Flavio Carvalho, Variance—Setbacks
The following comments must be addressed by March 13th, 2006 in order to be placed onto the March
23, 2006 P&Z Board agenda:
1. The fee for a variance application is $225.00; please submit the rest of the required fee to the Village Hall.
2. The driveway cannot be wider than 20 feet at the rear property line. Please modify plans accordingly.
3. Remove portion of driveway within the front swale that extends parallel to NW 92nd Street. A circular
driveway is permitted in the swale, but the existing driveway is not. This can be made a condition of P&Z
Board approval.
4. Area Calculations Table states that there is a “Proposed Master Bath Addition.” Where is the addition on the
site? Please provide a detailed floor plan showing location and show on the site plan as well.
5. If the addition is part of this application, elevations of all sides of existing structure with proposed addition
must be provided. It is suggested that this statement be removed from this application and the master
bath addition submitted as a separate permit application.
6. Provide proof of permit for west side “existing paver walkway”. This area is really a patio. Patios must
conform to all setback requirements as well. If requesting a variance, an additional fee will be required. If
there is proof of permitting consider this comment void.
7. When the P&Z Board considers the variance request they look at evidence provided by the applicant. The
evidence should clearly show that there is a hardship placed on the property owner by the strict interpretation
of the Code, which, because of extremely unusual circumstances, is unique to the subject property. It is
recommended by the Code that the property owner provide evidence that shows:
a) the alleged peculiar and unusual conditions affecting the property
b) The alleged reasons why such conditions make it impossible strictly to apply specified provisions of this
ordinance to the property.
c) The request is the minimum variance necessary in order to enable the applicant to make a reasonable use of the
property.
d) The reasons why the applicant is of the opinion that such variance would be in harmony with the intent and
purpose of this ordinance, would not be detrimental to the existing use or prospective development of property
in the vicinity, and would not give to the applicant an advantage with respect to the use of his property that is
not enjoyed by the owner of similarly situated property.
8. With respect to #8 please provide a written narrative that explains the four points above. This narrative will be
entered into evidence for the Board to consider.
If you have any questions, please do not hesitate to call. All changes must be submitted by March 13th,
2006. Applicant must make changes to all sets of plans.
