R-2021-041 2 RESOLUTION NO. 2021-04 3 A RESOLUTION OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, 4 FLORIDA, URGING THE FLORIDA LEGISLATURE TO STRENGTHEN CONSUMER 5 PROTECTION MEASURES TO PROPERTY ASSESSED CLEAN ENERGY (PACE) 6 PROGRAMS; TO EXPAND THE QUALIFYING IMPROVEMENTS THAT MAY BE 7 FINANCED THROUGH PACE PROGRAMS TO INCLUDE CONVERSION FROM 8 SEPTIC TANKS TO SEWER SYSTEMS AND OTHER SEWAGE TREATMENT 9 IMPROVEMENTS; TO PRELIMINARILY IDENTIFY THIS ISSUE AS A STATE 10 LEGISLATIVE PRIORITY FOR THE 2021 SESSION; DIRECTING THE VILLAGE 11 CLERK TO TRANSMIT A COPY OF THE RESOLUTION TO THE NAMED OFFICIALS 12 LISTED HEREIN; AND PROVIDING FOR AN EFFECTIVE DATE. 13 14 WHEREAS, Miami Shores Village participates in the Property Assessed Clean 15 Energy (PACE) programs that provide additional ways that property owners can finance 16 certain improvements to their real property by opting into a special assessment district 17 through non ad -valorem assessments on the owner's property tax bill; and, 18 19 WHEREAS, Section 163.08 Florida Statutes provides that only certain kinds of 20 improvements may qualify for PACE financing in Florida; and 21 WHEREAS, numerous properties in Miami Shores Village in Miami -Dade County 22 are served by septic tanks and are not connected to a sanitary sewer system; and 23 WHEREAS, sewage treatment improvements such as the conversion of properties 24 from septic tanks to sewer systems are not currently eligible for PACE financing because 25 they are not listed as a qualifying improvement in Section 163.08; and 26 WHEREAS, Section 163.08 could be amended to expand the list of qualifying 27 improvements to also include sewage treatment improvements including the replacement 28 of an onsite sewage treatment and disposal system with an central sewer system together 29 with the associated fees or charges to connect to said sewage system; and 30 WHEREAS, adding these sewage treatment improvements to the PACE list of 31 qualifying improvements would provide additional options for property owners to finance 32 such sewage treatment improvements; and 33 WHEREAS, in furtherance of the Village's efforts to support property owners in the 34 conversion of their properties from septic tanks to sewer systems, the Village Council now 35 urges the Florida Legislature to add substantial consumer protection measures to PACE 36 programs by expanding the list of qualifying improvements for PACE to include sewage 37 treatment improvements and to preliminary identify this issue as a state legislative priority 38 for the 2021 session. 39 NOW, THEREFORE, BE IT DULY RESOLVED BY THE MIAMI SHORES 40 VILLAGE COUNCIL, 41 Section 1. Urges the Florida Legislature to expand the qualifying improvements that 42 may be financed through PACE programs to include sewage treatment Page 1 of 2 1 improvements including the replacement of an onsite sewage treatment and 2 disposal system with an advanced central sewage treatment system to 3 include the associated fees or charges to connect to said sewer system. 4 Section 2. Preliminarily identifies this item as a state legislative priority for the 2021 5 legislative session. 6 Section 3. Directs the Village Clerk to transmit certified copies of this resolution to the 7 Governor, the Senate President, the House Speaker and the Chair and 8 Members of the Florida State Legislative Delegation. 9 Section 4. Directs the Village's state lobbyist to advocate for the legislation described 10 in Section 1 and Section 2 above. 11 Section 5.
