R-1256-14 RESOLUTION NO. 1256-14 A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL SUPPORTING THE REPEAL OF STATE PREEMPTION OF MUNCIPAL ORDINANCES CONCERNING THE FREQUENCY AND DURATION OF SHORT-TERM VACATION RENTALS,AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Prior to June 1, 2011, Miami Shores Village held authority to regulate vacation rentals based on their classification as vacation rentals, including regulation of frequency and duration; WHEREAS, In 2011, the Legislature passed CS/CS/CS/HB 883 which pre-empted to the State the power to regulate vacation rentals and prevented local governments such as Miami Shores Village from enacting any new law, ordinance, or regulation that restricted or prohibited the use of vacation rentals based on classification, use, or occupancy; WHEREAS, In 2014, the Legislature passed SB 356, partially removing the pre-emption to the State and permitting local governments to regulate vacation rentals, provided those regulations do not prohibit vacation rentals or restrict the duration or frequency of vacation rentals; WHEREAS, Miami Shores Village has experienced the use of residential homes as vacation rentals in a manner that is conducive to crime, disturbs neighbors, and negatively impacts property values; WHEREAS, In order to preserve the well-being of our residents and the residential quality of our community, the Miami Shores Village Council wishes to consider enacting municipal ordinances that concern the length and duration of vacation rentals within the Village. NOW,THEREFORE, BE IT RESOLVED BY THE MIAMI SHORES VILLAGE COUNCIL: Section 1. That the Village Council supports the adoption of legislation providing for the repeal, in whole or in part, of the pre-emption contained in Florida Statute §509.032(7), in order to allow municipalities such as Miami Shores to enact reasonable ordinances concerning the frequency and duration of short term vacation rentals so as to further the best interests of the residents in the Village's single family residential districts. Section 2. The Village Clerk is directed to forward a copy of this Resolution to the Miami-Dade County Delegation, Governor Rick Scott, the Speaker of the House and the Senate President. Section 3.
