R-2019-011 RESOLUTION NO. 2019 -01 2 3 4 A RESOLUTION OF MIAMI SHORES VILLAGE COUNCIL DIRECTING STAFF TO 5 ACCEPT THE "MINIMUM PERMIT FEE" OF $100 PURSUANT TO SECTION 6- 6 7(2) IN LIEU OF "EXPIRED PERMIT FEE" PROVIDED FOR UNDER SECTION 6- 7 7(3) OF THE MIAMI SHORES VILLAGE CODE IN CONNECTION WITH THE 8 CURRENTLY PENDING APPLICATION FOR PERMIT RENEWAL REGARDING 9 THE PROPERTY LOCATED AT 87 NE 92 STREET, MIAMI SHORES, FLORIDA 10 AS A CONSEQUENCE OF CERTAIN UNUSUAL AND EXTRODINARY 11 CIRCUMSTANCES. 12 13 WHEREAS, as a result of certain unusual and extraordinary circumstances, Miami Shores 14 Village permit number RC -4 -15 -920, for work at the property located at 87 NE 92 Street, Miami 15 Shores, Florida, was inadvertently allowed to expire prior to the completion of all work referenced 16 therein; 17 18 WHEREAS, under Village Code Section 6- 7(3)(b), renewal of the expired permit would 19 require the property owner to pay an additional amount of permit fees totaling approximately 20 $8,000; and 21 22 WHEREAS, in light of the unusual and extraordinary circumstances and the amount of the 23 fee otherwise applicable to renewing the expired permit, the Village Council has determined that 24 imposition of such a fee would impose an unreasonable and excessive burden upon the property 25 owner; 26 27 NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MIAMI 28 SHORES, FLORIDA, THAT: 29 30 Section 1. The Village Manager is hereby directed and instructed to accept the minimum 31 permit fee of $100 provided for in Section 6 -7 of the Village Code as the total fee required for 32 renewal of the above described expired permit and to waive, for one time only, the requirement for 33 payment of sums above that amount for renewal of such permit.
