After acceptance. as provided, the Seller shall be' given a reasonable time in which to make delivery of materials and/or to labor to"corntnerciai, the performance of the contract. (4) -- INSURANCE.- The Seller shall comply with'ail laws relating; to Workman's Compensation in the state where the Work is to be performed and shall carry Public Uability and`_Property Damage Standard form insur`ance. Insuring during the progress of the work any liability which may be imposed by law upon the Seller on account of accident arising from such operations. e' (5) WORKING CONDITIONS. The Sellers employees shall not be required to work in hazardous _conditions,•(such_as.on freshly_ painted, areas., in close proximity to uninsulated power lines, in noxious fumes, in unusually intense heat from furnaces, of where traveling cranes may strike their scaffolds), and the Buyer agrees to give the Seller's employee all reasonable cooperation to -mitigate such conditions. ,- (8) DAMAGE TQSELLER'• S WORK. ,The Buyer shall underwrite in behalf' of the Seller the const of any damage to Seller's work caused by the Buyer, his agents, and/or contractors or sub -contractors. And in the even of such,damages the same shall by repaired by the Seller, and the Buyer shall reimburse or cause to be reimbursed to the Seller for the same on the basis of cost and labor, materials and expenses plus 30% of the total for overhead and profit. Such payment shall be made on the tenth of the month following receipt of such statement from the Seller. Buyer shall assumethe risk of loss or damage resulting from fire, theft, misuse, wind, flood, or from any other cause to materials delivered upon the premises or installed by Seller and Buyer shall reimburse Seller upon demand for any such loss or damage. (7) CHANGES AND/OR ALTERATIONS. In the event there are any changes in the drawing and/or specifications from. those from which -the seller computed thesurn of this proposal; or if there is any departure -in construction from - said drawings, then it shall become the duty of both the Buyer and the Seiler. before proceeding with the affected work to compute the additional cost or credit for such changes, and thereby agree upon the sum to be added from the amount (8) CANCELLATION. This agreement may be cancelled either before or after commencement of the work by the mutual agreement of both parties herein, and in such an event the Buyer shall settle with the Seller as provide In paragraph 9. (9) COMPLETION AND ACCEPTANCE. • Upon completion the buyer shall immediately inspect Seller's work and issue an acceptance to the Seller provided the work has been completed according to the terms of the working contract and full settlement shall be made in accordance with this agreement. A tull and complete acceptance of the work shall be presumed upon the Buyer making final settlement and/or executing a note of final settlement. (10) LITIGATION. in the event of any litigation to enforce the terms this contract the prevailing party shall be entitled to be reimbursed for all costs and attomey's fees including those in incurred appellate review. (11) MODIFICATION. This contract may not be modified or terminated except in writing or signed by all parties herein. Any attempted waiver of any of the terms of this contract shall not be valid unless in writing and signed by the party against whom the same sought to be enforced. (12) ENTIRE AGREEMENT. The Buyer acknowledges that when Seller cleans, seals, or patches an existing installation there is no warranty as to the result of the work. M. Seiler does not warrant the sub -surface or any other item which we did riot install and which we have no control over. Since Seller has no control over future traffic. sun exposure, or use, Seller can not -guarantee the shine and coloration of the surface, N. Seller's Warranty is limited to the examination and repair of faulty installations caused by defects in material and workmanship to the flail dollar value are proven defective. No other express warranty or guarantee is given. 0 . Seller makes no warrantied. guarantees, nor shall Seller be liable for any further work after the work is completed and accepted by Buyer, except as may be provided in this agreement by a reference to specifications covering the proposed work or as may provide specifically in this Agreement; however, any such references and/or provisions shall be strictly construed only as an obligation on the Seller to issue a written guarantee upon completion of the work. It is mutually agreed that before any guarantees are binding upon seller. They roust be in writing whether issued voluntary. or in accordance with this proposal and that whenever the Seller, upon completion of the work as provided. shall issue to the Buyer such a written guarantee, the liability of the Seller shall be limited to the terms and provisions os such guarantees and confined to the work actually done hereunder, in no event shall such a guarantee impose upon the Seller any liability for damages caused by fire, tornado, hall hurricane or other extraordinary cause beyond Seller's control, nor damage to the building upon or.in,which such work is done; nor for any damage to said 'work:caused'by'settlentent warping;-ttislartion; of sari biiilUin nor for the failure of any materials orintegral:part of said building use as base, attachment to, or from, said work: nor for damage to interior furniture and fixtures decorations, stock, or equipment due yo leakage or otherwise.
