("Contractor") to the customer ("Customer"). There are no other verbal or written warranties. There are no warranties which extend beyond the description on the face hereof, and NO WARRANTIES OF EXPRESS OR IMPLIED MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. General Terms - For the applicable time periods indicated below, this Warranty is transferable at no charge to future owners of the structure on which the work specified in this Contract is completed. This Warranty is in effect if the job specified in this Contract is completed and paid in full and, alternatively, is null and void if full payment is not received. Contractor does not warrant products not mentioned below, but some of such products may be covered by a manufacturer's warranty. Exclusions From This Warranty - This Warranty does not cover and Contractor specifically disclaims liability for: 1) exterior waterproofing; 2) system damage caused by Customer's negligence, misuse, abuse, or alteration; 3) dust incidental to installation; 4) damage to personal property of any type; 5) utility line breakage; 6) damage caused by mold; 7) failure or delay in performance or damage caused by acts of God (flood, fire, storm, methane gas, etc.), acts of civil or military authority, or any other cause outside of its control; 8) damage done during a lifting operation; 9) basement water seepage; 10) heave or any damages caused by it; and 11) damage caused by lateral movements and forces of hillside creep, land sliding or slumping of fill soils of deep embankments. Items For Which Customer Is Responsible - Customer is responsible for: 1) making full payment to the crew leader upon completion of the work; 2) preparing the work area for installation; 3) any finish carpentry, painting, paneling, landscaping, etc. that may be necessary after Contractor's work is finished; 4) marking any private lines such as satellite cables, propane lines, sprinkler system lines, etc.; 5) maintaining positive drainage away from the repaired wall(s); 6) keeping gutters clean and in good working order; 7) directing downspouts a sufficient distance away from the repaired wall(s); 8) maintaining proper expansion joints in concrete slabs that are adjacent to the repaired wall(s); and 9) any items mentioned in this Contract under "Customer Will" or "Additional Notes." Crawl Space Items for which the Customer is responsible: Customer is responsible for periodic inspections of installed equipment and for maintenance of equipment per manufacturer's recommendations. Customer is responsible for any flooding in the crawl space either from a storm event or a rise of the water table inside the crawl space. Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, or any underground utilities repairs, etc. that may be necessary after Contractor's Crawl Space work is finished unless stated in writing in the Contract. Clean Space Contractor warrants the "Clean Space Encapsulation System" will isolate the home from the earth in the areas in which the system is installed for a period of twenty-five (25) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the "Clean Space" installation. The Clean Space Encapsulation system will lower the humidity level in the air, reducing moisture needed for mold growth, however the encapsulation system does not claim to be a mold mitigation system. For maximum benefit the entire crawl space must be encapsulated. Wet crawl spaces require a drainage system and a sump system to remedy the problem with water below the Clean Space liner. THIS WARRANTY DOES NOT COVER, AND THE CONTRACTOR SPECIFICALLY DISCLAIMS LIABILITY FOR WATER DAMAGE TO FLOOR COVERINGS,FURNITURE, STORED ITEMS, FINISHED WALLS AND OTHER OBJECTS INSIDE THE CRAWL SPACE. Contractor will not be responsible for any damages caused by mold, to include but not limited to property damage, personal injury, loss of income, emotional distress, death, loss of use, loss of value, and adverse health effects, or any other effects. SmartJacks Contractor warrants that the SmartJacks will stabilize the affected area(s) against further appreciable vertical settlement in the areas were work was performed for twenty five (25) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the SmartJack work. Additionally, the manufacturer of SmartJacks warrants that SmartJacks will, under normal use and service, be free from defects in material and workmanship for twenty-five (25) years from the date of installation (see manufacturer's warranty for more details). If changes occur due to excess moisture in the area(s) where SmartJacks are installed, an encapsulation system, drainage, and dehumidification may be necessary in such area(s) at an additional cost to Customer. Contractor does not warrant lifting, leveling, to close cracks, to reduce floor squeaking, to render doors and windows operational or to move walls back to their original position, but will do its best to achieve positive results in this regard. Customer should also know that the possibility of further damages exists during a lifting operation, and that Contractor is not responsible for such issues. Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, or any underground utilities repairs, etc. that may be necessary after Contractor's SmartJack work is finished unless stated in writing in the Contract. Concrete Repairs-Crawlspace Contractor warrants the concrete repairs in the areas were work was performed for a period of ten (10) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the concrete repair. Wood Framing Repairs The proposed work includes the installation of framing members in the crawlspace. (i.e. joist repairs, ledger installation, beam repair) The new framing members are for the repairs to the existing framing inside of a crawlspace. The installation of the crawlspace framing members will not change the attitude (i.e. level) of the existing floor framing structure unless stated in writing in the job proposal. Contractor warrants the wood framing repairs in the areas were work was performed for a period of ten (10) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the wood framing repair. Pass-Thru Warranties Contractor assigns and passes through to the Customer the manufacturer's warranties for installed equipment (i.e. sump pumps, dehumidifiers, etc.). The only warranty on these items by the Contractor is limited solely to their being installed in accordance with the manufacturer's instructions. N Square, Inc. Axial compression tests completed at an independent laboratory on the assembled Smart JackTM system, with and without a precast concrete footing, resulted in ultimate values between 56 kips and 90 kips. While the rigidity and strength of the Smart JackTM components benefit installation and overall product stability, the allowable load applied to the Smart JackTM system will nearly always be limited by the bearing capacity of the existing soil. The well -compacted crushed stone or recycled concrete base is a proven method to increase support for the higher bearing pressure condition immediately below the concrete footing, and then to absorb and distribute lower pressures to the existing soils. Should settlement of the Smart Jack' system occur, adjustments are made easily by extending the all -thread rod. The Smart JackTM is designed to support axial compression loads only. The Smart JackTM should not be used in applications where the system is intended to resist lateral loads. Should settlement of the SmartJack® system occur, adjustments are made easily by extending the all -thread rod. The SmartJack® is designed to support axial compression Toads only. The SmartJack® should not be used in applications where the system is intended to resist lateral loads. Corrosion Protection The tube steel used for the SmartJack® is manufactured with a triple -layer, in -line galvanized coating. This coating process consists of: (1) a uniform hot -dip zinc galvanizing layer; (2) an intermediate conversion coating to inhibit the formation of white rust and enhance corrosion resistance; and (3) a clear organic top coating to further enhance appearance and durability. The inside of the pier tube also has a zinc -rich coating. The cast aluminum base is far less susceptible to corrosion than the steel components that surround it. There are, however, chlorides in some concrete that can be reactive with aluminum. It is recommended that a 20 mil x 16" square inert membrane be placed under the aluminum base to seperate it from recycled or poured concrete. Crushed limestone or other crushed stone alternatives do not have similar considerations. The remaining steel components of the SmartJack® system come standard as electrozinc plated per ASTM B633. Step 2 - Determine the Toad on the SmartJacks® by multiplying the calculated Girder Load (plf) by the spacing of the SmartJacks®: SmartJack Load (Ibs) = Girder Load (plf) x SmartJack® Spacing (ft) Step 3 - Verify that the calculated SmartJack® Toad is less than the allowable capacity provided by the various system components as well as the well -compacted crushed stone base and the bearing soils. Note 3: Without a detailed soil investigation, typical installations should assume no more than 1,500 psf allowable soil bearing pressure. This would equate to an allowable soil capacity of 6,000 Ibs for a 2'x2' poured concrete footing or a 2' cube of well -compacted crushed stone. Extremely soft soils may prohibit the use of a crushed stone base or require that a larger poured concrete footing be utilized. Step 4 - Size the new girder by entering the following table with both the SmartJack® Spacing (ft) and the calculated Girder Load (plf). Choose a girder that has an Allowable Load (plf) greater than the calculated Girder Load (plf).
