nsation Insurance Exemption
Florida Law requires Workers' Compensation insurance coverage under Chapter 440 of the Florida Statutes. lila. Stat. § 440.05
allows corporate officers in the construction industry to exempt themselves from this requirement for any construction project prior to
obtaining a building permit. Pursuant to the Florida Division of Workers' Compensation Employer Facts Brochure:
An employer in the construction industry who employs one or more part-time or full-time
employees, including the owner, must obtain workers" compensation coverage. Corporate officers
or members of a limited liability company (LLC) in the construction industry may elect to be
exempt if:
1. The officer owns at least 10 percent of the stock of the corporation, or in the case of
an LLC, a statement attesting to the minimum 10 percent ownership;
2. The officer is listed as an officer of the corporation in the records of the Florida
Department of. State, Division of Corporations; and
3. The corporation is registered and listed as active with the Florida Department of
State, Division of Corporations.
No more than three corporate officers per corporation or limited liability company members are
allowed to be exempt. Construction exemptions are valid for a period of two years or until a
voluntary revocation is filed or the exemption is revoked by the Division.
Your contractor is requesting a permit under this workers" compensation exemption and has acknowledge that he or she will not use
day labor, part-time employ r subcontractors for your project. The contractor has provided an affidavit stating that he or site will
be the only person allowed t + rk on your project. In these circumstances, Miami Shores Village does not require verification of
workers' compensationinsur coverage from the contractor's company for day labor, part-time employees or subcontractors.

3. CONNECTION METHODS: Fencing panels (Pickets & Rails) may be either mechanically (screw)
connected using #12 1-1/4" Tek screws or tack welded. Gate frames shall be fully welded by a
certified welder in the shop using 5183 or 4043 filler metal with 1/4" weld all around.
4. GATES: Gate leaf (single or double) widths can be installed up to the allowable size as shown in Gate
Details. Should a double leaf gate be installed then the Latch and Drop Bolt shall be installed (per the
local requirements).
5. SOIL: All soil around footings shall be 98% optimum density (2,500 psf minimum capacity).
6. OPENINGS & ENDS: All openings shall be able to reject a 4" sphere. All exposed visible ends shall be
provided with caps or covers.
7. THREE RAIL STYLE: May allow for opening between top and intermediate horizontal rail or be filled
with pickets and optional decorative rings or scrolls without affecting engineering design.
GENERAL NOTES (Installation):
1. POST CONNECTIONS:
a. POST @ CONCRETE DECK PLATE / SHOE: Pre -manufactured Aluminum post shoe or
4"W0/16" aluminum plate anchored with (4) 1/4"0 x 3-1/2" tapcons (minimum 3" embed). Attach
shoe to post using (2) #14 x 3/4" SMS.
b. POST @ CONCRETE DECK CORE DRILL: Core concrete deck 3"0 x 3-1/2" and install post with
high strength epoxy grout (10,000 psi minimum).

2. POOL FENCING ENCLOSURES:
2.1. All gates shall open outward and shall be 48" high and have no opening more than 1/2" within

5. SOIL: All soil around footings shall be 98% optimum density (2,500 psf minimum capacity).
6. OPENINGS & ENDS: All openings shall be able to reject a 4" sphere. All exposed visible ends shall be
provided with caps or covers.
7. THREE RAIL STYLE: May allow for opening between top and intermediate horizontal rail or be filled
with pickets and optional decorative rings or scrolls without affecting engineering design.
GENERAL NOTES (Installation):
1. POST CONNECTIONS:
a. POST @ CONCRETE DECK PLATE / SHOE: Pre -manufactured Aluminum post shoe or
4"W0/16" aluminum plate anchored with (4) 1/4"0 x 3-1/2" tapcons (minimum 3" embed). Attach
shoe to post using (2) #14 x 3/4" SMS.
b. POST @ CONCRETE DECK CORE DRILL: Core concrete deck 3"0 x 3-1/2" and install post with
high strength epoxy grout (10,000 psi minimum).
c. POST @ GRADE: Anchored in 10" x 24" (2,500 psi) concrete.
2. WALL CLIP CONNECTION: (Pre -Manufactured or 2"x2"x1/8" aluminum bent plate) Aluminum to
concrete connections shall be 1/4"0 x 2-1/4" tapcons (min. 1-3/4" embed). Aluminum to aluminum
connections shall be made using (2) #8 x 1" Tek screws per receiver.
3. RAIL / POST CONNECTION: (1) # 8 x 1" Tek screws or fully welded.
4. RAIL / PICKET CONNECTION: (1) # 8 x 1" Tek screw or fully welded.
5. PLEXIGLASS PANEL / FRAME, POST, PICKET: Affix at centerline of latch to Post, Frame & Pickets
#12 Tek @ 8"o.c.
GENERAL NOTES (Materials):
1. All aluminum extrusions shall be made of alloy 6063-T6 Alloy (35,000 psi yield) unless noted
otherwise. All fence panels and gates shall be powder coated or factory finished for corrosion
resistance. Aluminum shall NOT be in direct contact with concrete.
2. POOL FENCING ENCLOSURES:
2.1. All gates shall open outward and shall be 48" high and have no opening more than 1/2" within
18" of the latch.
2.2. All hardware used shall be automatically, self-closing and self -latching. Magna Latch and Lokk
bolt shall be used in a pool fencing application with latch location 54" AFF minimum. See
