Chairman Huber read into the record the Quasi-Judicial Virtual Hearings rules adopted in accordance with the Florida Governor's extended Executive Order 20-69 and 20-112, Florida Statutes Chapter 252, and 120.54(5)(b)(2) in order to prove for quasi-judicial virtual meetings of the Village Council and quasi-judicial Village boards. 2) ROLL CALL Present: Mr. Rod Buenconsejo Ms. Darci Cohen Mr. Barry Perl Chairman Patrick Huber Absent: Ms. Gladys Coia Mr. Robert Vickers Also present: Ms. Elizabeth McIntosh - Village Attorney Mr. Lazaro Remond - Code Director Ms. Mariana Gracia - Code Clerk 3) FIRST HEARING - NOTICES OF VIOLATION – NONE 4) PENALTY HEARING - ENFORCEMENT ORDERS – NONE 2 5) REQUEST FOR RELIEF 5.A Request for Relief Samuel Soriero 149 NE 99 Street Mr. Samuel Soriero was present, was sworn in to testify. Mr. Soriero testified that the contract with the Village had expired and work was not finished. He would like the Board to consider the amount he paid when the contract was signed. The Board asked questions. Chairman Huber asked if $500.00 was the final offer and how long to pay. Motion to accept $500.00 payable in 30 days made by Mr. Huber, seconded by Mr. Perl and the Motion failed 2-2. Board Proposed $1,500.00 payable in 180 days by Mr. Perl, seconded by Mr. Huber and the Motion was approved 3-1 with Mr. Buenconsejo voting against. 149 NE 99 Street.pdf 5.B Request for Relief Mr. Ed Capital Corp. 231 NE 104 Street Mr. Ed Ibarra was present, was sworn in and testified that the house was bought in foreclosure for $30,000.00. The Board asked questions. The amount was amended to $3,500.00 payable in 30 days. Motion to accept $3,500.00 payable in 30 days made by Mr. Perl, seconded by Mr. Huber and the Motion was approved 4-0. 231 NE 104 Street.pdf 5.C Request for Relief David Carlisle 1311 NE 105 Street Mr. David Carlisle was present, was sworn in and testified that he is trying to close but it was postponed because of this lien. Also present, Attorney Michael Tobin representing Mr. Carlisle. Mr. Tobin proceeded to claim that because the Enforcement Order recorded had no fine amount in paragraph 5 that there should be no lien. The Village Attorney said that this is not the position our Legal Department takes. The amount not filled in in paragraph 5 of the Enforcement Order is considered a scrivener’s error. The Board asked questions. The amount offered was amended to $1,000.00 payable in 30 days. Motion to approve $1,000.00 payable in 30 days by Mr. Huber. The Motion failed due to lack of second. 3 1311 NE 105 Street.pdf 5.D Request for Relief Laudy Luna 10666 NE 11 Avenue 10 minutes’ recess took place before this case. Ms. Laudy Luna was present, was sworn in and testified that she had no prior notice of this lien until she found a notice on her door. She went through a difficult divorce and her ex-husband did not let her know about the notice he received. She is trying to refinance and this lien came up on the title search. Mr. Camilo Bautista, her husband now testified to the same. The Board asked questions and made comments. The amount of the offer was amended to $1,000.00 payable in 30 days. Motion to accept $1,000.00 payable in 30 days by Mr. Huber, Motion failed for lack of second. Board Proposal by Mr. Buenconsejo in the amount of $2,000.00, Amended, seconded by Mr. Perl to $1,500.00 payable in 30 days and the Motion was approved 4-0. 10666 NE 11 Ave.pdf 5.E Request for Relief Victor & Elizabeth Oharriz 276 NE 105 Street Ms. Elizabeth Oharriz, Ms. Christina Martinez and Mr. Jorge Brito were present, they were sworn in. Ms. Oharriz testified that her husband had been going through medical issues and she wants to sell the house and move for a peaceful place. Ms. Martinez came in and is trying to buy the house. The house is in great shape. Existing mortgage is about $424,000.00. Ms. Martinez offered to pay $500,000.00 for it. Ms. Oharriz is in agreement with this offer. The Board asked questions. The amount offered to settle the lien is $4,723.00 payable in 60 days. Motion to accept the amount of $4,723.00 payable in 60 days made by Mr. Buenconsejo, seconded by Mr. Huber and the Motion was approved 4-0. 276 NE 105 Street.pdf 6) MINUTES 6.A Approval of the Code Minutes of September 3, 2020 Motion to approve the minutes as amended to reflect Chairman Huber’s attendance made by Mr. Perl, seconded by Mr. Buenconsejo and the Motion was approved 4-0. Code Minutes September 3, 2020.pdf 4 7) DISCUSSION Discussion by the Board and Staff about our next meeting on November 5, 2020 tentatively in the Council Chambers following the Covid19 guidelines. Chairman Huber requested that we follow up with Mr. Vickers regarding his Board position. Director, Lazaro Remond testified that Mr. Vickers did try to join last meeting via zoom on October 1, 2020 but could not get in. 8) ADJOURNMENT Motion to Adjourn by Mr. Buenconsejo, seconded by Ms. Cohen and the meeting adjourned 4-0.
