RC-14-2111 (3)1 5,ttkr- () OD 1 E I 4 "1% June 3, 2015 Ms. Valery Brown Genesis Development Group, LLC 1521 Alton Road, Suite 6798 Mimi Beach, Florida 33139 Re: Complaint by Elise Chambers to Florida Department of Business and Professional Regulation Dear Ms. Brown: We, the undersigned shareholders in the Miami Shores Co -Op Apts., Inc. ("Co -Op"), write this letter to you to clarify that the contract with your firm for the repair of the premises at Unit 7, 770 N.E. 91" Street, Miami Shores, Florida 33138 was between the Co -Op represented by Stephen Nader and your firm. Because Ms. Elise Chambers is also presently the president of the Co -Op, there is an inherent conflict in her speaking as shareholder and president. Therefore, the Co -Op voted on February 27, 2014 that Stephen Nader was to be the spokesman of the Co -Op with your firm regarding the repair of the aforesaid premises. Ms. Chambers did not enter into the contract, nor could she, because this is a co-op which owns the unit; the individuals are only stockholders in the Co -Op. The reason that Mr. Nader was so empowered is that we all felt he has acted completely professionally and properly in handling the communication and finances in the said repair. Further, with regard to the funds disbursed to your firm, there were damages to parts of the building beyond Apt. 7.Therefore, additional funds were given to your firm for those areas. Finally, with regard to delays, we are aware that DERM had held up repairs to be made to the bath room. As recently as February of this year, obtaining of the master permit also held up work. Finally, delays were caused by changes made by Ms. Chambers after the contract was entered into and that she requested the work to be held up in an attempt to hire another contractor. Again, however, no individual owns the units. In any event, all this was beyond your control.
