PREPARATION: The Purchaser agrees to fiilly prepare and make ready, in advance of installation, all job areas, surfaces and openings in order to permit continuous and uninterrupted installation work 8. INSURANCE: Seller agrees to carry Workmen's Compensation Insurance in compliance with the Workmen's Compensation Law of the state in which the work is being performed. Seller also agrees to tarty Public Liability Insurance in limits of $1,000,000.00/$2,000,000.00 for Bodily Injury and $250,000.00/$500,000.00 for Property Damage. Any additional coverage that may be required will be for the account of the Purchaser. 9. TAXES: This proposal does not include any Federal, State, or Municipal sales or use tax, unless so stated in this proposal. 10. WORK NOT INCLUDED: This proposal does not include furnishing or installing of any structural steel, flashing glass, scaffolding, or caulking, or any items such as shipping, masonry, changes of opening, cutting of holes for other trades, famishing of material or labor necessary to correct the mistakes of others, physical protection, cleaning or protection of work after installation or the grouting in or pointing of material unless specifically called for in this proposal. Purchaser shall immediately check and inspect all materials on their arrival and if found improper, short, or damaged shall immediately file claim with the carrier. If any other defect, shortage, or improper quality of material is disclosed, Purchaser shall give written notice to Seller within five days from the receipt of materials from carrier. Seller shall have right to repair, modify, or otherwise correct any matters that seller deems in need of correction. System is not watertight sealed. 13. BONDS: If Surety or Performance Bonds are required to be furnished by the Seller, cost of such bonds shall be home by the Purchaser. 14. TOOLS, JIGS, FIXTURES: Tools, jigs, and fixtures shall remain the property of the Seller unless initially furnished by the Purchaser. 15. CANCELLATION: Cancellation of this contract in its entirety or as to any part not performed, if desired by the Purchaser and approved by the Seller will provide payment pro -rated for work done, and for material in process or fabricated. MATERIAL OWNERSHIP: Ownership of materials delivered shall remain with the Seller until all payments have been made and received by the Seller. The Seller reserves the right to remove any such material from the job site if any dispute over payments remains unsettled. If payments are not maintained per contract, the Seller, without any penalty for delay, reserves the right to hold up further shipments and work until payments are made.
