf of multiple residents should be called out for what they are "stuffing the ballot box" and
deemed invalid. Thank you.

Hi, I am Pablo Arrieta, Miami Shores resident and I don't think this minute reflect the general feeling about the re-
zoning petition. I oppose to the re-zoning since I feel there is a better use of that land other than what was
discussed during the meeting (I was personally present in it). Also, my suggestion is to review the e-comments,
not all of them seam legit.

With regard to the minutes of the past meeting and specifically of discussion of items 7A and 7B, I want to
comment on the abusive and unprecedented inclusion of 144 e-comments by an agent of the developer. It is
definitely unethical, possibly fraudulent (were those comments verified other than by the affirmation of the
developer's agent? did they only include favorable comments?) and a disgusting subversion of the spirit of public
commentary, skewing the record and putting at a disadvantage the residents who don't have the resources to hire
public consultants and law firms. Public comment is often the only way Village residents can make their case to
their government, allowing manipulation will inevitably undermine the public trust.
I'm no stranger to politics and have seen first-hand the dirty tactics developers use to sway public perception but
this is a first for our Village, and should not set a precedent. I thank Vice Mayor Marinberg and Councilmember
Busch for bringing up this issue during the meeting, but more must be done in order to send a stronger message.
Strike those 144 comments from the record, correct the perception that there is public support of the rezoning,
and create clear guidelines for future use of the e-comment system (no more canvassing and bulk comment
uploading should be allowed.)

I oppose the approval of the minutes from the Nov. 16 meeting as questions have arisen regarding the validity of
approximately 100 e-comments showing support for the Murphy gas station project on 105th street. If these e-
comments can't be verified or are incorrect, then they are not reliable and shouldn't be approved in the minutes
from that meeting.

I feel so disappointed with the council's decision to approve this zoning change. Each one of you saw the amount
of constituents against it and you still vote YES to approving this? You were elected by the residents of Miami
Shores, to serve the residents of Miami Shores. It seems like you do not care about majority of the village you
represent and voted for you. By approving this, you are looking at adding more problems related to traffic,
violence and disturbance in the future. From what we all witnessed last meeting, majority of your village is against
this project. So why go against your constituents decisions?

Dear Council, thank you for your participation in our village. We are opposed to the zoning change of the 10500
Biscayne Blvd. site. Traffic congestion has been increasing in much of the South Florida area, development or
not, and everything indicates that it will continue to get worse, representing an undoubted menace to the quality
of our life in the Miami Shores Village. Currently, the traffic flow to exist the 104th Street, Miami Shores Golf
Course and all the way up to 96th Street heading North is a very, very dangerous expedition. Currently, we have
to wait until the traffic light changes to red in order to make a left-hand turn heading North. If there is a busy gas
station, we will never be able to Safely make a left-hand turn heading North. This does severely impact the streets
all the way South. We would like to see the traffic study that you have acquired. It's a shame that our newly
(driver) licensed children have to take their lives in your hands to exit their own street. Why would you approve of
such a dangerous situation and congestion-filled proposal when the majority of the village does not agree?
Additionally, we would like to verify the support of the neighbors on the farthest west side of the village. Firstly,
these folks are not severely affected by the zoning change as the East side residents. Secondly, we understand
many of these folks never even commented for approval of the zoning change or even still live in the village. The
Village Council has to perform its due diligence and validate these approval comments.
We would really like our voices to be heard. The majority of the village opposes this change. The village can
produce the same tax revenue by allowing single family or townhomes to built in keeping with the beauty and
charm of our village. This is the Northernmost point of our charming Village. Does Coral Gables, Biscayne Park,
or any other beautiful area have a Gas Station to welcome everyone into their Village? Please listen to the voice

Jennifer Ale-Jathar- 1055 NE 105 street. I oppose the zone change proposed at the November 16 meeting and
am very disappointed in the council’s vote. Clearly they are not taking us, the residents, into consideration in their
vote. If they did, they would vote against it since it is what the overwhelming majority wants. Our families are the
ones that live here and will be directly impacted with this change. Please do not lose sight of that and fight for us.
There are so many better residential options that can happen on that land to maintain the current safer and
cleaner conditions. Please hold the developer accountable for lying about the support from residents for this
project which is not true. The overwhelming majority does not want this. And please show them that they cannot

I am very much opposed to the zoning change for the parcel on Biscayne Boulevard/105th Street. I don't see any
benefit since we have 3 gas stations in a short driving distance, and the negative effect on the neighborhood

I strongly oppose the change of use of land with the proposal of building yet another gas station so close to my
home. Why open a business that will bring environmental issues and potential criminal activities? We observe
everyday all the issues that gas stations bring to the community in the ones nearby. The zoning commission and
even the police of the Village have recommended not to change the use of land to allow a gas station. There are
so many possibilities of other type of businesses that will impact the community in a positive way. I try to

listing a name and address. The ecomments do not actually contain any comment at all so should not be seen as
support. It should not be held as face value of an approval of rezoning because Greg King of Next Movement
simply said that the information is accurate. An audit of this information should be performed if you would like to

My Name is Brandon Moran, resident at 1070 NE 105th street, Miami Shores, FL 33138. I strongly oppose the
consideration for rezoning this parcel of land simply because it will directly jeopardize the safety and security of
our wonderful neighborhood. Not only will a rezoning open up the threat of misuse of that lands original intent, it
will also attract the wrong kind of development for our area. I am interested in partnering with developers to plan
out a property use that continues to work within the current zoning to be a viable, and profitable solution, but
rezoning is not that. Additionally, the approach by the developer, and perceivable conflict of interest between
some of the council members and the developers lead us to believe there are questionable actions beyond our
current knowledge. For the sake of transparency and duty to the ethics of this position, we are imploring you to
consider the voices opposed to this re-zone and request that you do so with the highest of ethical standards. Now
that this topic is a critical concern for the neighborhood, there will be heightened scrutiny on the actions and
behaviors of this council going forward.

setting the precedent that a buyer of a property can change the zoning of Miami Shores with complete disregard

Jade Moran: I'm very confused and concerned from the last meeting. There were FAR more people opposed to
the proposition then in support of. Most of the people who expressed their concerns are the ones whom will be

The minutes reflect a “gentlemen” saying he canvassed the neighborhood and found most people in favor of the
rezoning. This is a blatant lie with no proof, no people willing to support the veracity of this unsubstantiated claim.
