TERMS AND CONDITIONS: You are entitled to and exacted copy of the contract you signed. Unless otherwise specified above, all installation of
replacement and new A/C systems will be installed, hooking up to existing electrical wiring and breakers, refrigerant lines, drain lines, slabs, roof
stands and support brackets, air handler platform boxes, condensate pumps, smoke detector, fire dampers, thermostats, humidistat, duct work,
supply and return air grills. Due to your existing building constructions and South Florida's high humility and heat wave weather conditions, seller
can't guarantee any particular cooling temperature. It is recommended to set your thermostat at 78 degrees for maximum savings on electrical
usage. Temperature set below 78 degrees could result in your air conditioning system to run for extended length of time.
If it becomes necessary to take collection actions for any charges, THE CUSTOMER, shall be responsible for all court cost, collection cost, and
reasonable attorney?s fees incurred to collect any unpaid charges.

AAA MODERN AIR, INC EQUIPMENT SALE
ADDITIONAL TERMS AND CONDITIONS
1. Binding Effect. AAA Modem Air agrees to sell and Purchaser agrees to purchase the equipment from AAA Modem Air at the price set forth on the face hereof and subject
to the terms and conditions of this Contract. The Equipment delivered to the Purchaser remains the property of AAA Modem Air until the purchase price is paid in full.
2. Payment. The purchase price of the Equipment is payable upon execution of this Contract. Purchaser shall pay interest at the highest statutory rate permitted by law, from the
date due, on any payment which is delinquent by thirty (30) days or more. All credit arrangements between AAA Modem Air and Purchaser shall be in writing and payments
shall be due in accordance with same. Any amount due which is not timely paid shall incur a late charge/interest at the highest statutory interest permitted by law.
3. Equipment Warranties. The Equipment installed by AAA Modem Air shall be guaranteed solely by the manufacturer for a period of one (1) year from date of the installation
unless otherwise specified. AAA Modem Air does not warranty the equipment. The following items and their associated costs are not included in the manufacturer's
warranty on the equipment: (a) coil cleaning; (b) drain flushing; (c) air filter cleaning; and (d) existing electric breakers, fuses and wires; (e) refrigerant, [Freon R 22 or
"Puron" R-410a].
4. Services Warranties. AAA Modem Air shall service the equipment for a period of one (1) year from the date of installation of the Equipment without cost to Purchaser (as
long as performed during normal business hours — Monday through Friday from 8:00am to 5:00pm EST). Under this service warranty, AAA Modem Air, after evaluation,
shall have the discretion to repair the equipment or provide replacement parts. AAA Modem Air warranty service does not include maintenance such as filter or fuse
replacement. AAA Modem Air warranties clogged drain lines for thirty (30) days. AAA Modem Air has weekend emergency service available: Saturday from 12:00 PM to
6:00 PM and Sunday from 9:00 AM to 6:00 PM. Additional cost may be required for weekend emergency service.
Purchaser is responsible to monitor drain lines after installation, to make sure that there are no water leaks coming from the air conditioning unit. AAA Modern Air is
not responsible for and does not warrant against damage from water intrusion and/or condensation to Purchaser's walls, floors, ceilings, carpeting or any building
materials work that might occur during the installation and/or use of the Equipment or and for any mold growth from water leaks from drain pan overflow and roof
leaks from mounted equipment. Further, AAA Modern Air is neither responsible for dust accumulation that may occur during the installation and/or use of the
Equipment and/or Duct system nor odors that might be expelled by the Equipment and/or duct system during its use. AAA Modern Air is not responsible for any
condensation or sweating problems that might occur to purchaser's existing ductwork and grills and any mold, mildew, or mold spores due to the sweating and
condensation of purchaser's existing duct system.
5. Power of Attorney. Purchaser agrees to grant AAA Modem Air a limited power of attorney to act as his/her agent for the sole purpose of securing all necessary paperwork to
obtain a permit to install the Equipment.
6. Force Majeure. If AAA Modem Air is delayed or prevented from performing any obligation hereunder due to causes or events beyond its control, including, without
limitation, any act of God, fire, riot, embargo, strike, legal action, accidents, transportation delays, present or future law or governmental order of regulation, such delay or
non-performance shall be excused during the pendency of such condition and the time for performance extended or rescheduled by AAA Modern Air.
7. Default. Purchaser shall be in default under this Contract upon the failure of Purchaser to observe or perform any of the Purchaser's agreement contained herein. In the event
of default by Purchaser, AAA Modern Air shall be entitled to collect from Purchaser all costs, fees and expenses incurred to enforce its rights hereunder, including, without
limitation, court costs, costs of arbitration, attorney's fees and costs and fees paid to other professionals or agencies.
8. Remedies. In the event Purchaser fails to pay any amount due and owing hereunder and /or fails to perform any obligation hereunder, AAA Modem Air shall have the right
to exercise one or more of the following remedies: (a) recover the balance of all amounts due hereunder including interest on all unpaid sums; (b) enter the premises where
the Equipment might be located and take possession of the Equipment and retain all prior payments as partial compensation for its use and depreciation; (c) incur collection
and legal expenses (including attorney's fees and costs) in exercising any of its rights and remedies upon default and/or (d) pursue any other remedy permitted by law.
9. Assignment. This Contract is freely assignable by AAA Modern Air. Purchaser may assign this Contract only with the written consent and percussion of AAA Modem Air .
and all obligations of Purchaser under this Contract shall bind its successors and assigns.
10. Other Services. This Contract does not cover maintenance service outside the warranty period provided for in Paragraph 4 above. Purchaser may elect to purchase
maintenance service with respect to the Equipment purchased from AAA Modern Air by entering into a separate maintenance Contract with AAA Modem Air.
11. Limitation of Liability. AAA Modem Air's liability for damages to Purchaser relating to or arising out of the performance or non-performance of the Equipment, or for any
cause whatsoever, and regardless of the form of the action, whether in contract or in tort including negligence, shall be limited to the total sale price stated herein for the
specific equipment that caused the damage or is the subject matter of or is directly related to the cause of the action. The forgoing limitation -of liability will not apply to
claims for personal injury cased solely by AAA Modem Air's negligence. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AAA MODERN AIR SHALL NOT BE
LIABLE TO PURCHASER OR ANY PERSON CLAIMING THROUGH OR AGAINST PURCHASER FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL
DAMAGES (INCLUDING LOST PROFITS, REVENUES, BUSINESS OPPORTUNITIES OR INTERRUPTION OF BUSINESS) RESULTING FROM OR ARISING
OUT OF THE DELIVERY, INSTALLATION, OPERATION, PERFORMANCE OR USE OF THE EQUIPMENT (OR NON-PERFORMANCE, DELAY IN OR
FAILURE OF THE SAME), EVEN IF PURCHASER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification. Purchaser shall indemnify and hold AAA Modem Air (including its subsidiaries and related companies and its and their officers, directors, employees,
agents, and consultants) harmless from and against any and all losses, expenses and damages arising out of or incident to willful or negligent acts or omissions ofPurchaser.
13. Severability. This Contract is intended to be performed in accordance with and only to the extent permitted by all applicable laws, ordinances, rules, and regulations of the
jurisdiction in which the parties do business. If any provision of this Contract or the application thereof to any person or circumstance shall, for any reason or to any extent,
be invalid or unenforceable, the remainder of the Contract and the application of such provision to other persons or circumstances shall not be affected thereby, but rather
shall be enforced to the greatest extent permitted by law.
14. No Payment Waiver. The acceptance of any payments after the specified due date thereof shall not constitute a waiver of purchaser's obligation to make future payments.
AAA Modem Air may apply any amounts paid by Purchaser -pursuant to this Contract to any indebtedness owing by Purchaser to AAA Modem Air on account.
15. Entire Contract of Parties. This Contract contains the entire understanding of the parties with respect to the subject matter hereof, superseding all negotiations, prior
discussion and preliminary contracts or proposals made prior to the date hereof. Any modifications, change or amendment of this Contract shall be in writing and -shall be
signed by an authorized representative of each party.
16. Headings. The article and section headings contained in this Contract are inserted for convenience only and shall not affect in any way the meaning or interpretation of the
contract.
17. Notices, All notices expect routine service and warranty requests under this Contract shall be in writing and shall be deemed to have been duly given and received on the
business day when personally delivered or transmitted successfully via facsimile to the intended recipient at the address or facsimile in this Contract.
18. Governing Law. This Contract shall be construed in accordance with the laws of the State of Florida and any proceeding arising between the parties in any manner pertaining
or related to this Contract shall, to the extent permitted by law, be held in Broward County, Florida.
19. The Purchaser shall be responsible for any change in such equipment, not caused by the seller's negligence, during period of installation and before payment in full.
20. The Purchaser agrees that the seller shall have the rights to file a mechanics lien for work and labor done and material fumished, and the contract shall not affect that right.
21. Upon default in payment as herein provided, the Seller may enter into premises unmolested and removed said equipment (which the parties agree shall remain personal
property notwithstanding that the equipment may be attached, set or affixed to real estate or improvement thereon) at the expense of the defaulting Purchaser. It is agreed that
damage to the real estate as is the necessary result of such removal shall be home by the Purchaser exclusively.
22. Permits. Purchaser agrees to provide a property survey if required by the building department in order to obtain a building permit. Purchaser agrees to coordinate with AAA

23. Filters. Filters included in the contract will not be ordered unless contract is paid in full. Filter orders can take up to two weeks to process. Filters will be delivered to
