Please refer to past exchanges pertaining to the captioned files. The applications have been approved and we are hereby adding five
crossings to the Blanket Agreement dated 4/12/00, and making revision to Schedule "A", as of 8/6/09, at an annual rental of
$1,824.76, $1,824.76, $1,824.76, $1,824.76 and $912.38. Enclosed is an invoice for the prorated annual fee payments. Copies of the
plans, Railway's insurance requirements for the construction and the revised Schedule "A" (report date 8/6/09) are also included.
In addition to the yearly crossing fees, the Railway will require installation at each new crossing location a conduit of equal size, with
two 1.5" innerducts dedicated to FEC with terminating Quazite handholes equipped with EMS locators placed within the right of way.
Railway handholes to be 18" below grade with EMS locators placed on top of handhole lid. Conduits to be extended 18" within
handholes, and proofed to industry standards. A letter of completion with as-builts, to be provided to FEC Railway upon final
installation. This requirement has been waived for the $3,000 buyout payment received for each location.
In compliance with the provisions of this agreement, and at least 72 hours prior to you or your contractors or subcontractors entering
upon Railway property an FEC flagman/watchman must be scheduled, and Railway's signal and train control cables must be located
by calling our Engineering and Signal Department at (800) 342-1131 ext. 2377. In addition, and also prior to any entry onto Railway
property by you, your contractors or subcontractors, in compliance with the Agreement a Certificate of Insurance naming Railway as
an additional insured must be submitted to the undersigned.
Please be advised several communications companies have installed a fiber optic communications system within the licensed area and
prior to any digging or subgrade work on the licensed premises, you must call "SUNSHINE" at 1-800-432-4770, in order that the said
companies will be properly notified and in turn can locate cables and protect against damages.
Inasmuch as these additional facilities constitute a change to the blanket agreement, please acknowledge your receipt and acceptance
by endorsing below and retuming one copy within 30 days of this letter to the undersigned.
