Mr. Busta Motion to lift from table; seconded by Mr. Reese and the vote was unanimous in favor of the Motion. Mr. Robert Rossi and Jacqueline Barrantes were not present. Public comment by Valentina Gutches of 9839 NE 13 Avenue. She testified that she is the adjacent neighbor to the applicant on the South side. She reminded the Board that on the last hearing she had been informed that there was a violation on her Boat Lift. She received confirmation from DERM less than ten days ago. She is working on resolving the situation and will be working with DERM to fix the violation. She testified that they are going to challenge DERM’s pre-approval. She testified that they will be having problems docking their boat if their neighbor builds according to plans. She questioned the fact that DERM does not require letters of consent from the neighbors. Mr. Abramitis Motion to table until next meeting. Seconded by Mr. Diaz and the vote were unanimous in favor of the Motion. Site plan review and approval required. Change of use, office to retail and customer ceramic decorating experience. Staff is recommending approval with the conditions attached. Mr. Busta Motion to approve subject to Staff’s recommendations; Seconded by Mr. Diaz and the vote was unanimous in favor of the Motion. 3) PZ-01-16-201612: 30 NE 93rd Street, (Owner) Jude & Frances Faccidomo, (Applicant) Same, (Agent) Victor Bruce; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required. Garage conversion. Staff is recommending approval with the conditions as attached. Mr. Diaz Motion approve subject to Staff’s recommendations; Seconded by Mr. Reese and the vote were unanimous in favor of the Motion. 4) PZ-02-16-201613: 82 NW 98th Street, (Owner) Nyce C. Daniel, (Applicant) Same, (Agent) Rufus Orindare; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations and Sec. 600. Site plan review and approval required. One-story addition. Miami Shores Village, Planning Board Meeting Minutes: February 25, 2016; Not approved by the Planning and Zoning Board 3 Staff is recommending approval with one additional condition that the Applicant removes the screened enclosure. Rufus Orindare agreed to tear down the structure. Mr. Reese Motion to approve subject to Staff’s recommendation with the additional of a condition to tear down and remove the screen structure; Seconded by Mr. Diaz and the vote were unanimous in favor of the Motion. 5) PZ-02-16-201614: 1301 NE 100th Street, (Owner) Nancy Cigno Margolis, (Applicant) Same, (Agent) Brian Moretti; Pursuant to Articles IV, V and VI of Appendix A Zoning, Sec. 400 Schedule of Regulations, Sec. 534 and Sec. 600. Site plan review and approval required. Waterfront development. Seawall repair, dock and boatlift. Staff is recommending approval with the conditions attached. Public comment by Mr. Esteban Cerrano of 1290 NE 100th Street. Mr. Cerrano testified that he is opposed to his neighbors proposed dock and boatlift. Mr. Rossi testified that the way the D5 triangle works is that DERM only lets you go outside the D5 triangle without a letter of non-concern from a neighbor if it is done to avoid and minimize harmful effects on resources. Public comment is closed. Motion to table the item for later tonight made by Mr. Abramitis; seconded by Mr. Reese and the vote was unanimous in favor of the Motion. Motion to lift from the table made by Mr. Reese; seconded by Mr. Abramitis and the vote was unanimous in favor of the Motion. Motion that would permit the Seawall Repair subject to Staff recommendations as applicable to the Seawall made by Mr. Reese; Seconded by Mr. Abramitis and the vote was unanimous in favor of the Motion. Motion to table until next meeting made by Mr. Reese; seconded by Mr. Diaz and the vote was unanimous in favor of the Motion. VII) DISCUSSION 1) Barry University Campus Master Plan. Mr. Dacquisto reports that the Village Manager and he had discussions with Barry University about the closure of the streets that are part of the Master Plan. Miami Shores is doing a traffic study of the entire city. The question of the closure of 5th and 6th street are going to be added to that traffic study. Mr. Dacquisto is not expecting to hear back from Barry University until after that study. 2) Florida Friendly Landscaping, ground cover requirements. Staff was directed by the board to write draft landscape ordinance allowing additional low growing plants to be used for ground cover. Discussion ended. 3) Front yard hedge, height limit along high traffic streets, fence material and corner plots. Motion to direct staff to draft code language allowing taller hedges up 6’ in height along Biscayne Blvd., NE 2nd Avenue, NE 6th Avenue, and N. Miami Avenue as identified in the draft previously presented. Motion failed for lack of second. The Board requested that Staff put together a proposed change in reference to that. The Board commented on hedge height limit and line of sight triangle. Consensus was that minutes should be a short summary. IX) NEXT WORKSHOP – TBA, TENTATIVE TOPICS 1) None X) NEXT REGULAR BOARD HEARING – March 24, 2016.
