pz 7-26-07Planning and Zoning 1 May 24, 2007 MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD REGULAR MEETING July 26, 2007 The regular meeting of the Miami Shores Planning and Zoning Board was held on Thursday, July 26, 2007, at the Village Hall. The meeting was called to order by Richard Fernandez, Chairman at 7:00 P.M. with the following persons present: ROLL CALL: Richard Fernandez, Chairman Cesar Sastre (arrived at 7:00pm) Sid Reese Robert Abramitis ALSO PRESENT: David Dacquisto, Planning & Zoning Director Richard Sarafan, Village Attorney Valerie Bierley, Village Clerk Anthony Flores, Code Enforcement Officer ABSENT: Mark Ulmer Mr. Sarafan swore in all those participating in the meeting. BOARD MEMBER DISCLOSURES: Mr. Reese disclosed he visited each property. Mr. Fernandez disclosed he visited property 1200 NE 96 St.; 1361 NE 103 St.; 502 NE 106 St.; 10221 NE 13 Ave. Mr. Sastre disclosed he visited properties 1200 NE 96 St.; 1361 NE 103 St.; 9830 NE 2 Ave.; 9204 NE 3 Ave.; 174 NE 96 St. Mr. Abramitis disclosed he visited each property. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended approval of the proposed site plan with the finding that it is consistent with the technical provisions of the code subject to compliance with listed conditions. The applicant questioned Mr. Dacquisto but the Board did not. The applicant did not address the Board. The Board had no questions the applicant. Following discussion by the Board Mr. Reese moved to approve application, Mr. Abramitis seconded the motion and the vote was unanimous in favor of the motion 3-0 Planning and Zoning 2 May 24, 2007 PZ 5-07-200732 Miami Shores Center (owner) Sandra Stefani (applicant) 9830 NE 2 Ave. Sec. 600: Sec.400. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended denial of the site plan with a finding that it is not consistent with the technical provisions of the code. The board questioned Mr. Dacquisto. The applicant addressed the Board. The Board questioned the applicant and after a discussion from the board, Mr. Abramitis moved to deny the application Mr. Sastre seconded the motion and the vote was in favor of the motion 3-1. Mr. Reese voted no. PZ 5-07-200733 Tina Heffernan (Owners) Catherine Salow (applicant) 9204 NE 3rd Ave. Sec. 600: Sec. 523. Site plan approval, One story addition, pool and pool deck; Special Approvals, Sec. 600: Sec. 518. Fence in front yard; Errors and Variances, Sec. 702: Hardship variances. Sec.518. Fence height in front yard setback. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended approval of the proposed site plan with the finding that it is consistent with the technical provisions of the code subject to compliance with listed conditions. The applicant and the Board questioned Mr. Dacquisto. The applicant addressed the Board. The Board questioned the applicant and after further discussion Mr. Sastre moved to approve the application with the recommendations set forth by staff and modified the application to exclude the variance request. Mr. Abramitis seconded the motion and the vote was unanimous in favor of the motion 4-0. PZ 4-07-200734 Todd Leone (Owner) Ray Perez (applicant) 174 NE 96 St. Sec. 600: Sec. 504. Signs. Wall Sign. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended approval of the proposed site plan with the finding that it is consistent with the technical provisions of the code subject to compliance with listed conditions. The Board questioned Mr. Dacquisto. The applicant addressed the Board. The Board did not question the applicant, and after a discussion Mr. Abramitis moved to approve the application along with the recommendations set forth by Staff and adding that the owner may only keep one sign on Planning and Zoning 3 May 24, 2007 the building and must remove all others. Mr. Sastre seconded the motion and the vote was in favor of the motion 3-1. Mr. Sastre voted no. PZ 4-07-200735 Gabriella Contreras (owner) (applicant) 1200 NE 97 St. Sec. 600: Sec. 523. Site plan approval, addition, wall/fence, walkway and driveway; Errors and Variances, Sec. 702: Hardship variances. Sec. 518. Fence, height in side yard. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended approval of the proposed site plan with the finding that it is consistent with the technical provisions of the code subject to compliance with listed conditions. The applicant and the Board both questioned Mr. Dacquisto. The applicant addressed the Board. The Board questioned the applicant. Mr. Sastre moved to approve the application along with the recommendations set forth by staff and modified the fence height to 4ft. Mr. Reese seconded the motion. Mr. Dacquisto provided background information and summarized the information on the Staff Report. The Planning & Zoning staff recommended approval of the proposed site plan with the finding that it is consistent with the technical provisions of the code subject to compliance with listed conditions. The applicant did not address the Board. The Board did not question the applicant. After further discussion Mr. Abramitis moved to approve the application with all recommendations set forth by. APPROVAL OF MINUTES: Mr. Reese made a motion to hold the minutes until the next meeting, Mr. Sastre seconded the motion. Motion passed 3-0.
