The comments on the Planning and Zoning Critique Sheet dated March 2nd and March 9th of 2006 and found in the applicant file have yet to be adequately addressed. The front driveway has yet to be dimensioned and the rear lot coverage calculation is unclear. Please note that the Village Code restricts rear yard coverage to 20%. ((Sec. 409) Appendix A) Currently, plans do not express rear yard coverage calculation as a percentage. Please indicate on plans which areas are being included in the calculation and then express the result as a percentage. 2. At the time of the initial review, a survey was not provided. As a result, front, side, and rear dimensions could not be determined and a complete review could not be conducted. At the time of this review, a survey was made available and is has been discovered by staff that the proposed addition does not meet the rear setback required by Village Code. Please note that residential dwellings have a rear yard setback of 15’ while accessory building have a rear yard setback of 5’ providing that there is 15 feet between the accessory building and the main building. ((Sec 409) Appendix A) 3. Miami Shores Village Code does not make an exception for patio pavers within the side or rear setback. The use of a soft dashed line or “fade outs” to indicate the edge of pavement is confusing. Please indicate the edge of pavement by a solid lines and dimension pavement from side and rear property lines. 4. Please note that development of waterfront land is subject to the approval of the Planning and Zoning board and the review is made according to a criteria which includes the retention of the natural vegetation near the water’s edge. (Sec. 534) The large paved area adjacent to the waterfront appears to be in conflict with the intent of the Code, however, this determination can only be made by the Planning and Zoning Board during Site Plan Review. 6555 Nova Drive Suite 305  Fort Lauderdale, FL 33317  954--475-3070 Fax: 954--475-9550  www.mmaplanning.com 5. Please note that flat roofs are permitted on existing pitched-roof structures providing that they are approved by Planning and Zoning board and that they are not visible from the front elevation of the building on an inside lot. (Sec 523.1(e)). Applicant should consider whether the proposed flat roof will be visible from the front elevation. 6. Please note that Miami Shores Village Code can be accessed free online at www.municode.com if you would like to consult any of the sections referenced in this review. 7. Because extensive changes will need to be made to the current set of submitted plans. It is advised by staff that the applicant submit only one copy to Miami Shores Planning and Zoning office for a preliminary site plan review before resubmitting ten copies to the Planning and Zoning Board. If this option is pursued, the applicant will need to reschedule their hearing for the month of May. If the applicant would like to be heard on the April 20th meeting, ten (10) sets of revised plans will need to be submitted by April 10th to the Village providing that they address all of the comments above and meet all minimum code requirements.
