R-1127-07 RESOLUTION NO. 1127-07 A RESOLUTION OF THE MIAMI SHORES VILLAGE COUNCIL, MIAMI SHORES VILLAGE, FLORIDA, VACATING A CERTAIN PORTION OF AN ALLEYWAY ADJACENT TO THE PROPERTY OF MIAMI SHORES CONDOMINIUM ASSOCIATION INC. RESERVING EASEMENTS FOR EXISTING UTILITIES IN PLACE, PROVIDING FOR ADDITIONAL CONDITIONS AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The Miami Shores Condominium Association Inc. ("Association') has requested that Miami Shores Village vacate a portion of the alleyway located between N.E. 90th and 91st Street , adjacent to the Association's properties, as set forth in the legal description and sketch attached hereto; and, WHEREAS, The Association intends to improve their property, such improvement plans to include providing additional parking for the unit owners and gated fences for the parking lot; and, WHEREAS, The Village Council deems the alley at issue to be no longer required for public use and the vacation thereof to be in the public interest; and, NOW, THEREFORE, BE IT RESOLVED, that the application for vacation and abandonment of the alley at issue is hereby conditionally approved, and the Village Manager is hereby directed and authorized to execute such documents as may be reasonably necessary to effectuate such abandonment and vacation, including Quit Claim Deeds in favor of the Association, at such time as the Association has satisfied the following conditions: 1) The Association provides the Village an opinion of Title confirming that the Association is record title holder of all properties adjacent to the alleyway to be vacated, together with a survey of the alleyway certified to the Village, all in a form acceptable to the Village Attorney; 2) The Association secures and files with the Village letters of"no objection"to the requested abandonment from all applicable utilities using the right of ways at issue, provided, nevertheless, that this Resolution shall in no manner affect the right of easement in and to said alleyway for any public utility erected or situated therein on the date of the adoption of this Resolution; 3) The Association agrees in writing to provide utility easements, if required by a utility or to accommodate existing utilities in such a manner as may be required by said utilities; 4) The Association fulfills all representations or offers of payment of compensation to the Village as consideration for the Quit Claim of any property interest of the Village in the alleyway to be abandoned, by paying a mutually agreed upon figure based on a certified appraisal, of the alleyway property. This approval will lapse and become invalid unless all conditions of approval contained herein are fulfilled and the abandonment and vacation is fully effectuated within one year of the date of this resolution.
