2020-03-05 CEB Minutes 1 Mayor Crystal Wagar Vice Mayor Alice Burch Vice Mayor Sean Brady Councilman Stephen Loffredo Councilman Jonathan Meltz Tom Benton, Village Manager Richard Sarafan, Village Attorney Ysabely Rodriguez, Village Clerk CODE ENFORCEMENT MEETING MINUTES DATE: March 5, 2020 TIME: 6:00 PM COUNCIL CHAMBERS 1) CALL TO ORDER Chairman Patrick Huber called the meeting to order at 6:00 PM. 2) ROLL CALL Present: Mr. Robert Vickers Ms. Darci Cohen Ms. Stephanie Pavolini Mr. Rod Buenconsejo Ms. Gladys Coia Mr. Barry Perl Chairman Patrick Huber Also present: Richard Sarafan, Village Attorney Lazaro Remond, Code Enforcement Director Mike Orta, Code Enforcement Officer Mariana Gracia, Code Enforcement Clerk 2.A SWEARING IN OF WITNESSES BY THE VILLAGE ATTORNEY: Will everyone that is going to testify tonight please raise your right hand and swear to tell the truth, the whole truth and nothing but the truth. 3) FIRST HEARING - NOTICES OF VIOLATION Case# 000438-2020 US Bank Trust LSF9 2 Master Participation Trust 501 NE 105 Street Lazaro Remond, Code Compliance Director testified that this violation was for work without permit and that he had made contact with the Contractor. The Contractor was present and testified and agreed to the violation. Mr. Remond made a recommendation for 90 days’ extension with the Contractor agreeing to this time. The Board asked questions. Motion to accept the Staff's recommendation of 90 days to comply and that a violation exists in conclusion of law made by Ms. Gladys Coia, seconded by Mr. Rod Buenconsejo and the Motion was approved unanimously. Case# 004721-2019 Estate of Louise Alexandre 601 NW 112 Street Ms. Nataki Kupta was present and wished to testify. Lazaro Remond, Code Compliance Director testified of the violation and that Ms. Kupta has been working with the Department. Staff recommends 90 days to cure the violation. The Board asked questions. Motion to accept the Staff's recommendation of 90 days to comply and that a violation exists in conclusion of law made by Mr. Barry Perl, seconded by Mr. Rod Buenconsejo and the Motion was approved unanimously. Summary Adjudication for 1st Hearings: Case(s): 000150-2020; 000439-2020; 004406- 2019; 000016-2020; 000357-2020; 005470-2019; 014908-2019. The officer, Mike Orta, testified that Affidavits of Non-Compliance and evidence of violation exists in each of the files. Motion: I move for summary adjudication of all such cases to include a finding of fact and conclusion of law that a violation exists as charged in the respective notice of violations issued therein and that, in each such case, the offending party shall correct the violation within time period specified and immediately notify the Code Enforcement Officer when the property is brought into compliance. In each such case, if the violation is not brought into compliance within such time period, the Code Enforcement Officer may report this fact back to the Board in accordance with the Board’s Rules and Regulations at which time a fine is hereby authorized to be automatically assessed against the violator. In the respective daily amounts specified in staff’s recommendations for tonight’s hearing, retroactive to the original compliance deadline. He agrees that a violation exists. Lazaro Remond, Code Compliance Director recommends 60 days to comply. The Board asked questions. Motion to accept the Staff's recommendation of 60 days to comply and that a violation exists in conclusion of law made by Mr. Rod Buenconsejo, seconded by Ms. Stephanie Pavolini and the Motion was approved unanimously. Summary Adjudication for Penalty Hearings: Case #’s: 000045-2020; 008113-2019; 013752-2019; 015141-2019. The officer, Lazaro Remond, testified that Affidavits of Non-Compliance and evidence of violation exists in each of the files. Motion: I move that, in each case currently remaining on the penalty docket for tonight’s hearing, each respective violator be ordered to pay the daily fine previously adjudicated and authorized to be imposed against them by prior order of the Board, retroactive from the day the violation was to have been corrected, that upon recording, the Board’s Order in this regard will constitute a lien on the property of the violator. The Board asked questions. Motion to accept $2,100.00 payable in 30 days made by Mr. Vickers, seconded by Mr. Buenconsejo and the Motion was approved 6-1 with Mr. Barry Perl voting against it. 4 5.C Request for Relief 9534 NE 2nd Avenue 9534 NE 2 Avenue.pdf Ms. Gladys Coia recused herself from this case. Mr. Leoni gave a brief explanation of the violation and why the Board should accept his offer. The Board asked questions. Motion to accept $500.00 payable in 30 days made by Mr. Buenconsejo, seconded by Mr. Vickers and the Motion was approved 4-2 with Ms. Darci Cohen and Mr. Perl voting against it. 5.D Request for Relief 10151 NE 14 Avenue 10151 NE 14 Avenue.pdf Ms. Perez gave a brief explanation as to why the Board should accept her offer. The Board asked questions. The Board is to refer those calls to the Village Attorney, Richard Sarafan. 8) ADJOURNMENT The meeting adjourned at 7:30 PM
