A RESOLUTION OF THE MAYOR AND VILLAGE COUNCIL OF
MIAMI SHORES VILLAGE, FLORIDA AFFIRMING APPROVAL OF A
"WAIVER OF PLAT" FOR THE PROPERTY KNOWN AS LOTS 22 & 23,
BLOCK 18, AMENDED PLAT OF MIAMI SHORES VILLAGE SECTION
NO. 1, TO ALLOW INDIVIDUAL PARCELS TO BE DIVIDED BY
"WAIVER OF PLAT" IN CONNECTION WITH THE VILLAGE
DOWNTOWN SEWAGE PROJECT; PROVIDING FOR
SEVERABILITY, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning Board held a public hearing on March 23, 2017 and
recommended to the village council approval of a waiver of plat regarding the property, and for
the purposes shown on the Planning Board Report and and Development Order attached as
Exhibits "A" and "B "; and
WHEREAS, Miami Shores Village is the owner of said property; and
WHEREAS, Miami Shores Village has provided an Opinion of Title and boundary survey;
and
WHEREAS, the requirement for platting has been met in prior plats of the lot and all right -
of -ways have been granted and recorded with the Clerk of the Courts in Miami Dade County; and
WHEREAS, the applicant, Miami Shores Village, is requesting that the County Board of
Miami -Dade County grant approval for the "Waiver of Plat" to split the Parent Tract into two
Parcels identified as Parcel "A" and Parcel "B" in the attached Legal Description.
NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
MIAMI SHORES VILLAGE, FLORIDA AS FOLLOWS:
SECTION 1. All the requirements of the Miami Shores Village Code of
Ordinances have been met and Approval of the requested "Waiver of Plat" is hereby
granted by the Village.
SECTION 2. If any clause, section or other part of this Ordinance shall be held
invalid or unconstitutional by any court of competent jurisdiction, the remainder of this
Resolution shall not be affected thereby, but shall remain in full force and effect.
SECTION 3. This resolution shall become effective upon its passage.

Planning and Zoning
Background
The village requests that the planning board approve a waiver of plat to authorized a simplified
process for subdivision to split a parent tract into 2 parcels.
The village installed a sanitary sewer system in the downtown and as part of that installation a
sewage pump station was constructed on village property on 97th Street, one -half block west of
NE 2nd Avenue in a village parking lot.
The proposed plat will split the parent parcel into 2 tracts. The village will retain Parcel B as a
parking lot and will deed Parcel A to Miami -Dade County as part of the turnover of the sewer
system to the county.
Analysis
Utilities are located where necessary and are not governed by the zoning code as are other land
uses.
Recommendation
Recommend Planning Board approve waiver of plat and plot split.

Parent Tract
Lots 22 & 23, Block 18, of "AMENDED PLAT OF MIAMI SHORES SECTION No.1 ", according
to the plat thereof as recorded in Plat Book 10 at Page 70 of the Public Records of Miami -Dade
County, Florida.
Containing 11,500 Square Feet or 0.26 Acre more or less.
Parcel "A"
A portion of land lying in lots 22 & 23, Block 18, of "AMENDED PLAT OF MIAMI SHORES
SECTION No.1 ", as recorded in Plat Book 10. Page 70, of the Public Records of Miami -Dade
County, Florida, being more particularly described as follows:
Commence at the Southeast corner of Lot 23, Block 18, of said Plat; thence run South 87'40'17"
West along the South line of Lot 23 also being the North Right -of -way line of NE 97th Street
(75.00 foot Right- of -way), a distance of 34.69 feet to the Point of Beginning; thence continue
along said South line of said Block 18 also being the North Right -of -way line of NE 97th Street,
South 87'40'17" West, a distance 65.31 feet to the Southwest corner of Lot 22, Block 18, of said
Plat; thence departing said North Right -of -Way line of NE 97th Street, run North 02 029'14" West
along the West Line of said Lot 22, a distance of 65.00 feet; thence leaving said West line run
North 87 040'09" East, a distance of 65.31 feet; thence run South 02 029'13" East, a distance of

Whereas, the applicant Miami Shores Village (Owner), has filed an application for site
plan review before the Planning Board on the above property. The applicant sought

Whereas, a public hearing was held on March 23, 2017 and the Board, after having
considered the application and after hearing testimony and reviewing the evidence
entered, finds:
1. The application was made in a manner consistent with the requirements of
the Land Development Code of Miami Shores Village.
2. The conditions on the property and the representations made at the hearing
merit consideration and are consistent with the requirements of the Land
Development Code.
