Notice to Owner — Workers' Compensation Insurance Exemption
Florida Law requires Workers' Compensation insurance coverage under Chapter 440 of the Florida Statutes. Fla. Stat. § 440.05
allows corporate officers in the construction industry to exempt themselves from this requirement for any construction project prior to
obtaining a building permit. Pursuant to the Florida Division of Workers' Compensation Employer Facts Brochure:
An employer in the construction industry who employs one or more part-time or full-time
employees, including the owner, must obtain workers' compensation coverage. Corporate officers
or members of a limited liability company (LLC) in the construction industry may elect to be
exempt if:
1. The officer owns at least 10 percent of the stock of the corporation, or in the case of
an LLC, a statement attesting to the minimum 10 percent ownership;
2. The officer is listed as an officer of the corporation in the records of the Florida
Department of State, Division of Corporations; and
3. The corporation is registered and listed as active with the Florida Department of
State, Division of Corporations.
No more than three corporate officers per corporation or limited liability company members are
allowed to be exempt. Construction exemptions are valid for a period of two years or until a
voluntary revocation is filed or the exemption is revoked by the Division.
Your contractor is requesting a permit under this workers' compensation exemption and has acknowledge that he or she will not use
day labor, part-time employees or subcontractors for your project. The contractor has provided an affidavit stating that he or she will
be the only person allowed to work on your project. In these circumstances, Miami Shores Village does not require verification of
workers' compensation insurance coverage from the contractor's company for day labor, part-time employees or subcontractors.

single woman who currently resides at; 77 NE 106th Street, Miami Shores, in the County of
Dade, State of Florida, is hereby called the "senior" or "trustee",
Reference in this trust to the "trustee" shall be deemed a reference to whomever is serving
as trustee, be it a co -trustee, an alternate or successor.
Reference to any assets of the trust represents the principal or corpus of the trust and any
earnings derived therefrom,

C. Life Insurance
a) Trustee named as beneficiary,
The trustee may be named as beneficiary of death benefit proceeds of life insurance
policies on the life of either the primary beneficiary of this trust agreement or any other
individual chosen by the trustee at the trustee's sole discretion, Such death benefit proceeds shall
be subject to all the terms and conditions hereof,
IV. PRIMARY BENEFICIARY
The primary beneficiary of this trust shall be SHEILA CLAIRE MCDONALD;
V. ORIGINAL AND SUCCESSOR TRUSTEES
A. Original Trustee
The original trustees shall be co -trustees, herein naming SHEILA CLAIRE MCDONALD
and RICHARD M. FERNANDEZ, ESQ., 11077 Biscayne Boulevard, Fourth Floor, Miami,
Florida, 33161 Tele; 305.893.7040, As co•intstees, each is fully empowered to act without the
approval of the other, Should RICHARD M, FERNANDEZ, ESQ., be required to act as trustee
then he shall be compensated et the rate of $150,00 per month, plus, for lime applied in excess of
an hour during any given month, an hourly ram of $150 per hour, plus costs, for any services as
an attorney or as necessary to manage and maintain this trust, or, caring for the needs of the
primary beneficiary and may hire the services of any other professionals as may be required in
the reasonable judgment of the trustee to maintain and defend the trust; and tradesmen to
maintain properties of the trust; ee, and physicians and caretakers as may be required for the care
and maintenance of the primary beneficiary,
B, Successor Trustee
In the event of the death, resignation, incapacity, incompetence, or, serious illness of either
co -trustee, the SETTLOR hereby appoints the surviving co -trustee without the approval of any
court, or, the concurrence of any other parry to continue as the successor and sole trustee , subject
to the other terns of this must not In conflict herewith.
In the event that none of the above persons or entities desire to continue as trustee, or, are
unable to continue as trustee for any reason, the final resigning or last to survive trustee shall
have the authority to name and appoint a successor trustee in their place and stay and may do so
by testamentary appointment.
However, it is the absolute direction of the Settlor that no relative of the Senior be
appointed trustee of the SHEILA MCDONALD REVOCABLE LIVING TRUST, at any time,

B, To sell at public or private sale, to mortgage, pledge, or hypothecate, or, to exchange or
lease (including lease for a period extending beyond the terms of this trust) any stocks, notes,
securities, real estate, minerals, and other trust property upon such terms, cash or credit, or both,
as the trustee may deem advisable, the power herein includes the conveyance of homestead
property,
C, To invest and reinvest the trust estate without limitation, to trust investments,
investments of any kind, real or personal, including without limitation♦ stocks, bonds, notes,
mortgages, land, minerals, royalties, Leaseholds, and participation in partnerships, joint ventures
and other business enterprises,
D, To construct, repair, or demolish any improvements upon any real property held by the
trust,
E, To participate in any reorganization, consolidation, merger, or dissolution of any
corporation, the stocks, bonds, or securities of which may be held at any time as part of the trust
estate.
F, To hold investments or any part of the trust estate in common or undivided interest with
other persons,
G, To demand, receive, provide receipt for, and collect any and all rights, money,
properties, or claims to which this trust may be entitled, and to compromise, settle, or abandon
any claim in favor of or against this trust,
H. To borrow funds for this trust in such amounts and for such purposes as the trustee may
deem proper and to purchase property on credit of this trust and in connection therewith, or in
connection with such borrowing, to execute and deliver promissory notes or other evidence of
indebtedness of this trust, and to mortgage or pledge all or any part of the trust to secure payment
of such indebtedness and to repay such indebtedness out of the trust estate.
I. To employ agents, legal counsel, accountants, brokers and assistants and to pay their fees
and expenses.
J, To vote in person or by proxy on shares of stock which may be a part of the trust estate,
K. To lend money to any person or persons upon such terms, but with adequate interest and
security, as the trustee may deem advisable for the best interest of the trust and the beneficiary.
L, Without limiting the generality of the foregoing or any other provision herein, to
manage, control, operate, invest, reinvest, sell, exchange, lease, mortgage, encumber, and/or deal
with the property of this trust for an on behalf of the trust and the beneficiary thereof to the same
extent and with the same powers that any individual would have in respect to his or her own
property and funds,

This trust has been established and accepted by the trustee and is to,be administered in the

F. Counterparts
This trust agreement may be executed in any number of counterparts, and each shall

As used in this trust agreement, the masculine and feminine and the neuter gender, plural
and singular number shall each be deemed to include the other when the context so indicates.
