3 A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES
4 VILLAGE, FL, AMENDING THE PROCEDURES AND RESTRICTIONS
5 FOR PUBLIC COMMENT AT VILLAGE COUNCIL MEETINGS; AND
6 PROVIDING FOR AN EFFECTIVE DATE.

9 WHEREAS, representative local government requires that legislative and certain administrative
10 matters brought before the Village Council be open to public comment and debate, with
11 reasonable limitations, so that input and information may be obtained from all citizens of the
12 Village for consideration by the Council; and,
13
14 WHEREAS, the primary purpose of Village Council meetings is to determine municipal policy
15 and to implement the government of the Village for the benefit and with the participation of all of
16 the citizens of the Village; and,
17
18 WHEREAS, during the May 4, 2021 Village Council Meeting, the Village Council directed Village
19 staff to prepare a resolution encompassing Village Council recommendations concerning public
20 comment for Village Council consideration; and,
21
22 WHEREAS, it is in the best interest of Miami Shores Village that Village Council meetings be
23 conducted in an orderly fashion.

25 NOW, THEREFORE, be it resolved by the Village Council of Miami Shores Village, Florida:

27 Section 1. Public comment shall be permitted on all matters under consideration for adoption by
28 Village Ordinance.

30 Section 2. Public comment shall be permitted on all other matters that come before the Council
31 for its consideration, and for open public comment at the beginning of the Council's
32 agenda for the meeting.

34 Section 3. Public comment shall be subject to the following limitations:

36 A. Speakers shall each be limited to a presentation of two (2) minutes per agenda
37 item; the same limitation shall apply to open public comment at the beginning
38 of the Council's agenda for the meeting;

40 B. When a large number of the public wish to speak on an item, groups may be
41 limited to one representative per group per agenda item or may silently wave
42 in support or in opposition of such item(s) when the question is asked by the
43 Presiding Officer;

C.
Item -specific public comment shall occur before Council discussion and shall

be restricted to discussion of matters relevant to the agenda item then before
3
the Council and such comments shall be limited to one comment per person
4
for each agenda item;

D.
Any member of the public who provides item -specific public comments during
7
open public comment shall not provide additional comments when the presiding
g
officer opens the floor to comments related to such items .

E.
Any member of the public who wishes to provide public comments on agenda
items that are considered by the Village Council after 9PM shall be limited to
11
12
one (1) minute per person for each agenda item.

F.
Any member of the public who wishes to engage in public comments may do
so in person or via eComments (electronic written comments), but not both;
15
16
G.
The deadline to submit eComments shall be three (3) hours before the start of
17
18
the corresponding Village Council Meeting;
19
20
H.
eComments provided by any member of the public who remains anonymous
21
will not be read into the record at the meeting, but will be circulated to the
Village Council before the meeting and retained as part of the official record.

I.
H. Any member of the public who:
25
26 i) engages in the use of abusive or profane language, physical violence or
27 the threat thereof, or other loud and boisterous behavior, which the Mayor
28 or presiding officer determines is intended as, or has the effect of, disrupting
29 or impeding the functioning of the meeting; or
30
31 ii) after being warned, continues to violate the limitations on public comment
32 set forth in this Resolution;
33
34 may be ejected from the Council meeting for the duration of the meeting or for such
35 lesser time as the Mayor or presiding officer determines.

The procedures set forth in this Resolution shall take effect immediately upon its
adoption.
