A Resolution Authorizing the Village Manager and Village Attorney to
execute the final reimbursement agreement between the Florida
Department of Transportation ( FDOT) and the Village to close out
reimbursement requests for final distributions of cost reimbursements
due to the Village from FDOT for Hurricanes Katrina and Wilma.
WHEREAS, the Village incurred costs related to the clean-up of damages which
occurred during Hurricanes Katrina and Wilma; and,
WHEREAS, costs associated with "named" storms are paid by the Village and
reimbursed by FEMA and the Florida Department of Transportation (FDOT), in the amounts of
75%and 12.5% respectively; and,
WHEREAS, FEMA and FDOT have completed their final project review; and,
WHEREAS, both FEMA and FDOT have found the Village to be in compliance with
each storms' related reporting requirements; and,
WHEREAS, FDOT has withheld $95,411, ($69,881 and $25,530 related to Hurricane
Wilma and Hurricane Katrina respectively) as final payment to the Village; and,
WHEREAS, FDOT requires an Emergency Relief Program Agreement between the
Village and FDOT to release the final payments; and,
WHEREAS, Kenneth Robertson of the FDOT has requested this resolution which
authorizes the Village Manager and Village Attorney to execute the agreement for eligible
reimbursement.
NOW, THERERFORE BE IT RESOLVED BY THE MIAMI SHORES VILLAGE COUNCIL,
that:
1. The Village Council authorizes the Village Manager and Village Attorney to
negotiate and execute an Emergency Relief Program Agreement with FDOT to
expedite the final payments due to the Village for costs related to Hurricanes
Katrina and Wilma.
2. The resolution is effective immediately.
