Re: Service Contract Made as of the First Day of December, 2012
By and Between Miami Shores Village and AshBritt, Inc. as
Extended and Amended
Dear Mr. Noble:
I write you in my capacity as Village Attorney for Miami Shores Village. As you are
aware, under the above referenced Contract, the Village relied upon AshBritt, Inc., to promptly
provide the contracted for services as and when needed in connection with emergency events
such as the recent Hurricane hTna. As you are also aware, the scope of services in the Contract
provides, and the Village has repeatedly requested, that AshBritt provide the manpower and
equipment to collect all debris and transport same, but AshBritt, Inc. has failed and refused to
provide any of these desperately needed services and is thus in breach of the Contract. AshBritt's
representative has admitted this breach. Accordingly the Village has been forced to make
alternative arrangements to obtain the services, on an emergency basis.
Please be advised that, as a result of this breach of Contract, the Village has elected to
terminate the Contract for cause and reserves all rights against AshBritt, Inc.
Please do not hesitate to contact me if you have any questions.
Very truly yours,
Richard Sarafan
