CALL TO ORDER Mayor Glinn called the meeting to order at 6:08 PM. 2. MOMENT OF SILENCE/ PLEDGE OF ALLEGIANCE 3. PUBLIC COMMENTS (3 Minutes Time Limit Per Speaker) No one present wished to comment on scheduled agenda items. 5. CONSENT AGENDA (Items are routine, self-explanatory matters and are not expected to require discussion or review. Items will be enacted by one motion. If discussion is desired by any member of the Council, that item must be removed from the Consent Agenda and considered separately. If the public wishes to speak on a matter on the Consent Agenda, they must inform the Village Clerk prior to the start of the meeting. They will be recognized to speak prior to the approval of the Consent Agenda) The Village Clerk read the introductory statement and the caption of each item contained on the Consent Agenda. A motion was moved by Vice Mayor Brady and seconded by Councilwoman Burch to approve the Consent Agenda. The motion passed unanimously. AWARD OF AUTOMATIC LICENSE PLATE RECOGNITION (ALPR) SYSTEMS RFQ 2017-08- 27 TO CINTEL LLC AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE ALL RELATED DOCUMENTS TO EFFECTUATE THE AGREEMENT (STAFF: VILLAGE MANAGER). Passed on Consent. 6. VILLAGEHALL WORKSHOP ITEM A. DISCUSSION AND PUBLIC INPUT ON THE PROPOSED COMPREHENSIVE MASTER PLAN Ms. Rodriguez read the caption of the item and noted for the record, due to an error of the Miami Herald, no official action will be taken on this item as advertisement requirements pursuant to 166.041, F.S., have not been met. Mayor Glinn opened the public hearing, but seeing no one come forward to speak on the proposed comprehensive plan, Mayor Glinn closed the public hearing. No action was taken due to the above stated reason. The notice of public hearing on the proposed Comprehensive Plan will be advertised in the Miami Herald to reflect a hearing date of October 2, 2018. Responding to Councilwoman Burch, Mr. Travis Kendall, Planning Director, clarified he did not provide an updated red line version on the Village website, as he was anticipating comments from the public and feedback from the Village Council during tonight’s meeting. 7. ORDINANCES ON SECOND READING- PUBLIC HEARINGS A. AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, AMENDING APPENDIX A, ARTICLE IV ESTABLISHMENT OF REGULATIONS, ZONING SECTION 410 (2) SCHEDULE OF REGULATIONS, REMOVING THE REQUIREMENT FOR PLANNING BOARD APPROVAL FOR ADDITIONS OF LESS THAN 400 SQUARE FEET, PROVIDING FOR CONFLICTS, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE (STAFF: PLANNING DIRECTOR). (THIS ITEM WAS APPROVED ON FIRST READING BY A 4/0 VOICE VOTE ON SEPTEMBER 4, 2018.) Ms. Rodriguez read the caption of the Ordinance into the record. Responding to the Village Council’s request for a sample size of prior requests for additions reviewed by the Planning & Zoning Board, Mr. Kendall reported his findings and recommended the Ordinance remain as presented. 3 Mayor Glinn proposed staff look into staff recovery costs associated with administrative reviews of Planning and Zoning applications. Mayor Glinn opened the public hearing, but seeing no one come forward to speak on the Ordinance, Mayor Glinn closed the public hearing. Mayor Glinn moved to adopt the Ordinance. The motion was seconded by Vice Mayor Brady. There being no further discussion, Mayor Glinn called for the vote, which was unanimous in favor of the motion. B. AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, RELATING TO ZONING; APPENDIX “A”, AMENDING ARTICLE V, “SUPPLEMENTARY REGULATIONS”, DIVISION 3 “HEIGHT REGULATIONS”, SECTION 508 “FINISHED GRADE OF PLOT”; PROVIDING FOR CONFLICT, CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE (STAFF: PLANNING DIRECTOR). (THIS ITEM WAS APPROVED ON FIRST READING BY A 4/0 VOICE VOTE ON SEPTEMBER 4, 2018.) Ms. Rodriguez read the caption of the Ordinance into the record. Mr. Kendall provided an overview of the item, thereby clarifying the various requirements pertaining to each flood zone. Mayor Glinn opened the floor to the public hearing, but seeing no one come forward to speak on the Ordinance, Mayor Glinn closed the public hearing. Individual Councilmembers offered their respective position on the use of considerable fill to raise the grade of plot in an effort to make properties more resilient versus the importance of the fill being harmonious with the surrounding neighborhood. The Village Council proposed amending the Ordinance to include the following language: Section 508 – Established grade of plot: • The finished grade of plot shall be not less than four inches above street level; but any use of fill shall be harmonious with the surrounding neighborhood. Mayor Glinn moved to adopt the Ordinance as amended. The motion was seconded by Vice Mayor Brady. There being no further discussion, Mayor Glinn called for the vote, which was unanimous in favor of the motion. C. AN ORDINANCE OF THE VILLAGE COUNCIL OF MIAMI SHORES VILLAGE, FLORIDA, RELATING TO ZONING; APPENDIX “A”, AMENDING ARTICLE V, “SUPPLEMENTARY REGULATIONS”, DIVISION 7 “QUALITY OF BUILDINGS”, SECTION 523.1 “CONSTRUCTION”; PROVIDING FOR CONFLICT, CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE (STAFF: PLANNING DIRECTOR). (THIS ITEM WAS APPROVED ON FIRST READING BY A 4/0 VOICE VOTE ON SEPTEMBER 4, 2018.) Ms. Rodriguez read the caption of the Ordinance into the record. 4 Mr. Kendall provided a brief overview of the item and explained the following corrections made to the Ordinance between first and second reading: In Section 523.1 (1)(d), the term “beams” was added. • “d. Trusses, and joists, and beams. Trusses and joists, and beams may be constructed of metal or wood.” In Section 523.1 (5) Trellises, arbors, and pergola, the following changes were made to the Ordinance: • “… to be designed by a registered architect and constructed of a material approved by the Florida Building Code. one of the following: pressure-treated Southern pine, cedar or redwood. with minimum timber sizes as follows: a. Support columns—Four inches wide by four inches deep, b. Main support beams—Nominal cross section of 16 square inches” In Section 523.1 (5), Mayor Glinn proposed deleting “of woods” on line 2 and replacing the term “timbers” with “members” on line 1. Mayor Glinn opened the public hearing, but seeing no one come forward to speak on the Ordinance, Mayor Glinn closed the public hearing. Mayor Glinn moved to adopt the Ordinance as amended with the changes cited above. The motion was seconded by Vice Mayor Brady. There being no further discussion, Mayor Glinn called for the vote, which was unanimous in favor of the motion. 8. DISCUSSION & POSSIBLE ACTION ITEMS A. DISCUSSION AND POSSIBLE ACTION ON AMENDING VILLAGE LITTERING ORDINANCES WITH INCREASED PENALTIES AND ENFORCEMENT TO THE NEXT COUNCIL MEETING (SPONSORED BY: COUNCILMAN JONATHAN MELTZ) Councilman Meltz provided a brief overview of the item and offered his perspective on the challenges associated with various types of littering caused in part by unsolicited and solicited material. He further proposed increasing the penalty fine for a first time offense to $250 and $500 for repeating offenders. Mr. Sarafan publicly thanked his staff, Darcy Cohen, for working on the item. He further mentioned his staff will continue to conduct research with respect to inserting language to distinguish between solicited and unsolicited material. Mr. Sarafan further recommended the Village engage the Miami Herald, the Egret, and other stakeholders for their input on the matter prior to the Village Council considering the Ordinance. Councilman Meltz spoke in support of asking deliverers of unsolicited material to place the material at the doorstep of the property. Responding to Vice Mayor Brady’s inquiry regarding the method by which the fines would be prosecuted, Mr. Sarafan indicated several options exists, such as prosecuting the fine in front of a Code Enforcement board or it can be taken to the County Court as a civil citation. Individual Councilmembers offered their respective position on the matter. 5 At the conclusion of the discussion, it was the consensus of the Village Council for staff to continue to modify the Ordinance for future Village Council consideration. No action was taken on this item. B. SEWER SYSTEM PROJECT UPDATE BY THE VILLAGE MANAGER. Mr. Benton reported Chase Bank on 97th Street is connected to the sewer system. 9. ANNOUNCEMENTS The Village Clerk read the announcements. 10. VILLAGE COUNCIL COMMENTS Councilman Meltz Councilman Meltz spoke about Green Day and the Farmers Market, which is scheduled on Sunday, November 11 and Saturday, November 3, 2018, respectively. Councilwoman Burch Councilwoman Burch spoke in support of the new 25 MPH speed signs and advocated for additional speed enforcement on NE 103rd Street. Councilman Zelkowitz Councilman Zelkowitz was not present. Vice Mayor Brady Vice Mayor Brady echoed Councilwoman Burch’s sentiments regarding speeding on NE 103rd Street and further encouraged more participation on Village Boards. Mayor Glinn Mayor Glinn spoke about the items on tonight’s agenda and closed by wishing residents who observe Yom Kippur an easy fast. 11. ADJOURNMENT There being no further business before the Village Council, the meeting was adjourned at 7:12 PM.
