R-2021-121 RESOLUTION NO. 2 -------- 3 A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES 4 VILLAGE, FLORIDA, SUPPORTING THE MIAMI-DADE COUNTY 5 RESOLUTION, CREATING A SEPTIC TO SEWER TASK FORCE; 6 DIRECTING THE VILLAGE CLERK TO TRANSMIT A COPY OF THIS 7 RESOLUTION TO THE NAMED OFFICIALS LISTED HEREIN; AND 8 PROVIDING FOR AN EFFECTIVE DATE . 9 10 WHEREAS, in Miami-Dade County, approximately 108,000 properties are served by 11 septic tanks and are not connected to the County's sanitary sewer system; and 12 13 WHEREAS, according to Miami-Dade County's Water and Sewer Department ('WASD"), 14 the overwhelming bulk of properties within Miami Shores Village lack access to the 15 sanitary sewer system (over 3120 residential properties and dozens of commercial 16 properties as well); and 17 18 WHEREAS, septic tanks treat and dispose of wastewater in an underground drain field; 19 and 20 21 WHEREAS, improper maintenance, aging infrastructure, and groundwater levels hinder 22 septic tanks from functioning as designed; and 23 24 WHERAS, improperly functioning septic tanks may pose financial, environmental, and 25 health risks; and 26 27 WHEREAS, the Miami-Dade County Water and Sewer Department and Department of 28 Regulatory and Economic Resources provided a Plan of Action Report regarding septic 29 tanks on December 10, 2020; and 30 31 WHEREAS, there is an item on the Agenda for the County's July 8, 2021, board meeting 32 regarding establishing a Task Force that will study issues related to the conversion from 33 septic tanks to the sanitary sewer system in Miami-Dade County and make 34 recommendations regarding same; and 35 36 WHEREAS, the Task Force would be established solely for advising the board and the 37 County Mayor on issues related to septic to sewer conversion in Miami-Dade County; and 38 39 WHEREAS, the Task Force would be required to provide a written report with 40 recommendations to the Board within 364 days of the effective date of the County's 41 resolution and would sunset on that date as well; and 42 43 WHEREAS, it is the desire of the Village Council to support the passing of the County's 44 Resolution during the July 8th meeting. 45 Page 1 of 2 2021-12 1 NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MIAMI 2 SHORES VILLAGE, FLORIDA: 3 4 Section 1. The foregoing recitals are hereby ratified and confirmed as being true and 5 they are incorporated into this resolution by reference as if set forth in full herein. 6 7 Section 2. The Miami Shores Village Council supports the passing of the Miami Dade 8 County Resolution creating a Septic to Sewer Task Force. 9 10 Section 3. The Village Clerk is directed to transmit a copy of this Resolution to the Miami- 11 Dade County Board of County Commissioners. 12 13 Section 4. Severability. If any section clause, sentence, or phrase of this resolution is 14 for any reason held invalid or unconstitutional by a court of competent jurisdiction, the 15 holding will not affect the validity of the remaining portions of this resolution. 16 17 Section 5. Effective Date.
