Article 1. SCOPE OF WORK
Article 1.1. Subcontractor has heretofore entered into a contract with said Contractor to furnish all labor,
materials and equipment to perform all work described below according to the construction
documents.
General - Contractor shall review construction documents and provide labor and materials
pertaining to the mechanical systems as required in said documents and as specified herein,
while complying with all applicable building codes.
15100 - Plumbing - Plumbing shall be a fully operational system of hot and cold water. Provide
and install all piping, soil, vents, drains, sewage removal and water supply systems to connect
with appropriate water and sewage systems. Provide and install appropriate insulation around
piping. All permits and inspections are to be obtained by contractor as required by local building
codes and the Uniform Plumbing Code.
Sewer and Waste Piping - Drainage system shall be Schedule 40 PVC pipe, or cast iron. All
connections shall have PVC cement or appropriate joint compound and assembled tight for no
leakage. Condensate drains shall be be constructed of Schedule 40 PVC. Valves shall be 125
PSI NIBCO SCOTT, STOCKMAN OR EQUAL. Connection to public sewer system shall comply
with all local requirements. Caulk joints or provide neoprene gaskets for all sewer lines. Pitch
shall be a minimum 1/8" per foot for soil lines larger than 3" diameter and a minimum of 1/4" per
foot for soil lines 3" diameter or less. Insulate all interior drain/waste piping with batt insulation for
sound attenuation.
Water Pipes - From public water line, install Type "L" or "K" " (minimum) copper pipes, located
below frost line. From the meter to the building, install " supply water lines. Use 1/2",3/4"
minimum lines from supply lines to each plumbing fixture as required. At water heaters and hose
bibs install a minimum 3/4" pipe. From water heater install 3/4"-1" pipe to each room with
branches to fixtures as described above. Fittings shall be wrought copper, soldered with 95-5
adjustable brass P-traps with wall escutcheons at all exposed locations.
Provide shut-off valves at sinks, toilets, water heater and other fixtures as required. Test all pipes
under 100 Ibs pressure per building code requirements.

Waste Drainage - Install sewage clean -out at the end of each horizontal drainage run and every
100 feet per building code requirements. Vents shall be installed throughout plumbing
connections and connected with the vertical stacks and vented through the roof. Check with local
building code officials for specific venting requirements.
Water Heater - Install one 80 gallon electric water heater per construction documents. Water
heater shall have appropriate safety valves, back flow preventers, pressure relief valves and drain
assemblies. Follow manufacturer recommendations and building code requirements for
installation and use.
Optional Plumbing - If required install necessary plumbing requirements for Septic tank
,disposal system, and solar water system.
15410 - Plumbing Fixtures - Provide necessary piping, water and drains for plumbing fixtures as
shown on the construction documents. Plumbing fixtures to be provided by owner.
Article 2. PAYMENT TERMS
Article 2.1. The Contractor agrees to pay the Subcontractor within 15 days after submittal of pay application
and the completion of the work and payment by the owner for such work.
Article 2.2. Subcontractor understands and agrees that progress payment requests shall be written and given
to the contractor/job superintendent before Monday for payment on the following Friday. All
work for the portion requested must be completed prior to the request for payment. The
Contractor will request a draw and payment will be made to the Subcontractor after the
draw is received. A release of lien from all sub -subcontractors or suppliers must be obtained
prior to payment being issued. Please note that a certificate of Workman's Compensation
Insurance must be received before the first payment is made or the contractor will hold a
percentage needed to cover the labor portion of the job.
Article 2.3. The Total Contract Amount shall be $5,200.00 ( FIVE THOUSAND TWO HUNDRED DOLLARS)
Article 3. TIME OF COMPLETION
Article 3.1. Subcontractor shall keep both an adequate size and properly trained crew on the job site so as to
complete the project work within the project schedule.

Article 4. CHANGE ORDERS
Article 4.1. Subcontractor understands and agrees that no change orders or contract additions will be made
unless agreed to in writing by Contractor. If any additional work is performed and not covered in
this contract, the Subcontractor proceeds at his own risk and expense. No alterations, additions,
or small changes can be made in the work or method of the performance, without the written
change order signed by the Contractor and Subcontractor.
Article 5. CLEAN-UP
Article 5.1. Subcontractor will be responsible for cleaning up the job on a daily basis, including all generated
construction debris, drink cans, food wrappers, and/or other trash. If it becomes necessary, the
Subcontractor will be back charged for appropriate clean up by deducting clean up costs from
payments.
Article 6. TAXES AND PERMITS
Article 6.1. The Subcontractor understands and agrees that he shall be responsible for all taxes, fees and
expenses imposed directly or indirectly for its work, labor, material and services required to fulfill
this contract. The Subcontractor is responsible for all permits pertaining to the law, ordinances
and regulations where the work is performed.
Article 7. INSURANCE AND INDEMNITY
See Exhibit A — Insurance Sample Certificate
Must Keep insurance thru all project phase or insurance cost will be deducted from last payment.
Article 8. LIQUIDATED DAMAGES
Article 8.1. If the project is not substantially completed on the stated completion date, the Subcontractor shall
pay to the Contractor the sum of ($ 180 per day) for each calendar day of inexcusable delay until
the work is substantially completed, as liquidated damages.
Article 9. WARRANTY
Article 9.1. Subcontractor shall warranty all labor, materials and equipment furnished on the project for 1
year against defects in workmanship or materials utilized. The manufacturers warranty will
prevail. No legal action of any kind relating to the project, project performance or this contract
shall be initiated by either party against the other party after 2 year beyond the completion of the
project or cessation of work.

Article 10. HAZARDOUS MATERIALS, WASTE AND ASBESTOS
Article 10.1. Both parties agree that dealing with hazardous materials, waste or asbestos requires specialized
training, processes, precautions and licenses. Therefore, unless the scope of this agreement
includes the specific handling, disturbance, removal or transportation of hazardous materials,
waste or asbestos, upon discovery of such hazardous materials the Subcontractor shall notify the
Contractor immediately and allow the Contractor to contract with a properly licensed and qualified
hazardous material contractor.
Article 11. ARBITRATION OF DISPUTES
Article 11.1. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be
settled by arbitration administered by the American Arbitration Association under its Construction
Industry Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be
entered in any court having jurisdiction thereof.
Article 12. ATTORNEY FEES
Article 12.1. In the event of any arbitration or litigation relating to the project, project performance or this
contract, the prevailing party shall be entitled to reasonable attorney fees, costs and expenses.
