We submit the following proposal to you in confidence, not to be disclosed to any other person without our
prior written consent, to perform work as described in the following scope of work:
TERMS AND CONDITIONS
Southeast Marine Construction, Inc. (SMC) will furnish all labor, materials, equipment, supervision and licenses
necessary to perform the Scope of Work as identified herein, according to the approved, engineered plans and
specifications, and also all applicable building codes and ordinances of agencies and governing bodies with
jurisdictional powers at this location. SMC shall carry General Liability and Workers Compensation insurance,
insuring any liability which may be imposed upon SMC or client. If client requests to be additionally insured
there will be an additional charge of $125.00. SMC is not responsible for any removal, installations, repairs or
damages to any and all landscaping; utilities; unknown, unseen, hidden or buried obstructions; or damage to
structures in the vicinity of the work area due to routine and proper performance of the job. SMC will make
every effort to perform the work in a timely and expeditious manner. Manufactures or SMC shall have no
obligation under any warranty unless SMC has been paid in full for all materials supplies and services. Unless
SMC fails or refuses to perform, the deposit is not refundable. Client agrees to promptly pay all invoices for all
work completed upon receipt of invoice, according to mutually accepted schedule of values for work in progress.
Any amount invoiced past due more than 30 days will be subject to a finance charge of 1.5% for every 30 days
late thereafter. Any progress invoices past due more than 10 days will result in stopping of all work until
invoices are paid. Any written changes to the following Scope of Work must be initialed by both SMC and the
client for any changes to be considered valid. Any alterations from Scope of Work will be executed only upon
written Change Order and will become an extra charge over and above the contract. Client will furnish all
refundable municipal and environmental bonds, owner compatible with local ordinances. If hard bottom
conditions are encountered, during any pile placement activities, requiring punching prior to driving, additional
charges will be assessed. Permit fees and permit related fees (i.e.: engineering, surveys, etc.) are NOT included
in the price of the contract; owner will reimburse SMC or pay proper agency direct for all permit, engineer,
special inspector and process related costs and fees.

stainless -steel hurricane straps, using double thru bolts and double stringer framing system.
c) Decking to be Preserve Plus, Ultra Tropical, 2" x 6", decking boards secured with stainless steel decking
screws.
d) Piles will be furred with 1" x 2", marine treated, furring strips and topped with new copper caps.

j) Warranty: 1 year structural, and 2 years on motors.

THIS AUTHORIZATION SHALL BE KEPT ONSITE DURING ALL PHASES OF WORK
Specific Conditions
By commencing the work authorized herein, the applicant and contractor agree to comply
with all conditions of the emergency authorization and the applicant agrees to submit a
complete Class I- permit application within 6 months of the start of work, including all
items listed in Attachment B. Any questions or concerns relating to the required items or any
other issues should be addressed with DERM staff, and if applicable, any revisions obtained from
DERM in writing, prior to the start of work.
2. A statement of acknowledgment as the contractor of record for the work authorized herein shall
be submitted directly from the contractor of record to DERM and shall include the contractor's
name, address, telephone number, State of Florida or Miami -Dade County license number,
DERM Class I permit application number, and description of the scope of work subject to the
emergency authorization. This Information is required to be provided a minimum of 2 and a
maximum of 6 business days prior to the start of work, and may not be submitted through
a third party.
3. All work shall be performed in accordance with the drawings approved by:Q�14Q and ;ttacbed
hereto (Attachment A), and in accordance with the conditions of the Emerggrlqy. Auth*t;Mldh.

4. All activities shall be conducted so as not to cause pollution or result in adww"0impacts to she
environment, including but not limited to impacts to marine fauna, the submafgad bottolh,*w2fer
quality, mangroves, seagrasses and other marine resources. All activities.shaI6 be conducted
using best management practices to prevent the release of any pollutantsog debris to 4he
environment and to prevent impacts to State or County water quality standards: For an;-1Mpa8`ts
caused by the construction or operation of the structures/faci;ity, DERrNsAJ requires at:a
minimum, restoration and mitigation.
5. Unless specifically listed as "Authorized Emergency Work" or exempt pursuant to Sections
403.9321-403.9334 F.S., trimming or alteration of mangroves is prohibited.
6. Representatives of DERM shall be notified immediately in the event of impacts to tidal waters, of
any impacts to natural resources,. or any spills or water quality standard exceedance. Any
adverse impacts determined to have occurred shall be required to be mitigated to DERM's
satisfaction.
7. The repair or replacement of legal structures is limited to their original location and dimensions
and in accordance with the sketches in Attachment A.
8. The wetface of any new or replacement seawall shall be located a maximum of 1 foot waterward
of the location of the wetface of the existing or previously existing seawall prior to the collapse or
damage occurring.
9. The contractor and applicant are advised that the reclamation of property lost as a result
of seawall failure and the excavation or use of benthic substrate as backfill landward of
the seawall Is strictly prohibited unless specifically listed in the "Authorized Emergency

new seawall is allowed pursuant to this authorization. Any excavation waterward of a new seawall
shall constitute a violation of this authorization.
10. The contractor shall submit receipts or weight tickets for the dprap that is placed on -site. This
condition shall be satisfied -within 30 days of the completion of the seawall.
11. The installation of fenders, davits, mooring whips, cleats, or any hardware to facilitate the mooring
of vessels along the seawall is prohibited unless specified in the "Authorized Emergency Work".

12. If the project involves construction, replacement, or repair of a seawall, the new seawall cap shall
be a minimum of 6 inches above the final grade of the immediately adjacent uplands. In order to
prevent positive drainage of stormwater into the waterway, all uplands immediately adjacent to
the seawall cap shall be sloped away from the waterway.
13. This emergency authorization does not eliminate the necessity to obtain any required federal,
state, and local authorizations prior to the start of any activity approved by this emergency
authorization. In the event that any agency requires removal or relocation of the work authorized
herein, a review by DERM is required, and a new authorization and/or permit modification may be
required.
14. This emergency authorization does not convey to the applicant or create in the applicant any
property right or privilege, or any interest in real property, nor does it authorize any entrance upon
or activities on property which is not owned or controlled by the applicant. In the event that any
structure authorized hereunder is determined by a final adjudication issued by a court of
competent jurisdiction to encroach on or interfere with adjacent riparian ,rights, the applicant
agrees to either obtain written consent for the offending structure from the affected riparian owner
or to remove the interference.

GENERAL NOTES:
1. Construction to follow the Florida Building Code 5th Edition (2014) and amendments as applicable and all
Local, State and Federal Laws.
2. Licensed contractor shall verify the existing conditions prior to the commencement of the work, Any
conflicts or omissions between existing conditions or the various elements of the working drawing shall be
brought to the attention of the Engineer prior to the commencement of the work. The Licensed Contractor
and all subcontractors are responsible for all lines, elevations, and measurements in connection with their
work.
J. Do not scale drawings for dimensions.
4. Any deviation ord/or substitution from the information provided herein shall be submitted to the Engineer
for approval prior to commencement of work.
5. All unanticipated or unforeseen demolition and/or new construction conditions which require deviation from
the plans and notes herein shall be reported to the Engineer prior to commencement of work.
6. All new work and/or materials shall conform to all requirements of each administrative body having
jurisdiction in each pertaining circumstance.
7. All new materials and/or patchwork shall be provided to match existing materials and/or adjoining work
where practical except as specifically noted herein.
8. Licensed Contractor to shall use all possible care to protect all existing materials, surfaces, and
furnishings from damage during all phases of construction.

1. Pile driving operations shall be observed by a special inspector, including test piles sufficient to determine
the approximate length required to meet design capacity.
2. Piles shall be driven using an approved cushion block consisting of material so arranged so as to provide
the transmission of the hammer energy. L J
J. Piles shall be driven -to required capacity a minimum of 8' into berm.
4. Piles Piles shall be driven with a drop hammer or gravity hammer provided the hammer shall weight no less than
3,000 pounds, and the fall of the hammer shall not exceed 6'.
5. Piles shall be driven with a variation of not more than 4 inch per foot from the vertical, or from the batter
line indicated, with a maximum variation of the head of the pile from the position shown on the plans of
not more than three inches.
6. Where piling must penetrate strata offering high resistance to driving, the structural engineer of records or
special inspector may require that the piles be set in pre —drilled or punched holes. The piles shall reach
their final penetration by driving.
