This matter came before the Construction Industry Licensing Board
(Board) pursuant to section 120.565, Florida Statutes. At a duly -noticed public
meeting held on November 15, 2013, in Ft. Lauderdale, Florida, the Board
considered the Petition for Declaratory Statement filed by Amramp of North and
Central Florida, who was present.
The Petition was filed with the Department of Business and Professional
Regulation on September 9, 2013. Notice of the Petition was published on
September 23, 2013, in the Florida Administrative Register. No comments were
received.
Having considered the Petition and relevant statutes and rules, the Board
issues the following:
FINDINGS OF FACT:
1. The facts considered by the Board are as alleged in the Petition, a copy
of which is attached hereto and incorporated by reference, and presented at the

meeting, with no further investigation by the Board.
2. Petitioner asks the Board whether their wheelchair ramp system is
exempt from the requirements of chapter 489, Florida Statutes.
CONCLUSIONS OF LAW
3. The Construction Industry Licensing Board has authority to issue this
Final Order pursuant to Section 120.565, Florida Statutes, and Rule 28-105,
Florida Administrative Code.
4. Petitioner is substantially affected, as required by section 120.565,
Florida Statutes.
Therefore, the Board hereby issues a declaratory statement that the
company's wheelchair ramp system is exempt from the requirements of Chapter
489 Florida Statutes, for residential installations only.
The applicability of this Declaratory Statement is limited to the set of facts
incorporated herein. This Final Order shall be effective upon filing with the Clerk
of the Department of Business and Professional Regulation.

The Amramp modular wheelchair ramp system is not like a typical wood or concrete
ramp The ramps are pre manufactured in Boston Massachusetts, and are assembled (not fabricated) at
the customers property
The Amramp ramp system conforms to the Federal Specification of DME (Durable Medical
Equipment).
It is not a permanent modification to the home The ramp is self-supporting and is not attached to
the home in any way The day before the ramp goes in and the day after the ramp is removed the home
will look exactly the same
The ramp is also considered chattel, 'a movable piece of personal property" The ramp can be
installed at a customers home, and if the customer moves the ramp can be disassembled and
reassembled at the customer's new home
Due to the healthcare systems typical short notice discharging of patients back home we are
often needed to place ramps at a customers homes that same day or the next day. This time frame would
be prohibitive of acquiring the proper permits Creating a situation where the patient would not be able to
safely gain entry into their home and would not be able to remain in the hospital

Chapter 489
489.103Exemptions.—This part does not apply to.
(6)The sale or Installation of any finished products, materials, or articles of merchandise that are
not fabricated into and do not become a permanent fixed part of the structure, such as awnings.
However, this subsection does not exempt in -ground spas and swimming pools that involve excavation,
plumbing, chemicals, or wiring of any appliance without a factory -installed electrical cord and plug This
subsection does not limit the exemptions provided in subsection (7)
The above referenced Florida Statute Chapter 489 103(6) clearly indicates that "finished
products. materials. or articles of merchandise that are not fabricated into and do not become a
permanent fixed part of the structure" are exempt. We believe that our Amramp modular wheelchair
ramp meets this criteria, as it is pre -manufactured, classified federally as DME, is not a permanent
modification to the existing structure, and is a movable piece of personal property.

Notice to Owner — Workers' Compensation Insurance Exemption
Florida Law requires Workers' Compensation insurance coverage under Chapter 440 of the Florida Statutes. Fla. Stat. § 440.05
allows corporate officers in the construction industry to exempt themselves from this requirement for any construction project prior to
obtaining a building permit. Pursuant to the Florida Division of Workers' Compensation Employer Facts Brochure:
An employer in the construction industry who employs one or more part-time or full-time
employees, including the owner, must obtain workers' compensation coverage. Corporate officers
or members of a limited liability company (LLC) in the construction industry may elect to be
exempt if:
1. The officer owns at least 10 percent of the stock of the corporation, or in the case of
an LLC, a statement attesting to the minimum 10 percent ownership;
2. The officer is listed as an officer of the corporation in the records of the Florida
Department of State, Division of Corporations; and
3. The corporation is registered and listed as active with the Florida Department of
State, Division of Corporations.
No more than three corporate officers per corporation or limited liability company members are
allowed to be exempt. Construction exemptions are valid for a period of two years or until a
voluntary revocation is filed or the exemption is revoked by the Division.
Your contractor is requesting a permit under this workers' compensation exemption and has acknowledge that he or she will not use
day labor, part-time employees or subcontractors for your project. The contractor has provided an affidavit stating that he or she will
be the only person allowed to work on your project. In these circumstances, Miami Shores Village does not require verification of
workers' compensation insurance coverage from the contractor's company for day labor, part-time employees or subcontractors.

Please note the aforementioned has been a patient of our practice for more
than 20 years.
Ms. Aquilino suffers from multiple medical issues including osteoarthritis to her
bilateral knees and diabetic neuropathy. Both cause her excruciating pain with
increased difficulty in walking.
Ms. Aquilino is unable to ambulate without her walker. The installation of a ramp
