O-2018-031 ORDINANCE NO. 2018 -03 2 3 AN ORDINANCE OF THE MIAMI SHORES VILLAGE 4 COUNCIL OF MIAMI SHORES FLORIDA, 5 ESTABLISHING THE EDUCATION ADVISORY BOARD; 6 PROVIDING FOR CONFLICTS, PROVIDING FOR 7 SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE 8 DATE. 9 WHEREAS, Miami Shores Village (the "Village ") entered into an Education Compact with 10 Miami -Dade County Public Schools for the benefit of the students and residents of the Village to 11 address educational needs and enhance the learning opportunities; and 12 WHEREAS, the Education Compact contains provisions detailing activities and outcomes; 13 and 14 WHEREAS, the Village Council desires to create a board for the purpose of exploring, 15 recommending, and facilitating ways and means to pursue implementation of the activities and 16 outcomes detailed in the Education Compact, attached hereto as Exhibit "A ", between Miami - 17 Dade County Public Schools and Miami Shores Village; and 18 WHEREAS, the Village Council finds that this ordinance is in the best interest and welfare 19 of the residents of the Village; and 20 WHEREAS, the Village Council desires to create the Education Advisory Board. 21 22 NOW, THEREFORE, BE IT ORDAINED by the Miami Shores Village Council that the Village 23 Code shall be hereby amended to create a new Chapter 2, Article 10 to read as follows: 24 ARTICLE 10 - EDUCATION ADVISORY BOARD 25 Sec. 2 -126. Established; Mission; Membership; Meetings 26 (a) There is established an Education Advisory Board for the Village, which shall 27 consist of seven members chosen by the Village Council. The Village Council 28 shall make reasonable effort to seek to appoint members with backgrounds in 29 education, grant writing, public administration or such other backgrounds or 30 experience as deemed consistent with the mission of the Education Advisory 31 Board. The Parent Teacher Association (PTA) of Miami Shores Elementary 32 may designate an ex- officio member to serve on the Education Advisory Board. 33 All board members shall hold their office for a term of 2 -years from the date of 34 their appointment except as provided herein below. Each board member shall 35 hold office until his or her successor has been duly appointed, except when 36 removed by the Village Council (and any member maybe removed at any time 37 by majority vote of the Village Council). If any member fails to attend two of 38 three successive meetings without cause or notice, the board shall declare the 39 member's office vacant, and the village council shall promptly fill such vacancy 40 for the remainder of the term. 1 1 (b) The mission of the Education Advisory Board shall be to explore, recommend 2 and facilitate ways and means to pursue implementation of the activities and 3 outcomes detailed in the Education Compact between Miami -Dade County 4 Public Schools and Miami Shores Village. The Education Advisory Board shall 5 be an advisory board and shall report regularly to the Village Council, as and 6 when deemed appropriate, but at least annually. 7 (c) The Education Advisory Board may adopt its own rules of procedures and shall 8 meet when deemed necessary by the members thereof, but such meetings 9 shall occur at least quarterly. Such meetings shall be publically noticed a 10 reasonable period of time in advance of the meeting and shall be open to the 11 public. Minutes shall be kept of all meetings of the board. 12 (d) Nothing contained in these provisions shall be construed to constitute a 13 delegation of any legislative or fiscal authority by the Village Council to the 14 Education Advisory Board. 15 (e) As soon as practicable after the Village Council's appointment of the initial 16 members of the Education Advisory Board, all such members shall meet and 17 organize by electing one of their members as chairperson and such other 18 officers as they may deem necessary. At the initial organizational meeting of 19 the board members, the seven members appointed by the Village Council shall 20 draw lots to select three of the members to hold initial 3 -year terms, so as to 21 stagger the terms of such board members. All decisions by the Education 22 Advisory Board shall be by majority vote of the members then present and 23 voting. Four members of the Education Advisory Board shall constitute a 24 quorum and approval of any decision, proposal or measure by the board shall 25 require the affirmative votes of at least three members. 26 Section 1. All ordinances or parts of ordinances in conflict herewith or inconsistent herewith, 27 are hereby repealed, but only insofar as such ordinances may be inconsistent or in conflict with 28 this Ordinance. 29 Section 2. If any section, sentence, clause or phrase of this Ordinance is held to be invalid or 30 unconstitutional by any court of competent jurisdiction, then said holding shall in no way effect the 31 validity of the remaining portions of this Ordinance, which shall be deemed to be severable 32 therefrom. 33 Section 3.
