Remodeling & Construction Contract
THIS AGREEMENT made on July 15th, 2015 by and between Mr. Mr. Gabriel
Kuskunov as a owner and Galloway Contractors & Builders, Inc as a
contractor.
All work shall be completed in a workman -like manner and in compliance with all
Florida building codes and other applicable laws.
Article 1. Scope of the Work
Contractor shall furnish all labor and materials to perform all Demolition,
interior and exterior structural work, pool and exterior impact windows and
doors specified on the remodeling work shown on the approved set of plans,
and contract estimated.
Please refer to construction estimated for details.
Article 2. Time of Completion
The work to be performed under this Contract shall be commenced on or before
Sep 20th, 2015 and shall be substantially completed on/or before Dec 15th,
2015.
Time is of the essence. The following constitutes substantial commencement
of work pursuant to this proposal and contract:
A. Interior demolition.
B. Structural Construction of proposed lay our as per plan and specifications.
C. Residence Pool as per plans.
Job that will be done by others choose by owner:
A. Framing, plaster and drywall.
B. Interior residence Electrical, Mechanical & Plumber.
C. Interior Finishing
D. Impact windows & doors Installation.
E. Interior & exterior Finishing
Under this construction contract, Contractor will provide the space built out as
propose in plans. All electrical, plumbing, and Mechanical should be perfectly
build as per drawings specifications and approved by Florida Building code. We
are including tabor to install the fixtures described on the plan. Any new
additional fixtures will be quoted accordingly.

Article 3. Payments
A. A lump sum of - for materials and labor to perform construction. Job is to
be performed under the Florida Building code and should be ready to
comply and approved all inspections required by city officials.
B. Job progress is Subject to additions and deductions pursuant to authorized
change orders and will be add to the PPR (Progress payment report).
C. Payment of the contract should be paid Follow the PPR (Progress Payment
report) signed by owner.
D. PPR will be altered only if change orders are processed. Additions and/or
alterations to the original estimate, new purchased orders, and/or credits
will be show accordingly.
E. Contractor will charge 15°lo as a Building Overhead and/or Company fee for
processing and management over all items or trades that get to be
purchased and chosen through our company. This FEE applies to
Supervision of any items purchased by the owner and installed by other
companies that need Contractor supervision requested by owner.
F. Contractor is -not responsible for any delays caused by others hired by the
owner. Please remember that final building inspection depends on all items
working perfectly. Kitchen, kitchen appliances. Bathrooms and bathroom
fixtures, Lighting fixtures and installation, laundry washer and dryer,
closets and doors for all areas. All this items must be installed in timely
manner in order for Contractor to meet the schedule propose on the
contract.
G. Contractor will gladly provide the client the service of helping you choose
all items needed in order to finish construction in timely manner. We will
manage shipping and handling for you to the property. Shipping and
handling is charged according to the material or items being delivered. We'll
make sure that all purchased items get installed successfully and in timely
manner.
H. We will deal with customer service. Any imperfection or broken item will be
return to the companies in order to get the right items. For this the owner
has to agree for Contractor to manage the products from the moment of
purchased to its delivery and installation.
Article 4. Construction Phases:
A. General Demolition: of existing Architectural Layout, Mechanical,
Plumbing, and Electrical as per plans and specifications.
B. Demo Inspections.
C. Structural layout. As per plan and coordination with architect
D. Walls Layout: (by others) Commencement of new walls and soffits layout
(framing).
E. E,M.P: (by others) Electrical, mechanical and plumbing begin rough work.
F. Rough Inspections: for Mechanical, Plumbing and Electrical and propose
new framing layout.
G. Approval of rough inspections determines initiations of finishes.
H. Drywall and finishes: (by others) Drywall installations, tile ceramic
installations, bathroom accessories installation, electrical fixtures

I. Carpentry installations: (by others) Bathroom vanities, Closets, doors
and base boards are items that are needed to pass final inspections. Please
make sure that your carpenter works accordingly with schedule due date.
Vanities should be provided first in order for plumbing to advance to its final
inspection.
J. Final inspections: Final inspections are called once all remodeling has
been finish and all areas in the unit are in perfect working conditions.
Electrical fixture must be all installed. Plumbing must be working
accordingly as well as mechanical work.
Article 5. General Provisions
Any alteration or deviation from the above specifications, including additional
alterations and involving additional material and/or labor costs, will be
executed only upon written change order for same, signed by Owner and
Contractor. If there is any charge for such alteration or deviation, the
additional charge will be added to the contract price of this contract. If payment
is not made when due, Contractor may suspend work on the job until such
time as all payments due have been made. A failure to make payments for a
period in excess of 7 days from the due date of the payment shall be deemed
a material breach of this contract.
In addition, the following general provisions apply:
A. The contractor & Sub contractors shall follow the approved drawing plans.
B. To the extent required by law all work shall be performed by individuals
duly licensed and authorized by law to perform said work.
C. Contractor may at its discretion engage sub -contractors to perform work
hereunder. Contractor, shall fully pay said sub -contractors and in all
instances remain responsible for the proper completion of this Contract.
D. Contractor shall furnish Owner appropriate releases or waivers of lien for
all work performed or materials provided at the time the next periodic
payment shall be due.
E. All change orders shall be in writing and signed both by Owner and
Contractor, and shall be incorporated in, and become part of the contract.
F. Contractor warrants it is adequately insured for injury to its employees and
others incurring loss or injury as a result of the acts of Contractor or its
employees or sub -contractors.
G. Owner shall at its own expense pay for all permits necessary for the work
to be performed. Contractor will do all diligences to obtain necessary
permits.
H. Contractor agrees to remove all exterior debris at owners cost and leave
the premises in broom clean condition at finish stucco exterior labor.
I. In the event Owner shall fail to pay any periodic or installment payment
due hereunder, Contractor may cease work without breach pending
payment or resolution of any dispute.
J. All disputes hereunder shall be resolved by binding arbitration in
accordance with rules of the American Arbitration Association.
K. Contractor Shall not be liable for any delays due to circumstances beyond

b. Permission by owner to Contractor employees and its subcontracts to enter
the premises.
c. PAYMENTS TOTAL: $74,646.00 to be pay Monthly as PPR show.
d. The following will be considered an extra to the owner if required after
completion of work described above: Furniture purchase, delivery and
installation. Boxes removal from premises and disposal. Decorations.
Miscellaneous expenses incurred on behalf of the project. Deliveries, labors
to adjust, assembly and installation of furniture.
• Certain additional costs are reimbursable in addition to compensation
and include actual expenditures during the process.

that the scope and magnitude to the facade changes do not warrant the need for planning
board approval.
The front of the facade is on 107th St. The front setback is 25 FT, uncovered steps may extend up
to 48 inches into the front yard, walls or a roof in conjunction with these steps is not permitted
Response: Sheet A-0.1 show the adjustment to the steps and columns. As per our meeting
the sheets A-1.0 and A-2.1 show that there is no new roof in conjunction with the steps, just
the existing eve prolongation line. Existing roof overhang to be demolished.
