Florida Law requires Workers' Compensation insurance coverage under Chapter 440 of the Florida Statutes. Fla. Stat. § 440.05
allows corporate officers in the construction industry to exempt themselves from this requirement for any construction project prior to
:;btaining a building permit. Pursuant to the Florida Division of Workers' Compensation Employer Facts Brochure:
An employer in the construction industry who employs one or more part-time or full-time
employees, including the owner, must obtain workers' compensation coverage. Corporate officers
or members of a limited liability company (LLC) in the construction industry may elect to be
exempt if:
1. The officer owns at least 10 percent of the stock of the corporation, or in the case of
an LLC, a statement attesting to the minimum 10 percent ownership;
2. The officer is listed as an officer of the corporation in the records of the Florida
Department of State, Division of Corporations; and
3. The corporation is registered and listed as active with the Florida Department of
State, Division of Corporations.
No more than three corporate officers per corporation or limited liability company members are
allowed to be exempt. Construction exemptions are valid for a period of two years or until a
voluntary revocation is filed or the exemption is revoked by the Division.
Your contractor is requesting a permit under this workers' compensation exemption and has acknowledge that he or she will not use
day labor, part-time employees or subcontractors for your project. The contractor has provided an affidavit stating that he or she will
be the only person allowed to work on your project. In these circumstances, Miami Shores Village does not require verification of
workers' compensation insurance coverage from the contractor's company for day labor, part-time employees or subcontractors.

RE: APPEAL TO ZONING BOARDS DECISION

Dear Barbara Fugazzi:

I recently purchased the property at the above address with the intent of enclosing the garage. When I
tried to obtain the building permit I was informed by Miami Shores Building Department that I need special
permission from the Zoning Board prior to obtaining the permit. On October 24, 1996, I presented my
case in front of the Zoning Board. My case was approved with a condition. The condition was, for
harmonious reasons, my exterior access had to be relocated to the east side of the garage enclosure onto
the existing wood deck. I have no choice but to appeal this condition for the following reasons:
1. The elevation of the existing wood deck is at the same elevation of the finish floor of the house
which is approximately 12" above the required floor elevation the garage enclosure needs to be to be a
habitable room. The height of the existing concrete tie beam for the garage is over one foot lower than
the rest of the house. Raising the floor elevation of the enclosure to that of the existing wood deck will be
very costly by bringing in extra fill and possibly structural changes to the existing wall to retain the fill.
Also, the top of the windows in the enclosure will be lower than normal, creating an uncomfortable
ambiance. If I were to keep the enclosure floor at the elevation proposed, I would need to install interior
steps leading up to the door opening onto the wood deck. For this option, the Building Code requires to
have the steps lead to a 3 foot long landing, the same width as the door, prior to reaching the door.
Leading up to a 5' wide sliding glass door, these steps and landing will be approximately 6' wide x 4'
deep. This is not functional and will greatly reduce the usable square footage of the room.
2. The distance between the bottom of the existing concrete tie beam and the elevation of the
deck will not allow a 6'-8" door to be installed, which is required by the Building Code.
3. The existing Electrical Main connecting the electrical meter to the electrical panel runs
horizontally along the same east wall where the Zoning Board relocated the exterior access to. There is a
definite conflict with the proposed door and the Electrical Main. Relocating the existing 3" diameter
electrical conduit containing the electrical main which have been existing for decades can be extremely
costly.

4. I fail to see how can a location of a door constitute what is harmonious or not. No where in the
Code does it state that I am not allowed to have a sliding glass door at the rear of the garage enclosure as
I propose. No where does it state in the Code that I am not allowed to have a garage enclosure. I do
propose to extend the wood deck in front of the enclosure to be at the same elevation of the enclosure,
connecting it with the existing wood deck. Between the proposed wood deck and the driveway will be a
small landscape buffer. I believe this is more aesthetically pleasing than a garage door or a solid wall.

The purpose for enclosing the garage is that I have no need
for a garage and the existing garage with the existing utility
room and existing bathroom is not large enough to
accommodate a car to begin with. I do intend to have a
family and will need the extra room and bathroom. The
need for the exterior access, as explained to the Zoning
Board, is for direct access to the house from my car at
night. Being a single female living by herself I feel the need
to have immediate access to the house from the driveway.
The only other accessible door from the outside will be the
front entrance door. I will not feel secure walking from the
rear of the house to the front of the house late at night.
Another need for the exterior door is for the accessibility for
moving fumiture into the enclosure. The utility room will
°? make it virtually impossible to move large furniture, such as
a couch or bed, into the room.
I believe my appeal to the Zoning Boards request to
relocate the exterior access is very much justified by the
multiple reasons stated above. Please, with your kind
consideration, consider these reasons proper and merited
and grant my appeal. Thank you
