2020-01-21 MINUTES1 Mayor Crystal Wagar Vice Mayor Alice Burch Vice Mayor Sean Brady Councilman Stephen Loffredo Councilman Jonathan Meltz Tom Benton, Village Manager Richard Sarafan, Village Attorney Ysabely Rodriguez, Village Clerk MEETING MINUTES JANUARY 21, 2020 6:30 PM COUNCIL CHAMBERS 1) CALL TO ORDER Vice Mayor Burch called the meeting to order at 6:32 PM. 2) MOMENT OF SILENCE / PLEDGE OF ALLEGIANCE Vice Mayor Burch called to mind the recent passing of Honorable William “Al” Davis and individual Councilmembers extended their respective condolences and comments regarding his legacy and call to service. 3) ROLL CALL PRESENT: (4) Sean Brady, Councilman Stephen Loffredo, Councilman Jonathan Meltz, Councilman Alice Burch, Vice Mayor Crystal Wagar, Mayor, was absent. ALSO PRESENT: Tom Benton, Village Manager Ysabely Rodriguez, Village Clerk Richard Sarafan, Village Attorney 4) PUBLIC COMMENTS Patrice Gillespie Smith, President of the Greater Miami Shores Chamber of the Commerce, spoke about the Mayor Wagar’s receptivity with respect to the Village working more closely with the Chamber. She further highlighted various upcoming events, such as the Home Expo and the Meet & Greet with Barry University's New President, Mike Allen. Dorothy Campbell supported Item 6A, regulating single-use plastic bottled water on Village-owned properties and facilities. 2 Tuyen Tieu spoke in support of Item 6A and asked the Village Council to consider upgrading Village water fountains. Mary Benton spoke in support of Items 6A and 7A. Adriana Ramirez Clark spoke in support of Item 6A and advocated for new water fountains throughout the Village. Lina, representative of the Miami Surfrider Foundation, spoke in support of Item 6A and educated the public on the effects of plastic pollution. Catherine Uden, Oceania Southeast Campaign Organizer, spoke in support of Item 6A and educated the public on the adverse effects of plastic pollution. Susan Howell spoke in support of Item 6A and emphasized the importance of educational outreach. 5) APPROVAL OF THE MINUTES 5.A JANUARY 21, 2020 VILLAGE COUNCIL MEETING MINUTES Councilman Brady moved the approval of the January 21, 2020 Village Council Meeting Minutes and Councilman Meltz seconded the motion, which carried a 4-0 voice vote. 6) ORDINANCE(S) ON FIRST READING 6.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, RELATING TO REGULATION OF SINGLE-USE PLASTIC BOTTLED WATER, PROVIDING DEFINITIONS; PROVIDING FOR THE PROHIBITION OF SINGLE-USE PLASTIC BOTTLED WATER IN ANY VILLAGE FACILITY OR ON VILLAGE PROPERTY AND EXCEPTIONS; ESTABLISHING PENALTIES FOR VIOLATIONS; PROVIDING FOR ENFORCEMENT; ESTABLISHING RIGHTS OF VIOLATORS, PAYMENT OF FINES, RIGHT TO AN APPEAL, FAILURE TO PAY CIVIL FINE OR APPEAL; PROVIDING FOR RECOVERY OF UNPAID FINES, ESTABLISHING UNPAID FINES TO CONSTITUTE A LIEN, PROVIDING FOR FORECLOSURE, PROVIDING FOR INJUNCTIVE RELIEF; PROVIDING THAT ENFORCEMENT IS CUMULTIVE; PROVIDING FOR SEVERABILITY, PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE (SPONSORED BY: JONATHAN MELTZ). Ms. Rodriguez read the title of the ordinance into the record. Councilman Meltz introduced the item and delivered a brief presentation on the proposed ordinance, thereby advocating for the regulation of single-use plastic bottled water, more refillable water stations, the implementation of water refill programs, and the sale of aluminum water bottles at Village facilities and Village-owned properties. Village Attorney Richard Sarafan clarified the next step, should the Village Council adopt the ordinance, is to launch a public education campaign on the adoption of the ordinance and the violation protocol. Responding to Councilman Loffredo’s inquiry, Mr. Benton clarified the proposed ordinance applies to patrons who rent Village facilities and such language will be incorporated in the rental agreement. Mr. Sarafan clarified the proposed ordinance is limited to Village properties, Village Contracts, and Village-sponsored events. 3 Vice Mayor Burch proposed a friendly amendment to the ordinance to reflect a 180-day implementation period in lieu of 90 days. Responding to Vice Mayor Burch's friendly amendment, Mr. Meltz agreed to a 120-day implementation period, as he felt additional time would defeat the intent of the ordinance. Individual Councilmembers expressed support for the 120-day implementation period. Responding to Vice Mayor Burch’s inquiry, Mr. Sarafan clarified Doctors Charter School, a village- owned property, would be impacted by the proposed ordinance. Mr. Benton stated he will look into the costs associated with retrofitting existing water fountains. Councilman Loffredo moved to approve the ordinance on first reading as amended and Councilman Brady seconded the motion, which carried a 4-0 voice vote. 7) ORDINANCE(S) ON SECOND READING- PUBLIC HEARING 7.A AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, ESTABLISHING A SUSTAINABILITY AND RESILIENCY COMMITTEE; DESCRIBING ITS COMPOSITION, AND STATING GOALS, DUTIES, AND FUNCTIONS AND SETTING AN EFFECTIVE DATE (SPONSORED BY: MAYOR CRYSTAL WAGAR). Ms. Rodriguez read the title of the ordinance into the record. Vice Mayor Burch opened the public hearing. There being no one present wishing to speak on the item, Vice Mayor Burch closed the public hearing. Councilman Brady moved to adopt the ordinance and Councilman Loffredo seconded the motion, which carried a 4-0 voice vote. Responding to Vice Mayor Burch’s inquiry, Ms. Rodriguez clarified the vacancies will be posted on the Village website and social media upon conferring with the Communications Specialist and the Public Works Director. 8) ANNOUNCEMENTS 8.A JANUARY 2020 ANNOUNCEMENTS The Village Clerk read the announcements. 9) VILLAGE COUNCIL COMMENTS Councilman Loffredo Councilman Loffredo thanked Recreation Staff and the Chamber of Commerce for hosting Game Night and commented on the Jewish Festival. Councilman Brady Councilman Brady thanked the public for attending the meeting and informed them of the new water fountains at Bayfront Park. Councilman Meltz No Comments. 4 Vice Mayor Burch Vice Mayor Burch provided an update for the Shores Estates Subdivision residents regarding FEMA grant funding. She further commented on the 2021 Smart Moves- Miami Shores Flagler Trail Application. She also thanked Councilman Meltz for the progression of the proposed ordinance regarding plastic bottled water. 10) ADJOURNMENT There being no further business before the Village Council, the meeting adjourned at 6:57 PM.
